Pursuant to Rule 10.2 of the Supreme Court Rules of Practicc and Rule 41 ol'the Ohio
Rules of Civil Procedure, Relator petitions the Court to dismiss his Complaint for Writ of
Mandamus. In light of the close proximity of the primary election, the Court's order denying
Relator provisional placement on the ballot pending the final outcome on the merits of his claiin
has effectively precluded Relator from obtaining the ultimate relief he has sought in this case.
Accordingly, Relator petitions the Court to dismiss his complaint, without prejudice.
