The men were located by police hiding in a backyard and were found with the loaded handgun and machete used in the robbery. Pena was charged with robbery and weapon possession, while Francia was charged with robbery, criminal use of a firearm, and weapon possession. They were to be arraigned the next day.

    INCIDENT: Arrests DATE/TIME: August 29, 2013, 2351 LOCATION: Westbury ITEM: 02

    The Third Squad reports the Arrests of two men that occurred in Westbury on Thursday, August 29, 2013 at 11:51 P.M. According to detectives, a male and female victim (ages unknown) had just exited La Frontera Deli/Mini Market at 427 Maple Avenue in Westbury when they were approached by Jose Pena, age 22 of 1096 Broadway Westbury and Jose Francia, age 20 of 360 Magnolia Avenue New Cassel. Defendant Pena while armed with a machete and defendant Francia while displaying a handgun demanded property from the victims. Francia then removed the females pocketbook from her arm and the defendants fled on foot westbound on Maple Avenue to northbound Linden Avenue. Third Precinct police officers and the Canine Unit conducted an extensive search and canine Gehrig located the defendants hiding in the side yard of a Dover Street residence where they were taken into custody. The Emergency Services Unit assisted with the investigation and located a loaded .38 caliber handgun and machete under a bush in the yard. The proceeds were recovered.
