Case No. 12-24882 ABC Chapter 11

ORDER GRANTING CLASS REPRESENTATIVES MOTION FOR PROTECTIVE ORDER REGARDING DEPOSITIONS Before the Court is the Class Representatives Motion For Protective Order Regarding Depositions ("Class Representatives' Motion"). Cheryl M. Foley, Thomas and Jane Wilner, Charles and Mary Jackson and Kevin B. Allen, as representatives of a certified class in a case pending in the District Court of Eagle County, Colorado ("Class Representatives"), filed their Class Representatives' Motion seeking a protective order because Debtor served notices of their depositions for days that conflict with a mediation scheduled by the parties. The Class Representatives assert that they were unable to reach an agreement with the Debtor to reschedule the depositions. Pursuant to L.B.R. 7026-1 (d) and Fed.R.Bankr.P. 7037(d)(2), the depositions set for September 11, 12, and 13, 2012 are automatically stayed by the filing of the Class Representatives' Motion. Accordingly, it is ORDERED that the Class Representatives' Motion is GRANTED and the depositions, notice of which the Debtor served for September 11, 12 and 13, 2012 are stayed; and it is FURTHER ORDERED that IF THE PARTIES CANNOT REACH AN AGREEMENT on the timely rescheduling of such depositions, the deponents listed below shall appear at the offices of Sender & Wasserman, P.C., 1660 Lincoln Street, Suite 2200, Denver, CO 80264 at the following dates and times to be deposed for a maximum of three (3) hours for each deponent:
