Re:

Matt Bevin for U.S. Senate Committee Advertisement

Dear Mr. Selvaggi, As counsel to McConnell Senate Committee 14, we write to inform you that Matt Bevins authorized campaign committee, Matt Bevin for U.S. Senate, is running an advertisement 1 on your station that contains inadequate disclaimers in violation of federal law. As a result of the violation described more fully below, we urge your station to immediately cease airing Mr. Bevins advertisement. Federal election campaign law states that any television communication sponsored by a candidate or candidates committee must include a statement that identifies the candidate and states that the candidate has approved the communication. Federal law also makes clear that in addition to being made verbally, this statement shall also appear in writing at the end of the communication in a clearly readable manner 2 U.S.C. 441d(d)(1)(B)(ii); 11 CFR 110.11(b). The stand by your ad statement identifies the candidate and states that he or she has approved the communication. 11 CFR 110.11(c)(3)(ii). In this case, for example: Paid for by Bevin for Senate. Approved by Matt Bevin. The ad that Mr. Bevins committee is currently running on your station fails to include such a written statement, and as such violates federal law. As a result of Mr. Bevins committees failure to include a legally compliant disclaimer, we urge you to immediately cease airing the advertisement at issue.

The advertisement at issue can be found here: https://www.youtube.com/watch?v=GjgbdVOZqyw

Please do not hesitate to contact me with any concerns regarding this matter.

Sincerely,

Sean Cairncross Chris Winkelman Counsel to McConnell Senate Committee 14
