Complainant is not an attorney, neither is he represented by counsel in this matter; Complainant has specialized in analysis of integrity, or lack thereof, of government and banking electronic record systems. Given that Complainant is not an attorney, special lenience is requested in review of the complaint. No sections of the code were specifically referenced. Where errors were made in reference to the legal definition of the alleged crimes, Complainant requests that such references be disregarded. Instead - the facts alone should be reviewed, and the correct sections of the code be applied by the investigators. Over the past decade, Complainant specialized in analysis of integrity, or lack thereof, in large government and banking electronic records systems. [i ] 3. Accused Sarah Lifschitz [] Residence: Unknown Work: Supreme Court of the State of Israel, Jerusalem 4. Allegations Complainant alleges that SARAH LIFSCHITZ engaged in: a) Fraud through Falsification of Court Records [;] - b) Undermining Legal Process [ ,] and c) To the degree that SARAH LIFSCHITZ was duly appointed as Chief Clerk of the Supreme Court Honest Services Fraud [ ;] alternatively, in case she was not duly appointed as Chief Clerk False representation as Chief Clerk of the Supreme Court [.] The conduct of SARAH LIFSCHITZ, documented in instant complaint, undermines the Rule of Law, and the Human Rights of all residents of the State of Israel. 5. Chronology a) Background Upon information and belief, sometime during 2003, SARAH LIFSCHITZ started appearing as Chief Clerk of the Supreme Court of the State of Israel. However, the exact nature of her position in the Supreme Court remains unknown (see below). Complainant resided in the United States until April 2010, and has no direct knowledge of conduct of SARAH LIFSCHITZ prior to his return to Israel. Upon his return to Israel, Complainant initiated a study of the electronic records of the courts of the State of Israel, including, but not limited to, the Supreme Court. [ ii ] The study was based on data-mining of the online public electronic records of the Supreme Court, as well as submission of papers in the Supreme Court, and analyzing their registration and disposition. [ iii ]

Complainants study identified fundamental deficiencies in the integrity of the records that are published in the online public access system of the Supreme Court. As a rule, all online records, which have been published later than March 2002, appear void of any legal validity. Such records are not signed by the justices of the Supreme Court, not certified by the Chief Clerk, and bear a disclaimer, subject to editing and phrasing changes. Additionally, Complainants study documented that purported decisions of the Supreme Court were not duly served, as required by the law of the State of Israel. b) SARAH LIFSCHITZ issued false and deliberately misleading records and misrepresenting them as certified decisions of the Supreme Court. In order to ascertain the nature decisions, which were published and served in an invalid form, Complainant attempted to have such decisions of the Supreme Court certified by the Chief Clerk of the Supreme Court, pursuant to the Regulations of the Courts Office of the Clerk (2004), Regulation 6a. [ iv ] As part of his efforts to have the decisions certified, Complainant corresponded with SARAH LIFSCHITZ. In her February 29, 2012 letter SARAH LIFSCHITZ indicated that Complainant should address such requests for certification directly to her. [ v ] (Exhibit 1) On or about March 12, 2012, and March 25, 2012, Complainant forwarded requests for certification to the attention of SARAH LIFSCHITZ. [ vi , vii ] (Exhibit 2, 3) In response, Complainant received the March 29, 2012 letter from SARAH LIFSCHITZ. Attached to the letter were copies of three purportedly certified decisions of the Supreme Court. [ viii ] (Exhibit 4) Upon examination of the purportedly certified decisions, Complainant concluded that the records provided under the signature of SARAH LIFSCHITZ, as Chief Clerk of the Supreme Court, were false and deliberately misleading court records, for the following reasons (Figures 1,2): i. If valid original judicial records had existed for any of the three decisions, they would have been the records signed by the respective justices/judges. The records at hand are not signed by the justices/judges. ii. Valid, certified court records cannot possibly be subject to editing and phrasing changes, as indicated in the disclaimer on the records at hand. iii. The certification statement used by the Chief Clerk on the records at hand is invalid: o The Regulations of the Courts - Office of the Clerk (2004), Regulation 6a, explicitly states, that the certification statement, which the Chief Clerk is permitted to execute is Copy Corresponds to the Original [ .] o The March 29, 2012 cover letter of the records, signed by Chief Clerk SARAH LIFSCHITZ, also purports the same: that the attached records bear the certification statement, Copy Corresponds to the Original. o In contrast, the attached records are stamped Copying Corresponds to the Original [.] iv. The records were misleadingly stamped with the Seal of the Supreme Court.

The footnote says, "copy subject to editing and phrasing changes", then shows the Seal of the Court, and the invalid, false certification stamp, "Copying Corresponds to the Original," with the hand signature of the Chief Clerk and the date of March 29, 2012.

On or about April 4, 2012, Complainant forwarded to SARAH LIFSCHITZ a request for new certification of the three records, correcting the deficiencies found in the records at hand. [ ix ] (Exhibit 5) No response on the request has been received to this date. Therefore, SARAH LIFSCHITZ issued false and deliberately misleading court records and misrepresented them as certified decisions of the Supreme Court. Complainant alleges that in doing so, SARAH LIFSCHITZ engaged in Fraud and Deceit through the Falsification of Court Records [ ,] - and Undermined Legal Process [.] c) The nature of SARAH LIFSCHITZs appointment in the Supreme Court remains vague and ambiguous.

The findings, pertaining to the records, provided by SARAH LIFSCHITZ as certified decisions of the Supreme Court, were not unique. Other findings also raised doubts relative to the nature of SARAH LIFSCHITZs appointment in the Supreme Court. [ x ] On or about March 2, 2012, Complainant filed a request with the office of Administration of Courts, pursuant to the Freedom of Information Act (1988) (the Act), seeking the legal public record, which is the appointment record of SARAH LIFSCHITZ as Chief Clerk of the Supreme Court. [ xi ] The March 6, 2012 response by the office of Administration of Courts denied the request. The response claimed that the requested record was exempt from the Act, as a record of internal deliberation. [ xii ] On or about March 28, 2012, Complainant filed a request for reconsideration with the office of Administration of Courts. Complainant claimed that it was inherent to Due Process/Fair Hearings rights to unequivocally ascertain the identity of the person, who lawfully held the authority of Chief Clerk of the Supreme Court. [ xiii ] Complainant has not received to this date a response on his request for reconsideration. On or about March 29, 2012, Complainant also forwarded a request to SARAH LIFSCHITZ, to clarify the nature of her appointment by providing a copy of her appointment record as Chief Clerk of the Supreme Court. [ xiv ] (Exhibit 6) Complainant has not received to this date a response from SARAH LIFSCHITZ on his request. Therefore, the nature of SARAH LIFSCHITZs appointment in the Supreme Court remains vague and ambiguous. Complainant alleges that in providing the false and deliberately misleading records (Figures 1, 2) SARAH LIFSCHITZ engaged Honest Services Fraud [ ] in case she was duly appointed as Chief Clerk of the Supreme Court; alternatively, in case SARAH LIFSCHITZ was not duly appointed as Chief Clerk, she engaged in Falsely Representation as Chief Clerk of the Supreme Court [.] 6. The conduct, documented in instant complaint undermines the fundamentals of Due Process/Fair Hearings, the Rule of Law, and the Human Rights of all residents of the State of Israel. The conduct of SARAH LIFSCHITZ, documented in instant complaint undermines the integrity of the Supreme Court of the State of Israel, and with it, the Rule of Law, and the Human Rights of all residents of the State of Israel. 7. Request for due process in acceptance, acknowledgement, review, and informing Complainant of the outcome of instant complaint. Complainant requests that the Israel Police acknowledge receipt of instant complaint, enter valid registration of the complaint, subject the complaint to honest and expedient review, and duly inform Complainant of the outcome of such review. 8. Any party interested in getting a stamped certification on a decision of the court may call or write the court and request to receive such certification and that will be provided.

I have previously visited the Office of the Clerk of the Supreme Court and asked in person for the certification of three decisions of the Court. My request was denied, and the staff of your office instructed me that certification was provided only upon explicit order of the Supreme Court. Therefore, I was instructed to file motions under the respective cases, requesting the certification. Consequently, I filed such motions, as instructed. [i-v] No decision of the Court on any of the motions was received to this date. Separately, I have previously filed two requests for apostille certification of public records of the Supreme Court, which were intended for international review, with the office of Courts Administration. [vi-viii] Neither records was apostille certified to this date. Following your letter, I ask that you deem the requests, [i-viii] as addressed to you. The certification statement is not the one authorized by law, neither the name and authority of the Chief Clerk, nor the true date appear in the certifications. The fact that such stamp exists, and that Chief Clerk Sarah Lifschitz uses it, must raise serious concerns. Since all three decisions are claimed to be simulated, illegal public records, the false certifications should also be deemed deliberately misleading.

[3] The March 29, 2012 Chief Clerk Sarah Lifschitz cover letter also purports that the attached records bear the stamp Copy Corresponds to the Original (Heeteq Matim la-Maqor). The individual copies of the decisions (which were not signed by the issuing judges), were stamped Copying Corresponds to the Original (Haataqah Matimah la-Maqor).

The certification stamp fails to show the name and authority of the signer (e.g. Sarah Lifschitz, Chief Clerk) Since the original legal records in this case should have been decisions records, signed by the issuing judges, it remains vague and ambiguous, why the Chief Clerk certified unsigned copies of the decisions. The Chief Clerk refused to certify other decisions/records, with no foundation in the law. The denial letter claimed exemption for the records under a clause for internal deliberations. [1-3] The most plausible explanation for this exchange is by accepting the response of the Administration of Courts verbatim: Both the appointment of Chief Clerk Sarah Lifschitz and the certification procedures of electronic records of the Supreme Court have been left in "deliberations" for years.
