Short Title and Commencement.- Thes e rul es may be cal l ed the Profess i ona l Dipl oma Cours es of Engi neeri ng a nd Technol ogy (Regula tion of Admis s ion a nd Pa yment of Fees ) Rul es, 2013. Definitions.- (1) In thes e rul es, unles s the context otherwi s e requi res ,(a ) Act mea ns the Guja ra t Profess i ona l Technica l Educati ona l Coll eges or Institutions (Regul ation of Admi ss ion and Fixation of Fees ) Act, 2007 (Guj. 2 of 2008); Admi s s i on for the purpos e of thes e rul es mea ns a dmi s s i on of candi da tes i n the firs t year of the Profes s iona l Diploma Courses of the Engi neeri ng and Technol ogy; Admi ss i on Commi ttee means the Admis si on Commi ttee cons ti tuted by the Sta te Government under s ecti on 4 of the Act, for the purpos e of a dmis si on ofcandi da tes in the fi rs t year of the Profes si onal Diploma Cours es ; Certi fi ca te Holder means a candi da te who ha s pa ss ed the two years certi fica te course conducted by the Techni cal Examina ti on Boa rd (TEB) or the Na ti ona l Counci l for Voca ti ona l Tra i ni ng (NCVT) or Guja ra t Counci l for Vocati onal Tra des (GCVT); GCVT means the Guja ra t Counci l for Voca tional Trai ni ng es tabl is hed by the Government of Gujara t; Guja rat Boa rd means the Guja rat Seconda ry and Hi gher Seconda ry School Exa mi nati on Boa rd es tabl is hed under secti on 3 of the Guja ra t Seconda ry and Hi gher Seconda ry Educa ti on Act, 1972; Hel p Centres means the centres notified by the Admi ssi on Commi ttee for fa ci l i ta ti on of the ca ndi da tes for off ca mpus onl i ne a dmi s s i on process ;

Indus tria l Tra ining Institute (ITI) means the tra ining i ns ti tute which provides trai ni ng i n technical cours es a nd i s a dmini s tra ted by the Di rectora te of Empl oyment a nd Tra i ni ng (DET), Government of Guja ra t; NCVT mea ns the Na tiona l Counci l for Voca ti ona l Tra i ni ng es ta bl i s hed by the Mi ni stry of Labour a nd Empl oyment, Government of Indi a ; Profes s ional Dipl oma Cours es mea ns a nd incl udes Di pl oma in Engi neeri ng/Technol ogy , Di ploma i n Archi tecture, Di ploma i n Hotel a nd Touris m Ma nagement, a nd Dipl oma cours es in Appl ied Arts a nd Crafts ; Qual i fyi ng Examina ti on means,(i) the Seconda ry School Certifi ca te Exa mi nati on (Sta nda rd X) pa s sed wi th Ma thema ti cs, Sci ence and Engli s h or equival ent examina ti on, or (ii) Std. X + Two yea rs certi fi ca te cours e conducted by NCVT or GCVT provi ded the ca ndi da te ha s pas s ed the Secondary School Certi ficate Exami na ti on (Sta ndard X) wi th Ma thema ti cs, Sci ence and Engl is h, or (iii) Std. X + Two yea rs certifi cate cours e conducted by the Techni cal Exa mi nati on Boa rd (TEB) provi ded the ca ndi da te ha s pa s s ed the Seconda ry School Certi fi ca te Exa mi na ti on (Sta nda rd X) wi th Mathema ti cs , Sci ence a nd Engl i sh, or (iv) Std. VIII + certifica te course of two or more years conducted by NCVT or GCVT provided the candidate have pa s s ed the Std X exa mi na ti on from the Guja ra t Board or from Open Schooli ng wi th s ubjects (i) Ma thema tics, (i i ) Sci ence (ii i) Gujara ti a nd (iv) Engl is h or equi va l ent exa minati on; Second Shi ft mea ns activi ties conducted i n s econd s pel l of ti me wherever two s hi ft worki ng exi s ts ; Shi ft means s pel l of time i n which educa ti ona l a cti vi ties of the techni cal ins ti tution a re conducted; Techni ca l Exami na tion Boa rd (TEB) means the Techni cal Exa mi nati on Boa rd, es tabl is hed by the State Government under Government Res ol uti on, Educa ti on a nd La bor Depa rtment No.ECT-1064/91813-GH, da ted the 11th Jul y, 1966; Webs i te mea ns the offici a l webs i te of the Admi s s i on Commi ttee to ca rry out off ca mpus onl i ne admi ssi on proces s. The words a nd expres si ons us ed i n thes e rul es but not defined sha ll ha ve the mea nings as as s igned to them i n the Act.

Admiss ions to Professional Diploma Courses.(1) Admi ss ions to the fi rs t year of the Profes si ona l Di pl oma Cours es shal l be gi ven a s under, na mel y:(a ) Al l the Government Sea ts s ha l l be fi l l ed i n on the bas i s of meri t l i s t prepa red by the Admi s si on Commi ttee. (b) Al l the Ma na gement Sea ts s ha l l be fi l l ed by the ma na gement of the res pecti ve Profes s i ona l Educa ti ona l Coll ege or Insti tuti on, on the bas is of inter-se meri t li st of the ca ndi da tes whos e na mes a ppear i n the meri t l is t prepa red by the Admis s i on Commi ttee. (2) The Admis si on Committee shal l gui de,s upervis e and control the entire proces s of admis si on of candidates to the Profess i onal Di pl oma Cours es in the Profess ional Educationa l Col leges or Ins ti tutions . Seats Available for Admission.For the purpos e of admi ss ion to the fi rs t yea r of the Profes si onal Di pl oma Cours es a va il abl e seats shall i nclude,A. Eligibility for Admission.(1) For the purpos e of admis s i on to the Profes s ional Dipl oma Cours es , a ca ndi date sha ll have pa s sed the qua li fyi ng exa mi na tion wi th mi ni mum el i gi bi l i ty criteri a of percenta ge of ma rks i n s ubjects pres cribed by the All Indi a Counci l for Technica l Educa ti on (AICTE) from ti me to ti me from,(i) The Guja ra t Boa rd; or (ii) The Centra l Boa rd of Seconda ry Educa ti on Boa rd (CBSE) or the Counci l of Indi a n School Certifi cate Exami na tion, New Del hi or the Interna ti ona l School Board or the Na ti ona l Ins ti tute of Open Schooli ng or Sa nskri t Pa ths al a : Provi ded tha t,(a ) the school / s tudy centre i n which the candi da te has studied, s houl d have been l oca ted i n the Sta te of Guja ra t; or (b) the school / s tudy centre i n which the candi da te has studied, s houl d have been l oca ted i n the Uni on Terri tori es of Diu, Dama n a nd Da dra Na gar Havel i a nd whos e pa rents a re ori gi n of Guja ra t; or (iii) A candida te who ha s s tudied under Ja waha rl al Na vodaya Vidyal aya Scheme upto Standard VIII i n a ny of the school s loca ted in the Sta te of Guja rat, therea fter s tudi ed i n a ny of the s chool s l oca ted out of the Sta te of Guja ra t under the sa i d Scheme s ha ll be el i gibl e for a dmi s s ion. No certi fica te to the effect of non-i nclus i on i n Crea my Layer s ha l l be va l i d, unl es s i t i s duly s ta mped, s i gned a nd is s ued by the a uthori ty empowered by the Government of Guja ra t. Such certi fi ca te s ha l l ha ve been i ssued on or after the 1s t April of the academic year in which the candidate is seeking a dmi ss ion. If a ca ndidate fai ls to submit the certificates as requi red under s ub-rul e (2) withi n the stipula ted ti me, hi s candidature sha ll be cons idered for admis s ion under unres erved category. If a ca ndi date of res erved ca tegory gets admi s s i on on unres erved s ea t i n order of meri ts , he may be given a dmi ss i on on the unres erved sea t a ccordi ng to hi s preference. The a dmi s s ion of a ca ndi da te of a res erved ca tegory on a res erved s ea t s ha ll be val i d s ubject to the veri fi ca ti on of ca s te certi fi ca te is s ued to hi m by the a uthority empowered by the State Government i n thi s beha lf. In ca s e the ca ste certifi cate i s found to be i nval i d on verifi cati on, he s ha l l not ha ve right to cl ai m hi s admis si on on reserved seat a nd if he ha s a lrea dy been gra nted a dmiss ion, s uch admis si on s ha ll be ca ncell ed. Admis s ion of such ca ndida te may be continued i n ca s e of a vai la bil ity of va ca nt unres erved s ea ts, s ubject to the condi ti on of el igi bi l ity of merit. After gra nting a dmi s si on to a l l the ca ndi da tes of reserved ca tegori es on res pecti ve res erved s ea ts, the res erved category s eats rema i ni ng va ca nt s ha l l be tra nsferred to the unreserved ca tegory sea ts .

Reservation for the Children of Defence Personnel and Ex-Servicemen.(1) One percent of a vai l a bl e sea ts s ha l l be res erved for the chil dren of Defence pers onnel a nd Ex-Servicemen, for a dmi s s ion. (2) A ca ndi da te cl a i ming a dmi s s i on a ga i ns t Ex-Servi cemen ca tegory s ha l l be required to s ubmi t a certi fi ca te to tha t effect dul y i s s ued by the Di rector, Sa i ni k Wel fa re Boa rd, Guja ra t State or by the Di strict Sa ini k Wel fare Officer. In-Servi ce Defence personnel s hal l be requi red to s ubmi t certi fi ca te to tha t effect dul y i ss ued by the Comma nding Offi cer of the res pecti ve uni t i n whi ch they a re s ervi ng. (3) The s eats remai ning vacant a ga i ns t the ca tegory of Defence Pers onnel a nd Ex-Servi cemen s hal l be fi l led up from the meri t l i s t of unres erved ca tegory ca ndi da tes . (4) The chi ldren of Defence Personnel a nd Ex-Servi cemen of Gujara t ori gin sha ll be i ncl uded under the res erved ca tegory s peci fi ed i n thi s rul e, i f they ha ve pas s ed the qual i fyi ng exami nati on from the s chool s l oca ted outs i de the Guja ra t State. Supernumerary Seats.(1) The s upernumera ry s ea ts s ha l l be fi ll ed in a ccordance wi th the di recti ons from the Al l Indi a Counci l of Techni ca l Educa ti on, New Del hi a nd Mi ni s try of Huma n Res ource Devel opment, Government of Indi a . (2) (i) The Tui tion Fee Wa i ver Scheme sha l l be a ppl i ca bl e to a l l the s anctioned s ea ts of the profes si ona l diploma cours es i n the Government col leges or ins ti tutions , gra nti n-ai d coll eges or i ns tituti ons a nd una i ded col l eges or i ns ti tuti ons approved by AICTE, New Del hi ; (ii) the s upernumera ry s ea ts not exceeding fi ve percent of s a ncti oned inta ke of the col leges or instituti ons shal l be fi ll ed on the ba si s of meri t of the ca ndida te, whos e pa rents a nnua l i ncome i s l es s tha n Rs.4.5 l a khs from a l l s ources of i ncome; (iii) the s upernumera ry sea ts not exceedi ng 15% of the s a ncti oned i nta ke of a l l the Government Col leges or ins ti tuti ons , grant-i n-ai d col leges or instituti ons or unai ded Col leges or Instituti ons approved by AICTE shal l be fi ll ed wi th the ca ndidates fa ll ing under the category of Forei gn Nati ona ls or Pers ons of India n Origi n (PIO) or India n workers in Gul f countries , s ubject to the conditi on tha t up to 1/ 3rd of the 15% s hal l be res erved in the di fferent di s ci pl i nes in a l l the col l eges or i nsti tuti ons , for the Chi l dren of Indi a n workers in the Gul f Countri es . (4) The ca ndi da te who i s una bl e to produce ori gina l certi fi ca tes a nd tes ti moni al s necess a ry for the purpose of a dmi ss i on wi thi n the ti me-l i mi t prescri bed i n sub-rul e (2), ma y be gi ven provis i ona l a dmi s si on, subject to fol lowing condi ti ons , namel y:(i) On pa yment of Rs . 10,000/- (Rupees Ten thous a nd onl y) to the Admi s s i on Commi ttee a s s ecuri ty depos it by the ca ndi date. If the ca ndi da te s ubmi ts the requi red documents wi thin a peri od of three worki ng da ys , the rema i ni ng a mount of the s ecuri ty depos i t s ha l l , a fter deducti ng Rs . 500/- (Rupees Fi ve hundred only) towards the a dmi nis tra ti ve expendi ture, be refunded; (ii) In the event of fa il ure to submi t origi na l certifi ca tes and testi monia l s within the time l i mi t a s a fores a i d, the provi s i ona l a dmi s s i on ma y be ca ncel l ed a nd the s ecuri ty depos i t ma y be forfeited. (2) In cas e of cancel l a tion of a dmi s s i on due to fai l ure of ca ndi date to get hi ms el f reported a t the Hel p Center wi thi n the speci fied ti me li mit as pres cri bed in sub-rule (6) of rul e 16, or for such other rea son a s the Admi ss i on Commi ttee may cons ider reas onabl e, a nd subject to the condi tion of such va ca ted s ea t bei ng fil l ed up by the Admi ss i on Commi ttee, the fees coll ected from such ca ndi da te s ha l l be refunded a fter compl eti on of the a dmi s s i on proces s , a nd a fter deducti on of s uch a mount a s the Admi s s i on Commi ttee ma y determi ne. (3) (a ) In cas e of a candida te withdra wi ng his candida ture before completion of admis s ion proces s, for a ny rea s on wha ts oever, he ma y reques t i n wri ti ng to th e Ad mi s s i on Comm i tte e fo r s u ch withdra wa l . In such cas e, the fee coll ected, if a ny , by the Admi s si on Committee s hal l be refunded to s uch ca ndi da te, s ubject to the condi ti on of s uch vaca ted s ea t bei ng fi ll ed up by the Admi s s ion Commi ttee; (b) In ca se of a ca ndidate withdrawing his candidature a fter compl etion of admi s si on proces s, for any rea s on wha ts oever, he ma y reques t i n wri ti ng to the col lege or i ns tituti on i n whi ch he i s gra nted a dmis s ion, for refund of fee pa i d by hi m. In such ca s e the fee sha ll be refunded, by s uch coll ege or i ns titution, a s per the di rections of the Admi ss i on Committee. Vacant Seats.(1) After offeri ng admi ss ion to al l the ca ndidates whos e name appea r in the merit l is t or after compl eti on of the admis s ion proces s, if the s eats rema i n vaca nt, s uch vaca nt sea ts sha ll be fi l led by the i nsti tutes , i n a ccorda nce with the di rections of the Admi s s ion Commi ttee, i n the ma nner prescribed i n s ub-rule (2).
