Notice is given that Roy Warden, Plaintiff in the above captioned case, hereby appeals to the United States Court of Appeals for the Ninth Circuit from an Order of the Court entered in this action on November 16, 2012 which (1) dismissed Defendants as "time barred" who were clearly not time barred, and (2) denied Plaintiffs Motion to Amend Complaint, as provided by Noll v Carlson, 809 F.2d 1446 (9th Cir. 1987).
