REVIEW OF YOUR LAST WILL AND TESTAMENT SIGNED ON [DATE OF EXECUTION] Your Will is the most important document

that you have ever signed in your life. It is the only document that disposes of all your earthly possessions. Your Will is a dynamic, living document. Although its intent is to provide for what happens to you and your estate in the circumstances of your death the reality is that your estate plan needs to change as your life changes. You should review your Will and overall estate plan after: you change your name, or anybody named in the will changes theirs; you enter into marriage or other domestic partner relationship; you enter or leave a de facto relationship; you divorce; you separate from your partner; your spouse dies; the birth or adoption of your child or grandchild; the death of a beneficiary; a serious injury, undue influence, gambling or drug addiction of a beneficiary; a change in relationship with nominated beneficiary, e.g. complete severing of relationship; the establishment of a self managed superannuation fund or the admission of new members to such a fund; change of residency interstate or overseas; your Executor dies or becomes unsuitable; your Attorney dies or becomes unsuitable; your Guardian of your minor children dies or becomes unsuitable; a significant change in your estates value in either direction; a change in the needs and financial circumstances of a beneficiary; your retirement; a bankruptcy; you receive an inheritance; you make loans or gifts to family members;

you dispose of assets covered by your will; any change in your life that causes you to re-evaluate to whom you want to leave something.

In addition to your Will other documents that often need updating are your: Superannuation death benefit nominations; SMSF Deeds; Life insurance policy benefit nominations; Enduring power of attorneys; Enduring power of guardianships; Inter vivo trusts; Business succession agreements such as buy-sell agreements.
