Eric dekenipp, a resident of potomac station, filed a suit against the School Board after their decision last year involving the redistricting of Leesburg school boundaries. AccordingtoDekenippsattorney,JohnWhitbeck,JudgeThomasHorneruledinfavorofthe SchoolBoardAug.20. ThecourtspowerovertheSchoolBoardislimited,Whitbecksaidinhisclosingstatements Aug.16.IftheSchoolBoardrulingisnotbasedonfact,laworreason,thecourthastheability tooverturnit. Dekenipp,whosreceivedaspecialwaiverfromLoudounCountyPublicSchoolsforoneyear, willhavehisdaughterattendJohnW.TolbertElementarySchoolthisfall.Thatisnotthecase for35otherstudentswhowillbebusedfromPotomacStationtheneighborhooddirectly acrossfromTolberttothenewelementaryschoolFrederickDouglass. TheCL19group,backedbyDekenippandWhitbeck,wantedtoseetheremaining35studentsin questionreturnbacktoTolbertthisfall. Theotherplaintiffinthecase,parentsofCL5,intheBeaconHillarea,alsobroughtacase againsttheSchoolBoardaddressinghowtheboarddisregardeditsbylawswhenadoptingthe newboundaries.ThenewplansplitstheCL19clusterandmovesneighborstodifferentschools. ItalsoaddresseswhichschoolswillholdspecialeducationclasseswhichCL5hadconcern over.Thenewplanwasdevisedtomovethefewestnumberofstudentsinordertocreateabetter boundarysystemandstabilityinschools. CL5sattorney,MichaelPetkovich,declinedcommentonthestatusofhiscase.
