MIP-007 : ENFORCEMENT OF INTELLECTUAL PROPERTY RIGHTS

Give any two major causes for growth of intellectual property crimes. What are the criminal remedies provided under the Indian Copyright Act, 1957 for violation of copyright ? Explain forms of evidence important in determining facts in IP litigation. Explain the fence post approach. Explain the term 'Geographical Indications'. What do you understand by term injunction ? (g) What is the role of Interpol for the prevention of IP crimes ? MIP-007 1 P.T.O.

5x5=25 Attempt any five parts : Write a note on Pitu and Marrow Doctrine. Discuss remedies for infringement of Trademarks and industrial design. Explain the terms counterfeit trademark goods and pirated goods in the light of TRIPS Agreement. Describe the role of Indian Customs Department in combating Intellectual Property Crimes. Explain the role of WIPO in domain name dispute resolution. State the grounds/basis on which court can set aside an arbitral award. (g) What reforms should be made in India to reduce piracy and to make the enforcement system in parity with TRIPS obligations ?
