Here is Part 1 of the the complaint against the Tx Workforce Commission that was submitted to the office of Travis County Attorney David Escamilla. This was submitted per section 552.353 of the Public information Act
Section 552.353(a) provides:
An officer for public information, or the officer’s agent, commits an offense if, with criminal negligence, the officer or the officer’s agent fails or refuses to give access to, or to permit or provide copying of, public information to a requestor as provided by this

AFFIDAVIT OF SARA BLACK
1, Sara Black, an unemployment recipient of Travis County, TX file a complaint against
the Texas Workforce Commission, I ask Travis County to investigate this complaint
alleging the concealment, alteration, destruction of my records and of TWC’s refusal to
produce them upgn my request.

1. On or about 10-17-08 at 2:34 pm, I requested information from the Texas
Workforce Commission at 101 E. 15th St., Rm. 266, Austin, TX, 78778-0001
(see Exhibit A and attachments).
2. On or about 10-20-08, I provided TWC with my driver's license, SSN and
signature so that they would process my request.
3. On or about 11-1-08 at 2pm, I received two responses from TWC Open Records
Staff, The first response from Margo Kaiser told me she was asking for a
decision from the AG’s office on part 5 of my request. The other response from
Maria Rivera provided heavily redacted emails from Claudia O’Meara, Rosa
Perez and another TWC employee.

5. On or about 1 1-7-08, I sent my first request to the Attorney General’s office
asking for the information that had not been provided.
6. Onor about 11-20-08, I wrote TWC and corrected the date in part 2 of my
request. There was a typo. It was 8-27-08 that I first contacted TWC staff to file a
unemployment claim not 8-24-08. (See Exhibit | attachments)
7, On or about 11-20-08, Lona Chastain, TWC Open Records Coordinator, claimed
that the information for part 2 of my request did not exist relating to a record of
my 8-27-08 call to TWC. | did not talk to Claudia O'Meara until 9-10-08, but
O’Meara knew the contents of my 8-27-08 call. O’Meara authored an 8-27-08
email with the details of my 8-27-08 call. It appears to me that Chastain and other
‘TWC Open Records staff are concealing the records of my 8-27-08 call.
8. I believe that Lona Chastain, Maria Rivera and Margo Kaiser concealed records
and did not provide me access to my records. Records I should be able to see. 1
believe they violated Section 552.353(a) which provides:An officer for public information, or the officer’s agent, commits an offense
if, with criminal negligence, the officer or the officer's agent fails or refuses
to give access to, or to permit or provide copying of, public information to

10. On or about 12-18-08, Margo Kaiser mailed me a letter claiming to have provided
the information according to 20 CFR Part 603 and a claiming my unemployment
information did not fall under the public information act. A copy of her letter is
attached to this affidavit as Exhibit “B.”
11. On or about 12-29-08, | the AG’s office sent me a letter stating that my
unemployment claim information was not public information. Therefore, the
AG's office could not assist me. A copy of the AG’s letter is attached as Exhibit

12. On or about 12-29-08, an assistant AG filed some of my UI records in Travis
County in response to my request for judicial review by Travis County of TWC’
actions case D-1-GN-08-004371. He provided my SSN and a

13. On or about 11-24-08, I resumed filing my UI claims. 1 filed two claim periods
by phone (2 weeks each). | reported wa

November 2-8 and wages from[{§B for November 9-13. A transcript of my
responses is automatically created by the TWC system.
14. On or about 11-26-08, I spoke with TWC employee Jimmy Mullens 936-6379.
He said my claims were on hold because | reported wages for both claim weeks
from November 2-15. I verbally gave Mullens the employer and wage
information for a: a I recorded my conversation with
Mullens.
15, On or about 12-09-08, my new claim was on hold because I had worked again. I
spoke to TWC staff to report my new wages and asked for the correction my
wages for November 9-15. had paid me less than they had stated. The
TWC employee informed me that there was no record of my wages for the week
ending November 15 (November 9-15.) There should be two: the Tele-Serv
telephone transcript and Mullens record.16. On or about 12-11-08 to about 1-14-09, TWC did an investigation of me. My
benefits were stopped in early January and restarted in the middle of the month. 1
lost hundreds in benefits in January due to the alteration and concealment of my
TWC records, Since my benefits had been stopped, | was not notified that my
balance was about to run out. So, | lost hundreds in benefit:
17. On or about 12-29-08, | appealed the actions starting 12-11-08 twice. TWC never
scheduled me for a hearing. That is concealment by TWC that I appealed this,
action
18. On or about 1-14-09 at 10:05 pm, I received an email from Leslie Geballe,
supervisor of both Rosa Perez and Jimmy Mullens. In her email, she claims I did
not report th ‘wages until December 9, 2008. This means TWC altered the
date I reported the wages (11-26-08). The email from Geballe is attached to this
affidavit as Exhibit “D.”
19. TWC records claim to have paid me full benefits for some weeks, but that differs
from the Chase statements. For instance, TWC claims to have paid me $276 for
the week ending 1-3-09, but TWC secretly deducted out $229 with the
explanation ‘prior payment.’ What prior payment? TWC did not send me a
fatement for this transaction. I stumbled upon it on the internet. I call that bad
faith on the part of TWC.
20. On or about 1-28-09 at 4:36 pm, I appealed another action of TWC. I sent my
appeal from the Travis County library.
21. On or about 3-5-09, I had a hearing on that action. TWC presented a fax receipt
showing two fax receipt lines. One line showed the date 1-28-09 from “Travis
County Law Library” and other showing a date of 2-9-09 with the location
missing. When I received the TWC decision, the hearing officer had changed the
received date of my appeal to 2-9-09. (I taped this hearing and can provide it
upon request.)
