Origins of Criminal Law

1 Conflict Model The content of criminal law is determined by the groups that hold economical, political and social power in a community. Groups can be social class, income, and race based.

2 Consensus Model The majority of citizens in a society share the same values and beliefs. Criminal acts are those acts that conflict with these values and beliefs and are deemed and harmed by the society.

3 Definition of Crime An action \or activity that is punishable under the criminal law as determined by the majority of society or, in some cases, a powerful minority Considered an offense against society as a whole and prosecuted by public officials, not victims Punishable by statutuality determined sanctions that bring about the loss of freedom or life

4 Types of Crimes Violent Crimes Property Crimes Public Order Crimes Organized Crimes Cyber ( High Tech ) Crimes White Collar Crimes

5 Violent Crimes (Crimes committed against persons ) Murder, or unlawful killing of a human being Sexual assault or rape Assault and battery Robbery - the forceful taking of money, property, or other item of value from a person by means of force or fear

6 Property Crimes Larceny Theft Burglary Arson Property crimes are the most common types of crimes in America

7 Public Order Crimes Behavior that has been labeled criminal because it is contrary to shared soial values, customs and normal. Examples of Consensus Prostitution, gambling, drug use, falsely victimless crime

8 White Collar Crimes Non-violent crimes commited by corporations and individuals to gain a personal or business advantage ( See Page 9 of textbook )

9 Organized Crime A conspirational relationship between any number of persons engaged in the market for illegal goods or services such as illicit drugs, fire arms, gambling, prostitution, pornography, loan sharking, counterfeiting and credit scams. The use of violent corruption and intimidation for economical gain. The big five are: MAFIA, RUSSIAN MOBS, JAPANASE YAKUZA, CHINISE TRIADS AND COLOMBIAN DRUG CARIELS.

10 Cyber ( High Tech ) Crimes Crimes that is commited by the use of computers or other technology.
