Police Brigadier General Myint Thein read the order to Ms Suu Kyi at her prison house in
Yangon's Central Insein Prison on Tuesday. Confirming this, Nyan Win, one of her lawyers,
told reporters after Tuesday's session: 'The house arrest has been lifted, but she is still
under detention. I don't know whether to be happy or sorry,' he said.
Ms Suu Kyi, one of more than 2,000 political prisoners in Myanmar, has been incarcerated
for more than 13 of the past 19 years. Most of it has been spent at her lakeside Yangon
home under police guard, her mail intercepted and visitors restricted.
The trial against Ms Suu Kyi continued on Tuesday for the seventh day, at which some
diplomats, local private and Yangon-based foreign reporters were allowed in again for
observation. The Nobel laureate faces up to five years in jail if convicted for allowing an
American intruder to stay at her home for two days in early May.
In her first testimony at the trial, Ms Suu Kyi on Tuesday denied any prior knowledge of
John Yettaw's plans. The 53-year-old American arrived at her home on May 4 after
swimming across the adjacent Inya Lake.
'I just allowed him to stay for a while,' she said. Yettaw, who says he dreamt that Ms Suu
Asked by Judge Thaung Nyunt if she reported him to authorities, Ms Suu Kyi replied: 'No, I
did not.' Her lawyers say she allowed him to stay for humanitarian reasons after he
complained of leg cramps from the swim.
Earlier, the Myanmar authorities offered their latest justification for the trial, widely
condemned as a sham to keep the National League for Democracy (NLD) leader in
detention during elections next year.
Police Brigadier General Myint Thein said they had considered freeing Ms Suu Kyi before
Yettaw stayed at her home and she 'talked to him and provided him with food and clothes'.
'These things infringed on existing law and we unavoidably and regretfully had to take
legal action against her,' he told a group of diplomats and journalists.
Asian and European (ASEM) foreign ministers meeting in Hanoi 'called for the early release
of those under detention and the lifting of restrictions placed on political parties'. --

Aung San Suu Kyi remains in the international limelight as her trial in Rangoon continues
Although hidden from the public eye for several years, Burma’s pro-democracy icon has
garnered resounding international support, showing a calm defiance in the face of the
The truth is that Suu Kyi remains deeply respected and loved. The huge respect she
commands was seen at Tuesday’s court session, when foreign diplomats, reporters and
even some security officials rose from their seats as she entered—an awkward moment for
the officials.
There is no doubt that Suu Kyi remains a figurehead of Burma’s beleaguered democracy
movement, and her trial before a kangaroo court in Rangoon’s Insein Prison is provoking
US president Barack Obama, whose administration has just extended sanctions against the
Burmese regime, hailed Suu Kyi’s patriotism, sacrifice and her vision of a democratic and
prosperous Burma.
“It is time for the Burmese government to drop all charges against Aung San Suu Kyi and
unconditionally release her and her fellow political prisoners,” Obama declared.
Despite these appeals from the highest international levels, the fear remains that Suu Kyi’s
captor, Snr-Gen Than Shwe, is determined to keep her in prison. The junta leader lives in a
Than Shwe and Suu Kyi are not equal contenders in a fight for a political ideology. Suu Kyi
fights for democracy and freedom in Burma, while Than Shwe runs an infamous gulag and
keeps Burma locked into the status of a pariah state. His hatred of Suu Kyi is
immeasurable.
Thus, Burma’s dissident community, Burmese political observers and Suu Kyi’s lawyers
have expressed fears that the international pressure won’t cause Than Shwe to budge an
inch.
Mark Canning, the British ambassador to Burma, told the British daily The Guardian the
regime had been "taken aback" by the strength of international opposition to Suu Kyi's
arrest. He did not expect Suu Kyi to be acquitted, however, although he felt that continued

If you’re looking for a barometer of how badly Burma’s junta is misbehaving, just wait and
see how the Association of Southeast Asian Nations (Asean) responds to the generals’ latest
headline-grabbing outrage.
Generally reluctant to weigh in on any issue relating to the “internal affairs” of one of its
members, the regional grouping rarely speaks out over Burma—and then only when silence
is no longer an option.
If Asean does criticize the regime—as it did when it expressed “revulsion” at reports of
Burmese soldiers gunning down monks and other protesters in the streets of Rangoon in
September 2007—you know that things have really gotten out of hand.
The bloc’s uncharacteristically tough language at that time was due to deepening concerns
about the effects of the junta’s actions on Asean’s reputation. As Singaporean Foreign

The trial of Aung San Suu Kyi has gripped the hearts of the Burmese people because they respect and
love her. Rationally, however, they know they can have little affect on the junta’s show trial now

Can efforts to relax US sanctions against Burma stay afloat in the wake of John
NOBODY knows for sure what inspired John William Yettaw to don a pair of homemade flippers
and swim across Inya Lake to the home of Burmese democracy icon Aung San Suu Kyi. But if his
intention was to frustrate efforts to open a new chapter in US relations with Burma’s ruling regime,
that prompted US President Barack Obama to renew sanctions on Burma on May 15, ending months
of speculation that the new administration was steering away from the hard-line stance of Obama’s

Still others made crude innuendoes about a supposed tryst between the 63-year-old Suu Kyi and 53-
year-old Yettaw. Such despicable slurs could hardly have been expected to convince the Burmese
public, but they probably earned some ambitious young sycophant a pat on the back from a pleased
superior officer, who is now in line for a promotion by Snr-Gen Than Shwe, a man who is said to

This raises the fear—the very real fear—that the generals have more in store for Suu Kyi than just a
sham trial to justify barricading her in her home for another half-decade or so of less than splendid
isolation. If they think they can get away with it, they will happily leave her in her “guesthouse” in
What is truly frightening about this prospect is that Burma’s prisons are notoriously hazardous to
the lives of their inmates, particularly those doing time for displeasing the powers that be. Suu Kyi is
known for her indomitable spirit, but it is doubtful that this alone would help her to withstand the
rigors of life in a Burmese gulag, especially given her recent health problems.
The question that many Burmese are now asking themselves is whether the regime will stop this
time at character assassination—a tactic that they have used against Suu Kyi in the past, to
absolutely no effect. What the people of Burma fear most is that they will lose another leader to
martyrdom—not in a hail of bullets like her father, but at the hands of jailers who have killed
Burma’s generals have shown how far they’re ready to go to silence Suu Kyi, most infamously with
the Depayin attack of 2003, which served as the pretext for her current incarceration. Regardless of
how the farcical trial against her plays out, it is clear that the regime’s ultimate goal is to

A Dangerous Experiment

A judgment will soon be passed down on Daw Aung San Suu Kyi. The timing of the
judgment and the sentence will be influenced to some extent by international pressure.
Her arrest and detention have sparked international outrage and even condemnation by
Burma’s usually passive neighbors. This show of disgust, anger and disapproval will play a
role in what happens next. Indeed, had there been similar sentiments expressed
consistently prior to this, Aung San Suu Kyi might not be in such a predicament.
Unfortunately, in recent years the international community has made far too many
concessions to the regime and has inexplicably wavered in its commitment to denounce the
junta’s illegitimacy.
Burma’s generals took this as a sign that they were getting the international stamp of
approval to follow their “seven-step road map to democracy” and that if Suu Kyi stood in
their way, then surely the international community would understand that they would have
to react.
In my opinion, it is inexplicable that there could be a softening of stance toward the regime.
The regime has done nothing whatsoever to advance democracy, freedom, development or
human security in our country. The regime's road map has not included anyone outside
their clique. The regime even denied humanitarian assistance to reach the hundreds of
thousands of people suffering the devastating impact of Cyclone Nargis in May last year.
Yet there are voices are in favor of supporting the regime's 2010 election, who suggest that
such an election could overcome the political deadlock in the country. And these voices are
international agencies.
In order for the election to go ahead, some have floated the idea of excluding Suu Kyi from
the political process, suggesting that she should be “above politics.” These voices have
emboldened the regime to take the necessary steps to exclude the NLD leader from the

conditions of her house arrest was delayed for a week over efforts to reinstate three defense
Suu Kyi's trial was adjourned until June 12 while a higher court hears a request by her attorneys to
reinstate the defense witnesses who were earlier barred from testifying at her trial, lawyer Nyan Win
The lower District Court earlier disqualified all but one defense witness—legal expert Kyi Win. Those
rejected were all members of Suu Kyi's National League for Democracy party.
They include prominent journalist and former political prisoner Win Tin, the party's vice chairman
Tin Oo, currently under house arrest, and lawyer Khin Moe Moe.
"The next session will be coming (next) Friday, but there won't be final arguments that day," Nyan
Win said.
Suu Kyi was detained last month after American John W. Yettaw swam to her lakeside home without
her consent and stayed for two days. Yettaw, a part-time contractor from Falcon, Missouri, claims he
had a dream that Suu Kyi would be assassinated and he went to warn her.
Suu Kyi has pleaded not guilty. Her defense team acknowledges that the 53-year-old Yettaw swam to
her lakeside home, but they argue it was the duty of government guards outside her closely watched

The trial has drawn condemnation from the international community and Suu Kyi's local supporters,
who worry the junta has found an excuse to keep her detained through elections planned for next

Members of Burma’s main opposition party have been warned that they could be charged with
violating the country’s infamous electronics act for publishing a statement about the trial of party
leader Aung San Suu Kyi online, Burma’s state-run media reported on Saturday.
According to a report in The New Light of Myanmar, youth members of the National League for
Democracy (NLD) were told that posting a party statement about Suu Kyi’s trial on the Internet
The law, which forbids unauthorized use of electronic media, was used against many pro-democracy
dissidents in trials held at Insein Prison late last year, resulting in lengthy prison sentences for critics
of the ruling regime’s crackdown on monks in 2007 and its response to Cyclone Nargis last May.
The report also suggested that the youth members may have broken other draconian censorship laws
“Without seeking permission for publication, the announcement has reached the public. Therefore
the announcement is against the printing and publishing registration law,” the newspaper reported.
However, the NLD youth members denied that they intended to post the statement on the blog,
which is run by a Burmese exile. They said that it was merely being circulated among members of
the party.
In the statement, the NLD youth members said they were saddened by the junta’s failure to respond
to international calls for the unconditional release of Suu Kyi, and expressed doubts about the
legality of her trial. They pointed out that the trial is being carried out under provisions of the 1974
constitution, which was abolished when the current regime seized power in 1988.

The last time I met Aung San Suu Kyi was in 2003, shortly before the regime ordered an attack on
her motorcade that led to the massacre of a number of her supporters and to her detention. She had
warned that the viciousness of government intimidation was increasing against tens of thousands
who would gather at rallies around the country to hear her speak. Years of isolation had failed to
diminish her allure for the Burmese people. Despite the increasing danger, her fortitude and focus
was inspirational. I know she will draw on the rare qualities she possesses to deal with the verdict of
the show trial she faces now. If anything, she will be energized and invigorated by it. The events of
the last few weeks have once again thrown the spotlight on her statesmanlike perseverance against
the juvenile banality of Burma’s dictator Than Shwe. The regime has set flowing the myriad streams
Aung San Suu Kyi’s power flows from many different sources. It comes from all those who invest
hope in her inside Burma and beyond: from dirt-poor farmers in the plains to cyclone survivors in
the delta; from refugees outside her borders to those displaced within them; from the businesses
that are choked by the regime to the public servants prevented form serving their people. It comes
from those inspired by her selflessness and integrity in a world where cynicism dominates our view
of leadership. It comes from the narrative of a monolithic military machine pitted against a solitary,
courageous woman. Than Shwe cannot stop the flow of these streams—his actions only help them to

However, I want to be fair to the critics by addressing the other side, those who profess to be
exerting serious effort, pressure and diplomacy to ease the regime towards change. I can’t tell you
how many “gravely concerned” press releases I saw from Kofi Annan during his time as secretary
general of the United Nations. It looks like Ban Ki-moon has been trying to save the UN paper by
simply rubbing out Annan’s name at the end of the old releases and replacing it with his successor’s
signature! Then there are all the governments that have condemned, abhorred and been outraged by
the junta’s actions, including those that have responded with a raft of symbolic sanctions.
As for Burma’s Asian neighbors—they have not been neighbors at all. They would hear the screams
of abuse in the house next door, day after day, year after year, and say it is not their business. Their
In my view, Daw Suu has maintained with incredible grace the right position of balance through all
of this. Dialogue is on offer without preconditions. Concessions are always possible in return for
measurable progress forward. Her people can never be used as cannon fodder to meet her political
objectives. National reconciliation needs to come from a position of principle married to pragmatism
with an openness of mind. You cannot give away your most important advantages in the hope the
For real change, pressure needs to reach a point at which those beneath Than Shwe realize they have
more to lose by not working with Daw Suu than they have to gain. The pressure needs to come from
China, which can threaten to withhold its veto of any attempt by the UN Security Council to refer
Than Shwe to the International Criminal Court. It needs to come from Asean using the human rights
mechanisms it has signed up to. It needs to come from intense diplomatic pressure by the West on
those who have most influence on the regime. The condemnations have never worked: concrete
action and real consequences for the regime if it fails to reform need to be constructed by the
international community.
I have given Daw Suu considerable praise, but don’t misunderstand my view of her. She will be the
first person to admit that mistakes have been made, that some things could have been done
differently. She has that honesty. However, on the key questions of dialogue, reconciliation, a role
for the armed forces and a just settlement for the ethnic nationalities of Burma, she has been right.
Those who believe political struggles have failed if they do not deliver results quickly,
comprehensively and categorically need to return to their history books. The African National
Congress was formed in 1912 and achieved its goal of a democratic South Africa eight decades later.
The victory of democrats in Eastern Europe took half a century. I don’t want Burma to wait that
long. We should be impatient for change in this beautiful country. But we should not lose sight of
what real change means. I believe Aung San Suu Kyi has always been clear about that. She said in an
interview that her only fear is to let people down who depend on her, that she would rather go down
herself than let that happen. It says something about her if she ends up doing that, but it will also say
