5 MarkandAmyDenicoreappearedincourtMarch14againsttheCommonwealthofVirginia onlytospendmorethantwohourslitigatingandwillnowhavetocomebacktocourtinMay. ThecouplefromWaterfordwereservedasummonsonJan.31foraClass3misdemeanorfor theirdaughterSophiesexcessivetardinesstoschool.TheDenicoreswerealsocitedforthe tardiesoftheirtwootherchildren,TuckerandDaisy. TheDenicoresadmittheyrenotperfectparents.Theirthreechildrenhavebeenlatetoschool morethan85timessinceSeptember,butthemajorityofthetimetheymissedtheopeningbell byonlyafewminutes. TheDenicoresappearedbeforeJudgeJamesRobeson.SeniorAssistantCommonwealth AttorneyAlejandraAlexAmatoisprosecutingthecase.TheDenicoresfaceupto$3,000in finesandamisdemeanorchargeontheirrecords,whichcouldaffectMarkDenicore,a lawyer,andhislawlicense. LoriMelcher,LoudounCountyPublicSchoolsattendanceofficer,toldthecourtthatthe schoolhadreachedoutnumeroustimestotheDenicoresforthemtomeetwithschool officialstoaddressthetardyproblemswiththeirchildren,buttheydeclined.Melchersaid MarkDenicoretoldherthatshewasmisrepresentingthelawandthatsheneededtoget heracttogetherandwouldntmeetwithher. Melchersaidthatbetweenthe2010and2012schoolyearsSophiehadbeenlateatotalof655 minutes,Daisywaslate802minutesandTuckerwaslate297minutes. MelcheralsomentionedthatAmyDenicorewasawareofaJan.17meetingbutrefusedtoget outofhercarwhenshedroppedoffherchildren. AmyDenicorewouldntmeetwithofficialsuntilLCPSsoughtcouncilbecausetheyfeltthat tardiesarenobigdealanditsagainstthelawfor[Melcher]toquestionherchildrens tardies,Melchersaid. Melcher,astheactingattendanceofficerforLoudounValley,WoodgroveandLoudoun Countyhighschoolsandtheirfeederschools,isresponsibletoenforcethestatecodethat studentsshouldbeinschoolforthesameamountofhoursanddayseachschoolyear. MarkDenicorefeltthatparentsarentgivenenoughwarningabouttheimplicationsiftheir childrenarelatetoschooltoomanytimesaresultthatcouldleadtocriminalcharges. Itdoesntdefinewhatschronicorexcessive,MarkDenicoresaid. Itsnotacrime,hecontinued.Hesaiditsanabuseofpowerfromtheschoolsystem.He alsoquestionedthemeaningofthelawhisfamilyisaccusedofviolating. Ithinkyoubeinganattorneyyouwouldknowthelaw,JudgeRobesonsaid. UndertheStudentsRightsandResponsibilitiesAct,after15ormoreconsecutiveabsencesor excessivetardiestheVirginiaAdministrativeCoderequiresthestudentbedroppedfromthe attendancerolls.Itsthenuptotheprincipaltodisciplinethechild.
