FINAL JUDGMENT

This matter was before the Honorable Christine M. Arguello on February 8th and

9th, 2011, for a motions hearing on Plaintiffs’ Motion for Preliminary Injunction. The

Court heard the evidence and arguments of counsel. The Court made oral findings of

fact and conclusions of law which are incorporated herein by reference as if fully set

forth. Accordingly, it is

ORDERED that, pursuant to Fed. R. Civ. P. 58(a), judgment is hereby entered in

favor of Defendant Lt. General Michael C. Gould, Superintendent, United States Air

Force Academy, in his official capacity and against Plaintiffs R. David Mullin, the Military

Religious Freedom Foundation, and four individuals, unidentified, who proceeded as

“John Doe” plaintiff’s in this action. It is

FURTHER ORDERED that the Complaint and this civil action are DISMISSED

for lack of jurisdiction.
