WORKMEN COMPENSATION:
Workmen compensation basically is a step to overcome the losses of workers or there dependents.

WHAT IS WORKMEN COMPENSATION ACT ?

Workman's compensation is a system to compensate employees when they are injured at work.

These laws are strict liability, fault and negligence by the employer or employee entitles employee to receive benefits.
This system compensates the employee or there dependents for medical costs, lost wages, and any other losses.

HIGHLIGHTS OF WORKMEN COMPENSATION ACT


Worker's compensation legislation requires the employer to furnish a reasonably safe place to work, suitable equipment & rules and regulations. Employer has to compensate his employees for injuries cause by accident, so the burden doesnt gets on the employee. If death or permanent and total disablement of a worker results from the injury, the employer has to pay the dependents of that employee. The employer has no liability for an injury that results in total or partial disablement for less than four days. Employer also has no liability for injuries if the worker willfully disobeyed the orders /safety rules and disregarded the safety guard or other device provided for safety of workers.

APPLICATIONS FOR WORKMEN COMPENSATION


Either he may sue his employer for damages in ordinary civil court, OR He may proceed under the act and institute a claim to compensation before a (workmen compensation) commissioner, OR Make an agreement with the employer for providing the compensation for injury in respect of the provisions of this act.
