SAN FRANCISCO — The fourplaintiffs in the U.S. SupremeCourt case that overturnedCalifornia’s same-sex marriageban tied the knot Friday, just hoursafter a federal appeals court freedgay couples to obtain marriagelicenses in the state for the firsttime in 4 1/2 years.State Attorney General KamalaHarris presided at the SanFrancisco CityHall wedding of Kris Perry andSandy Stier ashundreds of supporterslooked on andcheered. Thecouple sued tooverturn thestate’s voter-approved gaymarriage ban along with Jeff Katami and Paul Zarrillo, who mar-ried at Los Angeles City Hall 90minutes later with Mayor AntonioVillaraigosa presiding. “By joining the case againstProposition 8, they representedthousands of couples like them-selves in their fight for marriageequality,” Harris, who had askedthe appeals court to act swiftly,said during Stier and Perry’s brief ceremony. “Through the ups anddowns, the struggles and the tri-umphs, they came out victorious.”Harris declared Perry, 48, andStier, 50, “spouses for life,” butduring their vows, the Berkeleycouple took each other as “lawful-ly wedded wife.” One of their twinsons served as ring-bearer.Although the couples fought forthe right to wed for years, theirweddings came together in a flurrywhen a three-judge panel of the9th U.S. Circuit Court of Appealsissued a brief order Friday after-noon dissolving, “effectiveimmediately,” a stay it hadimposed on gay marriages whilethe lawsuit challenging the banadvanced through the courts.Sponsors of California’s same-sex marriage ban, known asProposition 8, called the appealscourt’s swift action “outrageous.”Under Supreme Court rules, thelosing side in a legal dispute has25 days to ask the high court torehear the case, and Proposition8’s backers had not yet announced

Appeals court lifts hold in California after U.S.Supreme Court ruling

ike the rest of California,the SanMateo County Clerk’s Office lateFriday received confirmation theNinth Circuit Court of Appeals lifted itsstay on same-sex marriages. The office of Mark Church,chief electionsofficer and assessor-county clerk-recorder,stayed open an extra hour until6 p.m.Friday to issue licenses and performceremonies if needed.For those whodidn’t jump on the chance the first day,here’s some information about the legalsteps toward tying the knot.Both people must obtain a license inperson with a valid government-issuedpicture identification between 8 a.m.and4:30 p.m.Monday through Friday at theoffice at 555 County Center,First Floor,Redwood City.There are noappointments and the process may take30 minutes depending on the line and if the online form was completed prior toarrival.A license is $78;a confidential marriagelicense is $80 and the marriage must takeplace in San Mateo County.Paymentincludes cash,Visa or Mastercard and thefee for a certified copy is not included. The marriage must happen within 90days of issuance anywhere in California.A county deputy marriage commissionercan perform a civil ceremony in the clerk’schapel by appointment Monday throughFriday.The chapel can be booked at oneof four times daily and holds 20 people,including one required witness.The costis $65.Ceremonies can also be broadcastonline.Individuals can be deputized as amarriage commissioner for one specificday by paying $60,stating an oath andsigning a certificate. The county clerk also maintains a list of marriage commissioners for civilceremonies.The list is available online.For more information,visitwww.smcare.org/clerk/marriage

Burlingame’s downtown couldbe getting free parking, temporar-ily, and a new mixed-use develop-ment under proposals that gobefore the City Council Monday. Downtown and BurlingameAvenue are going through somechanges. Portions of the road areclosed and construction is under-way. Work started earlier thismonth and should take 14 to 16months. On Monday, the councilwill consider allowing free park-ing during construction to boostbusiness. During the same meet-ing, the council will discuss enter-ing into exclu-sive negotia-tions withGrosvenor, aninternationalproperty devel-opment,investment andfund manage-ment group,interested increating a mixed-use project down-town. The Burlingame AvenueStreetscape project is expected tofinish next summer. Once com-pleted, Burlingame Avenue will bemore pedestrian-friendly whileparking is changed from slanted toparallel and the avenue’s two laneswill be thinned to a total of 20feet. Sidewalks will also bewidened from 10 to 16 feet withbulb-outs for smaller pedestriancrossing areas. The design willinclude more landscaping and out-side dining space.There are 113 parking spaces,excluding handicap spots, onBurlingame Avenue. Twenty-fourof those spaces are currentlyclosed off to the public duringconstruction. The remaining 89are metered between 8 a.m. and 9p.m., Public Works Director SyedMurtuza wrote in a staff report.

ASonoma county volunteer firefighteraccused of setting fire to land near a reservoir off Interstate 280 so he could watch the emergencyresponse received a year jail sentence on Fridayto start after he finishes serving time in SonomaCounty for similar crimes.Nathaniel Ridgway Schmidt, 20, faced up totwo years in prison after pleading no contestlast month to felony arson of forest land.Instead, he received half the amount plus fiveyears supervised probation. He was also orderedinto counseling and banned from possessingflammable and combustible items like torches,fireworks and matches. He will register for lifeas an arsonist.Schmidt confessed to the July 11, 2011 firenear the Crystal Springs Reservoir while beinginterviewed by a Sonoma County sheriff’sdetective about his attendance at four fires onthe coast between 2011 and 2012. SonomaCounty prosecutors also charged Schmidt withfour misdemeanor counts of phoning in falsereports to emergency dispatchers. Schmidt belonged to the Timber CoveVolunteer Fire Department and was near thelocal reservoir for controlled burn training withthe California Department of Forestry and FireProtection and the San Francisco PublicUtilities Commission. About 30 minutes after asupervisor directed him to walk the fire linelooking for hot spots, Schmidt reportedlyyelled that the fire was out of control and thathelicopters and fire units were needed before thecanyon burned. About a quarter-acre burnedbefore the fire was contained.Schmidt liked the excitement of watching theresponse to his reported emergencies, accord-ing to District Attorney Steve Wagstaffe.Schmidt will report to the county’s MaguireCorrectional Facility on Jan. 18 after finishinghis sentence in Sonoma County. He has creditof one day earned before posting $50,000 bail.

ADaly City parolee accused of holding hisgirlfriend under hot water to “know what thefires of hell are like” and forced her 3-year-oldson to bite her twice was sentenced Friday to40 years to life in prison. Judge Barbara Mallach denied MarcusRandel Smith, 41, a new trial and denied thedefense request to strike the prior convictionsfor the three-striker. After Smith proclaimedhis innocence in court and offered no remorsetoward his victim, Mallach said he “blamedeveryone except himself,” said DistrictAttorney Steve Wagstaffe. Maintaining his inno-cence is consistent withhis position throughoutthe case, said defenseattorney Paul DeMeester.“It’s hard so I’m veryremorseful but by the wayI’m very innocent,”DeMeester said. Wagstaffe called thesentence a good outcome for the case. DeMeester also noted that his clientreceived only 25 percent of the possible 160years to life term.Jurors deliberated six hours before convict-ing Smith of kidnapping, forced oral copula-tion, assault with a deadly weapon, falseimprisonment, making threats and misde-meanor domestic violence and assault byforce. Jurors acquitted Smith of child endan-germent.According to prosecutors, Smith attackedthe woman Feb. 24, 2012 because he ques-tioned her fidelity. Acable technician whoarrived at the home reportedly saw Smithpushing the woman around and she quietlybegged him not to leave but he did out of fear.She was ultimately able to escape to a neigh-bor’s home to call police.Before she fled, however, prosecutors told jurors Smith forced her into a bedroom toinspect her body for proof she was cheating.He also assaulted her and made the boy bite hertwice, according to the prosecution, althoughDeMeester said the jury’s acquittal discreditedthat allegation. He threatened to kill her andforced her under hot water while saying it rep-resented the fires of hell before he sexuallyassaulted her. He also reportedly brandished abaseball bat and threatened to kill her, accord-ing to prosecutors. Smith’s prior convictions are makingfelony threats and abusing a previous girl-friend.
