Grosz v. MoMA: How Long Do Victims of Nazi Spoliation Have to Get Back Their Stolen Art?

Program Outline A petition for certiorari is currently pending before the Supreme Court in the Grosz v. MoMA case, which relates to New Yorks demand-and-refusal rule governing the accrual of the statute of limitations in stolen art cases. Recognizing the importance of this case, EMIPS joined in support of a recently filed amicus brief. Represented by Mr. Dowd, the Grosz heirs allege that MoMA refused their claims on April 12, 2006 and argue that there could be no conversion prior to such date because they agreed to leave the paintings with MoMA while the parties investigated ownership. They believe that they should have the opportunity to prove an equitable estoppel defense before a jury and object to their cases outright dismissal on a 12(b)(6) motion. In his presentation, Mr. Dowd will discuss this case in detail, including the underlying facts, the current state of the law and the policy issues that may be affected upon a final ruling. Biography Mr. Dowd is a Partner in the law firm of Dunnington Bartholow & Miller LLP in New York City. He represents business and individual clients, mainly in copyright, trademark in business and estate-oriented litigation and licensing. He is the author of Copyright Litigation Handbook (West 5th Ed 2010), described by The New York Law Journal as "an indispensable guide". Mr. Dowd serves as Vice President for the Second Circuit and General Counsel of the Federal Bar Association, and is a former chair of EMIPS.
