Doug,

The Commission staff will be patient while the FAA "re-labels" or "re-identifies" tape recordings
of Herndon Command Center tapes previously provided to the Commission. Unfortunately, the same
CAN NOT BE SAID with respect to CC tapes NOT previously given to the Commission. When we
met on Friday, February 20, 2004, Commission staff identified at least 3 recorded lines at the NOM
Position # 34, 3 recorded lines at the TCA Position # 33,1 recorded line at the ZNY Position # 14 and
1 recorded line at the NTMO East Position # 26 that WERE NEVER PREVIOUSLY GIVEN TO THE
COMMISSION. These tapes should have been given to the Commission months ago in response to
formal written requests given to the FAA. in the spring of 2003 and the Subpoena served on the FAA in
October 2003. It is imperative that the Commission staff receive the materials immediately. The
review of the materials is essential to the completion of the staffs investiagtion of the events of 9-11. I
and the Commission really appreciate your personal efforts to resolve this issue and we understand that
you inherited this task late in the game. Please understand our frustration given how critical the receipt
of ALL CC tapes is to our work. Please also let me know when we can expect to receive the tapes not
previously provided to us. Thank you very much for your help to date and for your anticipated prompt
response to this very important inquiry.

John, The Command Center should be able to turn around most of the tapes
very quickly. Those tapes that they are not able to identify willl take
some time, based on when you can provide the rest back to us. It's based
on a process of elimenation if they cannot identify them by the label or
listening.

I will be available Either Tuesday or Wednesday depending on a pre


deployment briefing, which has yet to be determined. So for know pick a
day.
