A BILL ______ IN THE COUNCIL OF THE DISTRICT OF COLUMBIA ________________ Councilmember Marion Barry introduced the following bill, which was referred to the Committee on __________________. To amend the Advisory Neighborhood Commissions Act of 1975 to eliminate the prohibition on Commissions initiating actions in the courts and to eliminate the prohibition on Commissions using their allocated funds for legal expenses associated with Commission business.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the Advisory Neighborhood Commissions Empowerment Amendment Act of 2012.. Sec. 2. The Advisory Neighborhood Commissions Act of 1975, effective October 10, 1975 (D.C. Law 1-21; D.C. Official Code 1-309.01 et seq.), is amended as follows: (a) Section 13 (g) (D.C. Official Code 1-309.10(g)) is repealed. (b) Section 16 (l)(2) (D.C. Official Code 1-309.13(l)(2)) is amended to read as follows: (2) Funds allocated to the Commissions shall not be used for a purpose that involves partisan political activity, personal subsistence expenses, Commissioner compensation, meals, personal legal expenses, or travel outside of the Washington metropolitan area.. Sec. 3. Fiscal impact statement. 1

The Council adopts the fiscal impact statement in the committee report as the fiscal impact statement required by section 602(c)(3) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code 1-206.02 (c)(3)). Sec.4. Effective date. This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), a 30-day period of Congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code 1-206.02 (c)(1)), and publication in the District of Columbia Register.
