PROVIDING for the appropriation of the amount of $3,995,840 from the Income Tax-Transit Fund to provide for the current expenses and other expenditures of the Southwest Ohio Regional Transit Authority (SORTA) for the period beginning February 1, 2013 and ending February 28, 2013, and FURTHER providing that no City funds provided to SORTA may be expended now or in the future by SORTA for the payment of legal fees and related expenses for legal activities taken against the City of Cincinnati, or its officers and/or employees. BE IT ORDATNED by the Council of the City of Cincinnati, State of Ohio: Section 1. That the amount of $3,995,840 from the Income Tax-Transit Fund is hereby authorized to be appropriated to the operating budget account 759x08 1x7200 for the current expenses and other expenditures of the Southwest Ohio Regional Transit Authority (SORTA) for the period beginning February 1, 2013 and ending February 28, 2013. Section 2. That with regard to any funds provided to SORTA by the City of Cincinnati to be expended for operations from February 1, 2013 through February 28, 2013, no such funds provided by the City pursuant to this ordinance or in the past, shall be expended now or in the future by SORTA for the payment of legal fees and related expenses for legal activities taken against the City of Cincinnati, or its officers and/or employees. Section 3. That the proper City officials are hereby authorized to do all things necessary and proper to carry out the terms of Sections 1 through 2 herein. Section 4. That this ordinance shall be an emergency measure necessary for the preservation of the public peace, health, safety and general welfare and shall, subject to the terms

of Article II, Section 6 of the Charter, be effective immediately. The reason for the emergency is that this ordinance provides for the appropriations for the current expenses of SORTA.
