Comelec eyes damage suit vs Smartmatic

Posted at 04/25/2013 12:55 PM MANILA - The Commission on Elections is considering filing a damage suit against poll machine supplier Smartmatic after the May 12 elections. Comelec Chairman Sixto Brillantes said Smartmatic failed to produce the source code for the precinct count optical scan (PCOS) machines, which should have been part of the software it was supposed to turn over to the poll body along with the machines. Brillantes said the turnover of the source code is part of the contract between Smartmatic and Comelec when the poll body bought the PCOS and its software back in March 2012. A legal dispute in the United States between the owner of PCOS technology, Dominion Voting Systems. and Smartmatic, the company contracted by Comelec to provide the PCOS machines, has caused the source code to be unavailable for review.
