DECISION AND ORDER

This matter comes before the Court on the plaintiff’s motion for an order directing the

issuance of letters rogatory to any court of general jurisdiction in the Holy See (State of the

Vatican City), requesting that such court effect service of the Summons and Complaint,

Notice of Suit, Foreign Sovereign Immunities Act, and Certified Translations on defendants

Joseph Ratzinger, Tarcisio Bertone, and Angelo Sodano. Fed. R. Civ. P. 4(f)(2)(B) (service

on an individual in a foreign country can be effected “as the foreign authority directs in

response to a letter rogatory or letter of request”).

This motion [D. 8] is GRANTED. However, the Court deleted the “facts of the case”

portion of the letters rogatory, since the summons and complaint will accompany the letters

and the allegations therein speak for themselves. The Clerk of Court is directed to docket

the letters rogatory as modified and executed accordingly. The Clerk will also send

plaintiff’s counsel certified copies of the same.
