Read the new materials that I posted especially the

Jurisdiction of DENR to dispose public lands.
Original titles on land are acquired either through a direct land grant from the government (DENR issued
Patents) or indirectly by operation of law (Sec. 14 of PD 1529, procedure is judicial). Read CA No. 141 on
Homestead, Free Patent and Sales. Memorize the requirements. Free Patent in CA 141 has been amended
by RA 6940 and RA 10023. The area has been amended by the 1987 Constitution. Read the conditions in
the patents with the General Provisions(Title VI of CA 141).
Read the powers of the Land Registration Commission (Now LRA) and Section 14 of PD 1529 in your book
including voluntary and cadastral proceedings. We will discuss this week after next. Please ask people to
attend. 50% of the exam both in the midterms and finals will be about original titling. Read Malabanan vs.
Court of Appeals. This is our flagship case in Section 14.

PRESIDENTIAL DECREE NO. 2004

AMENDING SECTION TWO OR REPUBLIC ACT NUMBERED SEVEN HUNDRED AND THIRTY
RELATIVE TO THE SALE WITHOUT PUBLIC AUCTION OF PUBLIC LANDS OF THE REPUBLIC OF
THE PHILIPPINES FOR RESIDENTIAL PURPOSES TO QUALIFIED APPLICANTS UNDER CERTAIN
CONDITIONS
WHEREAS, Republic Act No. 730 permits the sale without public auction of public lands of the
Republic of the Philippines for residential purposes to qualified applicants under certain
conditions;
WHEREAS, land required thereunder are subject to onerous restrictions against encumbrance
or alienation; and cdas
WHEREAS, it is necessary to remove these onerous restrictions to allow the effective utilization
of these lands.
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, pursuant to the
powers vested in me by the Constitution, do hereby decree:
SECTION 1.
Section Two of Republic Act Numbered Seven Hundred and Thirty is hereby
amended to read as follows: cd i
"Sec. 2.Lands acquired under the provisions of this Act shall not be subject to any restrictions
against encumbrance or alienation before and after the issuance of the patents thereon."
SECTION 2.

This Decree shall take effect immediately. aisa dc
