Subject: Draft directive governing the award of damages to victims of anti-competitive


practices: removal from the Commission's agenda

The draft directive governing the award of damages to victims of anti-competitive practices was due
to have been approved within the Commission as a whole on 7 October 2009. Surprisingly, however,
the item concerned was apparently ‘dropped’ from the Commission’s agenda. Why did this happen?

For how long does the Commission intend to put off the approval of the draft directive?

Commissioner Kroes regarded the matter at issue as a priority, given that the directive would
establish a Europe-wide right whereby victims of a business cartel or of abuse of a dominant position
would be entitled to compensation.

Could the Commission explain its reasons for postponing the decision on this matter?
