PROCEEDING (IN CHAMBERS): ORDER REINSTATING DEFENDANTS MOTION TO DISMISS AND SETTING BRIEFING SCHEDULE Before the Court is a Notice Regarding Plaintiffs First Amended Complaint (Notice) filed by Defendants. (Dkt. 11). The Court finds this matter appropriate for decision without oral argument. Fed. R. Civ. P. 78; Local Rule 7-15. The Court GRANTS the Notice. This Court previously stated that if Plaintiff wishes to file an Amended Complaint . . . Plaintiff is free to do so under Rule 15. (Dkt. 10). The day after that order issued, Plaintiff filed a First Amended Complaint. (Dkt. 12). Defendants Notice requests that their Motion to Dismiss (Dkt. 7) be operative against the First Amended Complaint as that document adds no new factual allegations or legal theories and instead only adds new Plaintiffs. The Court agrees and thus GRANTS the Notice. Plaintiff shall file an Opposition to Defendants Motion to Dismiss (Dkt. 7) on or before noon on July 20, 2012. Defendants shall file a Reply, if at all, on or before noon on July 27, 2012. The Court does not alter the hearing date of 8:30 a.m. on August 6, 2012. The Clerk shall serve this minute order on all parties to the action.
