LIMITED DURATION CONTRACT OF EMPLOYMENT between PROFESSIONAL STAFFING (the employer) and Surname: _______________________ First Name: ___________________ I.D. No: ________________________ (the employee)
1. This limited duration contract of employment is made in terms of section 198 of the Labour Relations Act No.66 of 1995 (as amended). 2. The employer agrees to hire the services of the employee who in turn agrees to render to the employer his services at all fair and reasonable times on the terms and conditions hereinunder. 3. Duration: 3.1 given the nature of our business, Professional Staffing is not in a position to offer permanent employment to the employee or with any degree of certainty predict the duration of the assignment, and hence the duration of this contract of employment. 3.2 the employee acknowledges that this contract is therefore of limited duration and is dependent upon our clients operational requirements. 3.3 The agreement shall commence on the ______ day of ________ 2013 and shall not extend beyond the day of __________________ 2013 subject to: 3.3.1 The contract expiring due to the fluxation of the period of services stated herein; or 3.3.2 The client withdrawing and/or shortening the agreement entered into between himself and the employer; or 3.3.3 The client indicating written or verbal dissatisfaction as to the work or conduct of the employee to the employer 3.3.4 The contract being summarily cancelled if the employee is guilty of conduct justifying a summary dismissal or commits a breach of any terms of this Agreement 4. Designation The employee shall be employed in the capacity of ___________________ and shall report to: _______________________ (hereinafter known as the client). 4.1 Notwithstanding that the employee has been employed in the above capacity, he/she may be required from time to time to render other services at different clients, for which he/she will be entitled to the remuneration agreed upon for each assignment. 5. Payment The employer shall in consideration for the rendering by the employee of his/her services in terms of this agreement receive a Base Rate of pay to the employee, of R________ per hour/per day/per shift, that is INCLUSIVE of Leave Pay, Public Holiday Pay, Sick Leave, Family Responsibility Leave and any other statutory leave that may arise. Due to the nature of the business, each assignment will attract a differing rate of pay and will be confirmed with the employee before the start of each assignment. 5.1 Banking For security and convenience reasons, the employee will be paid directly into his/her bank account. 5.2 Income Tax No Payment can only be rendered if the employer is in possession of the employees personal tax number. 5.3 Deductions The employer shall be entitled to deduct from the wages of the employee any amounts required in terms of the law and/or agreement entered into between both parties, such as U.I.F. (to be deducted off full rate of pay) and P.A.Y.E as set out by the official tables of the Receiver of Revenue. 6. Employers rights of recovery If for any reason, the employee owes the employer any monies, the employer will have the right to deduct such amounts at any time or from time to time from any remuneration or other monies that are owing to the employee in the form of salaries or otherwise. 7. Enticement The employee accepts that he/she may not be enticed by the client to accept any permanent or temporary employment without prior consent of the employer. 8. Termination of Contract Neither the employer nor the client is able to guarantee the employee further employment. Termination shall not be construed as retrenchment. 9. A condition of your employment is dependent upon your attendance at ALL training sessions as scheduled by Professional Staffing. Failure to attend training will result in the termination of your contract. 10. The employee acknowledges that he/she has access to some or all of the company or the clients confidential information and operations, and the employee undertakes that he/she shall not directly or indirectly use or disclose for his own or the benefit of any other person such information.
