DECLARATION OF NO OBJECTION Pursuant to section 1746 of title 28, the undersigned hereby certifies the following: 1. On March 24, 2011, the Official Committee of Unsecured Creditors (the

Committee) of Lehr Construction Corp, the debtor (Debtor) herein, filed an application to employ Klestadt & Winters, LLP, as its attorney (Docket No. 95) (the K&W Application). The Committee filed a notice of presentment of the K&W Retention Application on March 28, 2011 (Docket No. 100), requesting that all objections to the Application be filed and served so as to be received on or before April 11, 2011. 2. On March 25, 2011, the Committee filed an application to employ J.H. Cohn LLP

as financial advisors and forensic accountants to the Committee, effective as of March 15, 2011 (Docket No. 97) (the JHC Application), and it filed a notice of presentment of the JFC Application on March 28, 2011 (Docket No. 101), requesting that all objections to the Application be filed and served so as to be received on or before April 11, 2011.

As of the date herein, no objections have been filed with respect to either the

K&W Application or the JHC Application. 4. It is hereby respectfully requested that the Court approve both the K&W

Application and the JHC Application and enter orders consistent therewith.
