The parties having appeared for a case management status conference on August

1. Plaintiffs shall submit a voluntary dismissal ofPreston v. FT 7th Ave LLC et aI.,
No. 12 Civ. 3270 (WHP), without prejudice by August 24,2012;
2. The parties are directed to submit a joint pretrial order, a joint request to charge
the jury, and any voir dire unique to this action by October 24,2012;
3. A final pretrial conference will be held on October 26,2012 at 10:00 a.m.; and
4. Trial of this action will commence on November 5, 2012, subject to the Court's
criminal docket.
