he end of the year is a time to reflect back on the past and look ahead to the future. One issue that seems to be at the forefront for paint and coatings manufacturers and their suppliers is sustainability. Time and time again, the issue of sustainability and developing more environmentally responsible products comes up. At this years technical conference at CHINACOAT it was announced that the theme for next years conference will be Smart, Eco-Friendly and Functional Coatings Additives. According to the conference organizers, as technology continues evolving toward environmental friendly systems, a series of new generation smart additives has emerged on multiple fronts to solve the performance problems of modern-day coatings. As this issue went to press, the U.S. Green Building Council (USGBC) unveiled LEED v4, the newest version of the LEED green building program. We take a closer look at the details of LEED v4 and what it means for the construction industry on pg. 36. Powder coatings have always been a popular choice because they are low in VOCs and solvent-free. The Powder Coatings Market (pg. 30) looks at what is driving growth for this segment. As we enter into 2014 I predict we will be reporting on issues of sustainability a great deal. PPG Industries board of directors ranks first among the boards of more than 600 U.S. public companies, according to a study of governance capacity that was released today by JamesDruryPartners. The third annual The Weight of Americas Boards study scored PPGs board highest for the makeup of its directors in terms of business accomplishments, leadership roles served with companies and the relative value of their experience. PPGs board is one of only two company boards to have ranked among the top 10 in all three of the annual studies published by JamesDruryPartners. PPG is proud that its board of directors has been recognized as having the highest overall governance capacity, said Charles E. Bunch, PPG chairman and chief executive officer. AkzoNobel to Optimize Coil Coatings Activities in Europe and Russia

AkzoNobel announced plans to optimize the manufacturing footprint of its Coil Coatings sites in Europe and Russia by concentrating production at three strategic sites. The company intends to improve operational performance by focusing all European manufacturing for the Coil Coatings business on plants in Malm (Sweden), Lipetsk (Russia) and Hilden (Germany). As a result of these plans, production at sites in Gamleby (Sweden) and Nrnberg (Germany) would end by June 2015. By focusing production on strategic sites that are close to our customers and manufacture products for more than one business, we will create a more efficient footprint and establish a more sustainable platform for future growth, said Conrad Keijzer, AkzoNobels executive committee member responsible for Performance Coatings. The transfer is scheduled to start in early 2014. Current manufacturing at Gamleby will move to Malm and Lipetsk, while production at Nrnberg will switch to Hilden. Approximately 280 employees will be affected, with the company planning to transfer and hire additional people in Hilden, Malm and Lipetsk. A centralized European development center will also be set up in Malm. Operational excellence is a key priority and moving production to three strategic sites is a logical step which will ensure that we are better positioned to deliver leading performance and accelerate profitable growth, added AB Ghosh, managing director of AkzoNobel Industrial Coatings. These improvements in our supply chain will also enable us to respond even faster to our customers. AkzoNobel is a global leader in coil coating, which is a continuous and highly automated process for coating metal before fabrication. The products are mainly used for building components and infrastructure, as well as for consumer goods such as kitchen appliances.

Valspar Foundation and NDSU Announce Coatings Scholarships and Student Research Program
The Valspar Corporation and North Dakota State University (NDSU) have announced two new scholarship programs to provide opportunities for students studying coatings and polymeric materials at NDSU. The Valspar Foundation will contribute $20,000 to support up to five graduate student scholarships and a new program for Summer Undergraduate Research Experience (SURE). The scholarship program is administered through the Department of Coatings and Polymeric Materials at NDSU and coordinated through NDSUs Development Foundation. A selection committee consisting of NDSU professors and Valspars technical leaders recently announced the first Valspar Graduate Scholars Program awards to Olena Kudina, Lviv, Ukraine; Casey Orgon, Bemidji, Minnesota, U.S.; Adlina Paramarta, Java, Indonesia; Andriy Popadyuk, Lviv, Ukraine; and Alison Rohly, Lino Lakes, Minnesota, U.S. Each graduate student will receive $3,000, supporting the students studies at NDSUs Department of Coatings and Polymeric Materials for the 2014 academic year. These scholarships will further our relationship and build our pipeline of talent by supporting students to develop insights into fundamental performance drivers of coatings and polymers and provide them an experience associated with an industrial environment, said Cynthia Arnold, senior vice president and chief technology officer of Valspar. The Dulux brand has unveiled its 2014 paint trends forecast. The colorful palette is filled with rich, invigorating hues that represent renewal and refreshing change, according to the leading Canadian paint brand. Reds: The berry tones of the past few years are being replaced by vibrant reds with orange undertones. Think tomato red, a tangy attention-grabbing colour that pairs well with warm browns, spicy oranges and golden yellows. The new reds also work nicely with elegant darks, jewel tones and other bright tones. The top red pick of the Dulux brand for the year is Tender Rose (10YR 16/407). Oranges: Terracotta and spice hues will be all the rage in the coming year, moving away from the melon and pinkorange tones of seasons past. Lively and expressive, the new oranges are both soothing and eclectic, warmed up with pastel pinks and greys, or cooled down

with turquoise or dark blue. Oranges of 2014 including Pagoda (60YR 36/468) from the Dulux brand work particularly well on an accent wall. Violets: Purples will move in two different directions in 2014, towards both red-purples and blue-purples. AkzoNobel Selects Terra Technologys MultiEnterprise Demand Sensing to Further Reduce Inventory
AkzoNobel has purchased Terra Technologys Multi-Enterprise Demand Sensing (MDS) to use point-of-sale data to reduce forecast error by an additional 25 percent. AkzoNobel is currently in the process of deploying Terras Demand Sensing and Multi-Enterprise Inventory Optimization in Europe, the Middle East and Africa. The addition of MDS closely connects AkzoNobels supply chain to the store shelf, allowing the company to make further gains in customer service and inventory reduction, according to the company. By implementing Terras MDS, we can now use point-of-sale data to create value for AkzoNobel and our customers, said Alain Crottaz, EMEA planning director, AkzoNobel. Using daily retailer data with demand sensing enables us to predict their orders. The ability to sense shifts in demand and quickly respond helps us meet our key goals of lowering stock while improving customer service. Daimler AG Gives Worldwide Approval of PPGs New Matte Clearcoats


PPG Automotive Refinish has received

approval of its new matte clearcoats D8115 Matte and D8117 Semi-Gloss by Daimler AG for use on all Daimler mattefinished passenger cars worldwide. The new clearcoats use the unique PPG dualclear repair process recently validated by Mercedes-Benz. According to PPG, full-body matte clears have increased in popularity in recent years and have continually proven technically complex to repair in order to achieve the perfect level of matte effect, especially with black and other very

dark colors. Minor damage has often had to be repaired by painting full panels in basecoat and clearcoat or by painting the entire side of the vehicle. PPGs dual-clear process allows the basecoat to be blended, significantly reducing the repair area and bringing the process back into more conventional dimensions. Demonstrated to Daimler on a matte black bodyshell in Hilden, Germany, the dual-clear process uses a glossy clearcoat as the first coat, followed immediately by a second coat based on a blend of the two

Each month, Northcoast Research surveys a large sample of paint retailers throughout the United States to get a sense for current business trends. Please note that of the three primary architectural coatings channels (paint stores, home centers, and retail distributors), this survey is primarily reective of the distributor channel which tends to see volume growth less than the industry; therefore, we view the results as a directional indicator more so than absolute industry volumes. Architectural Coatings Sales Volumes Up 1.9% in October vs. Last Year According to industry participants, average sales volumes in October rose 1.9% year-over-year following slightly slower growth of 1.3% in September and momentum picked back up where it left off from the 2.5% in August. Following a slower September, momentum accelerated back to levels more commonly seen over the past couple of months as precipitation returned to more normal levels. Overall, 68% of respondents witnessed an increase in volumes vs. only 14% that saw volumes decline, which averaged out to 1.9% volume growth and a net increase of 54%. Price of Paint from Suppliers 2013 Paint Prices Up Slightly vs. 2012 57% of contacts noted a year-over-year increase in the cost of a gallon of paint from suppliers in the month of October as our paint price index increased 1.4%. This compares to a year-over-year increase of 1.4% and 1.0% in September and August, respectively. Price increases issued by paint manufacturers in 2012 as a result of recovering raw material ination are starting to anniversary and thus year-over-year price increases are becoming less pronounced a trend that is likely to continue. We believe the trend of generally stable pricing will be sustained as 86% of respondents reported that there have been no price increase notications issued from paint suppliers at this time. Raw Materials TiO2 Sees Slight Down-Tick in Pricing Titanium dioxide (TiO2) prices have been stabilizing recently after witnessing sharp declines earlier in the year; however, our proprietary TiO2 index saw a slight price decrease recently as seasonal demand slows. Propylene prices were previously climbing, but have declined and stabilized since its peak in September. TiO2 manufacturers have recently issued price hike announcements although our data suggests these increases are not sticking. Overall, our research suggests that there is an emerging acceptance in the market for a moderate TiO2 price increase in 2014 but likely not until the end of the rst quarter. Paint Inventory Levels Inventory Levels Remain In Balance 90% of respondents stated that current paint inventory levels at their location are in-line with current business conditions and they are maintaining current levels of purchasing. Only 8% of contacts noted that current paint inventory levels are too low while the remaining 2% of participants revealed that paint inventory levels were too high in October. Overall, we believe that inventories are well-aligned with current demand levels. 3 Month Outlook Outlook Positive with Sequential Improvement Our proprietary Architectural Coatings Outlook Index reached 0.57 for the month of October compared to a level of 0.35 in September. Please note that the highest possible reading is +2 (indicating all contacts have a very positive outlook) and the lowest possible reading is -2 (indicating all contacts have a very negative outlook. A reading of 0.57 is a positive translation as it represents an improved outlook from September which was in-line with Augusts robust reading of 0.57 and indicates that contacts within the industry maintain a favorable outlook that is growing and are generally in anticipation for business to improve from current levels.

new clearcoats, D8115 and D8117. This process provides a match to the original color while maintaining an even level of matte finish across the repair area. The two new matte clearcoats were specially developed to provide the end user with the flexibility to blend the clearcoats together to achieve a perfect match to original matte finishes. This approach can be used on all colors to attain an effective repair and is a key step in the efficient repair process for darker colors such as MercedesBenzs Nachtschwarz black. PPG is first to market to recommend this process together with its market-leading matte clearcoats for repairing a wide range of gloss levels on matte and semimatte full-body colors. Matte finishes have increased in popularity with an increasing number of OEMs over the past few years, and it became clear to us that a special process would be needed to replicate the factory finish accurately, explained Ron Thomas, product platforms manager, EMEA. The two new clearcoats were developed to

provide the basis for the concept, and then in collaboration with Mercedes-Benz, the process was further developed to create a perfect result on darker colors and matte blacks. Renato Liano, front end evaluation manager at PPG, originally developed the dual-clear concept and followed up in close collaboration with Daimler AG to validate the overall process. This ultimately led to the approval from MercedesBenz, which is extremely pleased with the technical results. Body shops will benefit greatly since the application and blending of the basecoat can still be carried out using existing processes, saving time and increasing efficiency over earlier methods. The process provides an accurate match on the most difficult full-body matte colors and creates an easier, more effective and efficient process for matching the original finish and bringing overall repair time in line with conventional repairs. It should also be noted that in North America D8115 and D8117 are national

rule-compliant. For VOC containment areas, use a recommended PPG 2.1 VOC clearcoat with SLV4985 flattener.

PPG Donates $55,000 to the Center of Science and Industry (COSI) for New Energy Explorers Exhibition
The PPG Industries Foundation has donated $50,000 to COSI, the Center of Science and Industry, located in Columbus, in support of its new Energy Explorers exhibition area, along with $5,000 to assist COSI in covering general programming expenses. PPG is a long-time supporter of COSI and STEM education partners and we are appreciative of that support, said David E. Chesebrough, Ed.D., president and CEO of COSI. But Maldonado has pointed out that although Comex is already the leading paint company in the country, over 300 other manufacturers in the country continue to do business, since there are varied paint quality levels offered and sought in the various segments of the market. Maldonado further points out that the industry suffers from high-cost raw material imbalances, which the S-W/Comex merger might alleviate in part. Beyond the domestic competition issue, Maldonado was quoted saying 98 percent of the Anafapyt membership sees the S-W/Comex deal as an opportunity for Mexicos expansion in the global market. Comex is not only the largest paint distributer in Mexico, but also in Central America; the company has an international distribution chain that reaches as far as China. Increased Mexican paint sales to the United States, to Europe and beyond have been a dream of the industry for years, following the formation of the North American Free Trade Agreement in 1994 and the Mexico-EU Free Trade Agreement in 1997. Given Mexicos proven ability to compete with Chinese manufacturing, Sherwin-Williams investment could help rekindle growth of the Latin American paint market. CW

herwin-Williams (S-W) executives have said they plan to head south to meet with the new members of Mexicos anti-monopoly agency, Comisin Federal de Competencia Econmica (CFCE), in an effort to come up with a winning solution for their twice-rejected initial proposal to acquire the Mexican operations of Comex Group. While the regulators oppose the deal on the basis of potential unfair competition, Mexicos paint manufacturers have embraced the deal for the boost it would provide for the industrys global ambitions. In September, S-W, completed the purchase of the U.S. and Canadian businesses of Comex for $90 million in cash and assumed debt of some $75 million, out of a total offer of about $2.3 billion. Still, the Mexican manufacturing and distribution capabilities of Comex are the prize target. Alejandra Palacios Prieto is the new head of the CFCE, following work at the federal telecommunications regulatory agency and as a director of governance projects at the Instituto Mexicano para la Competitividad (IMCO), an independent think tank on domestic and international competitiveness. Her new colleagues at CFCE are well-heeled academics and professionals with international credentials that include degrees from such institutions as Stanford, the University of Chicago, Texas A&M and the University of Warwick. Palacios has said the CFCE is open to a modified deal. While S-W engages her and the rest of the new team, the Mexican paint manufacturers association has gone to bat for the merger. Javier Guillermo Maldonado Moctezuma, the president of the Asociacion Nacional de Fabricantes de Pinturas y Tintas (Anafapyt), has held several interviews supporting the deal, following the two CFCE decisions the first made by the old members of the agency, followed by unanimous

The construction upturn in the Gulf has triggered new expansion plans in the area among not only European but also Asian coatings producers, many of whom bundle Europe, the Middle East and Africa into a single entity in their marketing strategies. Some of them did well in the region in the years prior to 2008 when coatings sales in its oil and gas rich countries increased rapidly, particularly in a burgeoning construction sector. However during the new period of fast growth, international coatings companies will be confronted with changing market conditions. Construction will continue to be the cornerstone of the market. But overall it will be a much broader coatings sector. It will be serving a more diversified Gulf economy less dependent on oil and gas revenues by having a lot more capacity for downstream manufacturing.

This recovery was symbolized in late November by the announcement that Dubai, which was dubbed the construction capital of the world during the boom years of the mid-2000s, will be the site of the World Expo trade convention of 2020. The emirate, which is part of the United Arab Emirates (UAE), aims to spend $8.4 billion on the six-month event with a huge exhibition center, new hotels and expanded transport infrastructure. Two years later nearby Qatar will be hosting the World Cup, on which it has already started

Over the last 20 years the Middle East Gulf, which comprises mainly the Arab states of Saudi Arabia, Kuwait, Bahrain, Qatar, Oman and the United Arab Emirates (UAE) but also Iran, has shifted from being predominantly an oil and gas producer to also being manufacturers of petrochemicals and base chemicals as well as energy-intensive products such as steel and aluminium. Now they want to use these commodity chemicals and metals, which are currently mainly exported, as raw materials for the manufacturing of added-value products like consumer goods, automobiles, household appliances and electronic equipment. These downstream products would be sold not only in the domestic market of The Gulf Co-operation Council (GCC), a free trade area, comprising the six Arab Gulf states, which has a population close to 50 million. They could also be exported to the whole Middle East and North Africa (MENA) region with a population of 400 million. The size of the potential export market could rise to more than one billion with the addition of parts of east Africa and central and southern Asia. With a prospective regional market of such a huge size, international coating companies would have to consider establishing local production capacity. The vision of being a large manufacturing hub will also prompt the creation of a large indigenous coatings sector in the Gulf. In Saudi Arabia, which accounts for approximately 60 percent of the GCCs population and more than 40 percent of its GDP, a $517 million plant with an annual capacity of 340,000 metric tons a year of butanol is being built to provide raw materials for the large scale production of coatings in the country. Even now after 40 years of virtually continuous growth in construction in the Arab Gulf of homes, offices, transportation networks and utilities, the major suppliers of coatings are foreign-owned. They will, initially at least, benefit the most from a new phase of buoyancy in the Gulfs construction sector whose annual growth dropped by twothirds in 2008-2011 to around 5 percent, according to figures from Qatar National Bank (QNB). But the growth rate has since almost doubled and looks likely soon to return to its pre-recession levels. Saudi Arabia also aims to establish a local household appliance industry with an annual capacity for one million refrigerators, 800,000 washing machines, 250,000 dishwashers, 100,000 gas cookers and 1.5 million air-conditioning units. The country is also planning to build at cost of $400-500 billion up to six new economic cities to provide an infrastructure for a range of downstream manufacturing clusters. AkzoNobel has among the leading international coating companies been one of the most active in responding to the new prospects in the Gulf region, where it has had a marketing presence for nearly 40 years. We continue to look for effective ways to unlock its potential, said Keijzer. The company acquired in October a 50 percent share in Sadolin Paints of Oman to help the business expand its range of decorative paints, wood coatings and fire protection and powder coatings. AkzoNobel has also set up a marketing outlet in Qatar to take advantage of projects like the World Cup and the countrys large natural gas sector. BASF Coatings has been enlarging its Gulf business in car refinishing coatings through its R-M brand. With its strategy of providing complete solutions for car makers in OEM and refinish coatings, the company is well positioned to gain a presence in Saudi Arabias fledgling automotive manufacturing segment. Saudi Arabia and Jaquar Land Rover, part of the Tata Group of India, reached a deal late last year to set up a $1.2 billion car assembly plant in Saudi Arabia. BASF already has close ties with Tata, through its operations in the UK. BASF is already involved in the coil coating market in the Middle East through an alliance with the Turkish producer Coat Coil. Turkey aims to be a major exporter of coil coated and other metal products to the Gulf. However, the Arab Gulf already has a relatively large coil coating sector able to take advantage of GCC import duties. One dilemma facing international coatings producers in the years ahead is how much they will need to have a local production presence to benefit fully from a fast growing regional market. CW

In the falls of 2012 and 2013 the market for large infrastructure projects in Oman, Qatar, Saudi Arabia and the UAE rose by an average 27 percent, Conrad Keijzer, executive committee member responsible for performance coatings at AkzoNobel, told a press conference in Oman in October. While the big rise in construction activity will generate high demand for decorative paints, sales of performance coatings, like anti-corrosion and intumescent fire protection products, will grow faster, the company predicts. While the numbers of residential, commercial and infrastructure projects will increase, there will be continued rise in oil, gas, refinery and petrochemical chemical schemes. In 2012-2020 capacity for petrochemicals and other chemicals in the Arab Gulf will rise by 50 percent, according to the Gulf Petrochemicals & Chemicals Association (GPCA) However for many coatings companies the biggest interest will be in the regions long-term plans for new downstream manufacturing operations, particularly in Saudi Arabia. The regions largest country, which urgently needs to generate jobs for its predominantly young population, plans to make 600,000 cars a year by 2025 with locally produced components and materials for the domestic and export markets.

HBR shows an example comparing traditional strategic consulting firms versus the intrusion of the new models: The share of work that is classic strategy has been steadily decreasing and is now about 20 percent, down from 60% to 70% some 30 years ago, according to Tom Rodenhauser, the managing director of advisory services at Kennedy Consulting Research & Advisory. the results of the consultants inputs. Clients have usually relied on brand, reputation, and other social proof (education pedigrees, eloquence and demeanor) as substitutes for measurable results. This rationale set appears to be unstable in todays instant gratification climate. Agility has been another strength that has allowed the BIG GUYS the flexibility to respond to threats of disruption in the past. The large-, as well as some of the medium-sized market challengers to the big firms, are the direct opposite of Republic and US Steel disruption cases. However, HBR says, opacity and agility are rapidly eroding in the current environment. All Good Things... Must Come to An End...Unless Theyre Really Good, Like You Know, Chocolate or Something!

We look at trade secret cases that have been or are currently being litigated for suggestions of how to determine what is or isnt a trade secret, and these collectively form the common law. Lawyers occasionally look at the common law cases and summarize or restate the case law generating what is called the Restatement of Torts, or Restatement of Unfair Competition. Sometimes, they will suggest statutes to govern what is and isnt a protectable trade secretfor instance in whats called the Uniform Trade Secrets Act. Sometimes states adopt these suggestions from one or the other of these bodies of law into their own state lawsthats called statutory state law. The Feds do the same thing, ergo, federal statutory trade secret laws like the Economic Espionage Act. It gets really mind-numbing when you cross back and forth over national borders to protect your companys crown jewels. If in doubt, ask a litigator. Remember, it is not uncommon that a trade secret heist is an inside job. Secret formulas, manufacturing processes, financial information, future product plans, customer listswhat are your trade secrets and what are you doing to protect them from inadvertent or intentional misuse or misappropriation by your own employees? Trade secret protection is afforded to you as employer, but only if you the employer take reasonable steps to treat this information as confidential and you provide notice to employees of the status of the secrets. Protect, inform, get consent, maintain and remind employees of your trade secret policies. Employees need to know the boundaries of their access to trade secrets, how to treat trade secrets and the consequences if breached. It is important that these policies are set forth in clear and unambiguous language. Patent versus trade secret protection? In many cases, a patent is not the best way to approach this. A patent is in essence Plaintiffs Exhibit No. One, i.e., youre going to have to sue someone. You may have to repeat the process and spend gobs more money in Japan, Europe, etc. to cover those markets. Getting a patent in the U.S. these days is an expensive crap-shoot with the dice moving in super-slow motion. Your companys internal know-how can be protected immediately by binding contracts and concrete actions. Patent protection has its own intrinsic value, but trade secrecy is like loveits yours to cherish forever and it shouldnt cost you as dearly. If you have to resort to the courts to protect your trade secrets, all of the work you have done to batten-down your trade secret assets will be scrutinized and examined under the microscope and harsh light of 20/20 hindsight. Therefore, the creation of a program and its routine and rigorous enforcement is essential because every element of your program will be attacked as a defense to enforcement. If you fail to show that you have trade secrets or that you have not adequately protected them, even if the defendant wrongly accessed them, you will likely lose your case. Not only will you be unable to enforce it against the present defendant, it is likely that you will be unable to enforce them against any subsequent violator. So, in setting up your trade secret protection program, think lawsuit. Doing It Yourself even if you are setting up your trade secret protection protocols yourself, there is one and only way to organize your DIY trade secret audit and, that is by preparing yourself for a trade secret lawsuit. There are really only a few possible legal theories and chiefly there are two upon which you should focus your audit. Namely, either the bums broke a contract with you under which they promised NOT to steal them, or they committed the civil equivalent of criminal theft. In many cases, a well-designed process can prevent trade secret theft in the first place. In the instance that misappropriation takes place, this same wellhoned system can quickly and summarily prevent actual damaging use or more widely disclosed knowledge of your competitive information. And, in the fairly rare event that the suit goes the distance, your system will

The Wall will help you to avoid theft by relatively honest people and if litigation is inevitable it will serve as concrete evidence in court showing you took reasonable and proper steps to protect your trade secrets. A trade secret audit will have you locked and loaded and the thief will be staring down both barrels of a sawed-off 12-gauge shotgun poking out from behind a wall of paper. The paint and coatings industry is one whose recipes tell only a part of the story. We produce many high-solids suspensions, with many ingredients, using many process steps all of which are embodied in the product on the shelf. Even with the product in hand, and even with the publicly available Materials Data Safety Sheet, a competitor is sorely pressed to duplicate the coating in many cases. place your case in the best possible position to prevail. But, and not just because we are lawyers, do consider using a pro to set up your protective processes. There are two main goals of a professional audit. The first is to insure your procedures are strong enough to discourage and/or prevent a trade secret theft under real world attacks; and the second is to use the documentation of these procedures to provide ammunition in court to quickly and decisively stop any breach. We have also discussed what to do in the event that you have not been as diligent as perhaps you should have been in setting up your bastions of trade secret protection. There are instances in which a high-level departing employee can still be bound to protect your crown jewels even if he/she is not contractually bound to do so the Inevitable Disclosure Doctrine best explained by the Rolling Stones song, You Cant Always Get What You Want (but sometimes just sometimes you get what you need) You might be able to temporarily prevent someone from using your trade secrets long enough to establish your market lead, though you would prefer that prohibition to last forever. But what about completely careless and unprotected business relations, and employees to which the law does not extract a heightened fiduciary duty? We explored the situation where your trade secrets have been absconded in the hands of a mid-level employee, only to discover that you have failed to contractually protect yourself. Where there is a contract between the parties, to the extent it is consistent with public policy, a court will look to the contract to govern the parties intentions. But where there is no contract, trade secret law can offer protection by operation of law. There may be independent civil liability under the Uniform Trade Secrets Act (UTSA). If you do discover a hole in your prophylactic Wall of Paper, good business practices under the UTSA may provide you the protection you need. And let us not forget that we are chemists, engineers, scientists, and technical-industry gurus! WE KNOW lots of tricks of the trade and in-depth secrets that are important to protecting our technology. For instance, the common wisdom is that a mixture of commonly-known chemicals will not qualify as a trade secret. But, specific proportions, acceptable ranges of concentrations, orders of addition, pot times, etc. might very well be protectable. So, dig deep and deeper again to identify even more of your corporate assets heretofore un- or under-appreciated. Search for them where they lie cloaked and unseen, in the intimacy of the chemistry itself. Look for something that in many cases is unrecognizable but to a few chemistry nerds like us, and certainly not necessarily in the common knowledge surrounding our formulations. It is also important that we know what our assets are worth. The law imposes a value standard on trade secrets. A trade secret is valuable if it gives its owner an opportunity to obtain an advantage over competitors who do not know or use it. Courts appear may deny protection to any alleged trade secret that is deemed to be valueless. How much are our corporate trade secrets worth? thus becomes a very important question under a variety of business and legal scenarios restraining orders, injunctions, licenses, mergers, and overall company worth. If youre ahead of the game (you are the trade secret owner), stay ahead of the game (by knowing exactly what your trade secrets are and what theyre worth). And, this becomes critical when it is time to license your trade secret with the caveat that you must take care that your licensee does not intentionally or unintentionally divulge your property. A prospective licensee will likely want to look under the hood at your trade secrets prior to opening up their billfold. All the procedures for maintaining secrecy should be incorporated into the prenegotiation confidentiality/nondisclosure and subsequent licensing agreements, as well as which of your trade secrets will be part of the agreement(s). The agreement should clarify the licensee should use reasonable safeguards to maintain the trade secrets security in order to maintain its secrecy, and may include details regarding the security to be implemented, and rights for the licensor to inspect the security measures. The real meat and potatoes value of your intellectual property often is in your trade secret rather than a patent portfolio, and you should not forget that in determining the licensing royalties. Though your patents may cover related materials, and must include the best mode of practicing an invention as of the date of filing the patent application (i.e., a previously held trade secret = the best mode), often after the patent applications filing date new trade secrets such as substantive refinements and improvements or spin off technologies are developed. These additional, non-patented trade secrets often have the most real world licensing value as part of your trade secret portfolio. Further, patents must disclose the best mode, but not the worst mode (please do not give the patent office any ideas, OK?). Working know how of what not to do the technological dead ends can be of tremendous competitive edge value in accelerating development of a technology by showing a licensee where not to waste resources in bringing a product to market. And then we handled the hot potato of non-competition - the very term seemingly un-American. And, we admitted that that pretty much sums up the same attitude that the American courts have towards noncompetition agreements. So, how you walk the fine line between protecting your trade secrets and other confidential information using a non-competition agreement and running afoul of the natural disdain with which courts hold such agreements, is a dicey process. The drafting and enforcement of non-competition agreements is a nuanced exercise. One size does not fit all - but if you do choose to use one, then a non-competition agreement should be just one piece of the innovation protection pie, used in connection with confidentiality, nonsolicitation, anti-raiding and assignment of invention agreements to comprise a wellbalanced intellectual property program. And the thieves are getting very, very good at stealing your trade secrets hacking is a worldwide industry in itself. So besides draining your bank account, what are hackers after? They want your money, your trade secrets, you customer files. Trade secrets, like formulations, know-how, branding, internal codes, employee and customer information, business strategies and other sensitive information can all be compromised by electronic theft. Cyber hackers are just thieves, looking for an easy entry point. You lock your doors at night; lock your cyber valuables as well. With proper security, that hacker will likely move on to some unsuspecting victim. And then maybe you wont find out the hard way about that condo in Singapore you bought that you will never see. CW

PPG Introduces Duranar GR and Coraon GR Grafti-Resistant Coatings

PPG Industries industrial coatings business has introduced Duranar GR (graffiti-resistant) and Coraflon GR coatings. Duranar GR and Coraflon GR coatings feature a clear, graffiti-resistant barrier over the pigmented color layer of the coating. If the coating is spray-painted or otherwise marred, it can be cleaned by applying Duraprep Prep 400 graffiti remover by PPG. After the solution has been allowed to dwell on the stain for 10 to 60 seconds, it can be wiped with a clean cloth or scrubbed with a nylon brush. Most stains can be removed in 10 minutes or less. When applied on either Duranar GR or Coraflon GR clear coatings, Duraprep Prep 400 field-applied graffiti remover eradicates graffiti as well as paint overspray, pen and marker ink, lipstick, scuff marks, tape residue, bugs, tar and many other substances that mar the appearance of commercial buildings. It is believed to be the only graffiti-resistant coating system sold and tested by the same company, according to PPG.

Tikkurilas Temadur Paints Shorten Lead Times in Production


Tikkurila Oyjs range of industrial coatings has been extended with new fastdrying single-coat polyurethane paints. The Temadur SC-F series have shorter drying times than the previous Temadur SC series. The new Temadur paints contain anticorrosive pigments and are ideal for use as single-coat paints, according to the company. The recommended dry film thickness of 120m with one coat will provide excellent weather and abrasion resistance. The Temadur SC-F series of paints are recommended for steel surfaces blast cleaned to preparation grade Sa2, or for surfaces primed with Temadur 20, Temacoat GPL-S Primer or Temanyl PVB from Tikkurila. The Versiline vinyl ester range is already widely used in the U.S., and Hempel is launching it on the global market for the first time. Versiline is a range of tailor-made specialty solutions for highly challenging applications such as chemical tanks, stack linings and absorbers. The range was initially developed by U.S. Company Blome, a company Hempel acquired in 2012. Hempel is making the Versiline brand available globally, starting with the Versiline vinyl ester range, which was recently launched this year. The Versiline vinyl ester range includes five coatings that can be combined in various systems depending on the requirements of each application. Vinyl ester coatings offer superior performance against high temperatures and aggressive chemicals making them ideal for the extremely corrosive and abrasive environments encountered in many process industries. Strengthened with an epoxy backbone, the coatings in the Versiline vinyl ester range are also highly resistant to water penetration, delamination and humidity.

It is typically applied in a 4.0 mil wet film thickness that dries to approximately 2.0 mils. The theoretical coverage rate in a 1.0 mil dry film is 1058 ft2/gal. Corr-Paint CP2010 can be used in combination with Aremcos Corr-Prep CPR2000, a solution that is used to prepare extremely smooth surfaces for coating. CP2010 can also be applied directly to severely rusted surfaces found in many maintenance and repair applications. Application methods include brush, roller or conventional pneumatic spray equipment. Typical applications include the coating of OEM components such as motor housings, bag houses, cyclones, hoppers, pipelines and precipitators, to the coating of large structures found in MRO (maintenance repair operations) applications throughout the power, pulp and paper, and chemical processing industries.

New Biobased Open Atmosphere Corrosion Inhibitor from Cortec


Cortec Corporation has launched EcoLine 3680, a certified biobased, biodegradable, ready-to-use temporary coating for multimetal protection. EcoLine 3680 is formulated with USDA renewable raw materials, which allows use for corrosion protection of equipment where incidental contact with food is possible. The product is HX-1 approval pending. This green inhibitor provides indoor and outdoor multimetal protection. When applied on the surface, it leaves a tenacious, dry-to-touch protective coating, which provides excellent protection on metal surfaces, according to the company. The film is self-healing and moisture-displacing, providing superior protection even against aggressive environments. This wax-like film can be removed with alkaline cleaners such as Cortec VpCI-414. The market for powder coatings continues to recover, as manufacturers focus on enhancing their products to drive growth.

owder coating manufacturers Coatings World spoke with reported that the market is growing. Powder coating manufactures are working on improving durability, corrosion protection and lowering cure temperature to drive growth, in addition, to moving into new emerging markets around the world. Although powder coatings, as with many products, have not had quite the level of expansion that anyone would love to see, with the economy still in a slow growth mode, the growth in powder has been faster than that of the economy, said Ron McMahon, marketing director powder coatings, SherwinWilliams. It continues to gain acceptance as a viable technology among finishers and their customers. Powder coatings markets performed in a similar fashion to other paint and coatings markets and were impacted by the overall economic slowdown in the past, said John Wolff, AkzoNobels general manager for Powder Coatings. We are very pleased to now see the European market stabilizing, with some remaining volatility. We also see North America on a recovery path and China is coming back, as well. As a global market leader in powder coatings we believe that we are best positioned to benefit from the positive dynamics in these markets. At the same time, we are making very good progress in improving our operational efficiency in Europe and some of the other mature markets. Stricter environmental regulations in the paint and coatings industry have certainly given powder coatings a boost as there are several advantages to the powder coating process, the main one being that it does not require solvents, and only minor amounts of volatile organic compounds (VOCs) are released during the cure. VOC and solvent-free technologies like powder are advancing and benefiting from stricter environmental legislation, said Wolff. It is, for example, easier for an applicator to get a license for powder due to its lower impact on the environment. This applies to the entire supply chain. We have and will continue to

invest in powder coatings as we see it as a more sustainable alternative to liquids. As well as being free from solvents, powder coatings are easy to use straight from the box. They are also recyclable and easy and safe to dispose of. This is in line with AkzoNobels ambitious sustainability targets.

According to McMahon, although environmental regulations were the primary driver for many years and remain a key driver, there other factors contributing to powders growth. Although regulations remain a consideration, powder coating usage over the past several years has really been driven by the overall advantages powder offers to finishers and the benefits powder can provide customers, he said. These include the fact that powder can be applied as a primer-less finish (direct to metal); powder is efficient in that 95-98 percent of the coating can be used with a properly designed and maintained reclamation system; powder is easy to apply and powder produces a durable, high quality finish. Powder coatings have seen growth in a number of regions. As expected Asia continues to be a growth engine, however, McMahon said that Sherwin-Williams is seeing growth beyond China in places such as Thailand, Indonesia and India. Eastern Europe is also growing, especially Poland, he added. We have seen significant growth in places such as Brazil and Turkey. AkzoNobel has recently invested in new powder coatings factories in Chengdu in Western China and in Dubai in the Middle East to support the growing demand in these regions. While we invest in high growth markets; we continue to consolidate our manufacturing footprint in mature markets to improve our efficiency and to adapt our production to the regional demand, Wolff added. In September, AkzoNobel announced plans to expand its powder coatings manufacturing facility in Chengdu, China. This production site is scheduled to be operational in late 2014. Located in the Chengdu Economic and Technology Development Zone, the site occupies an area of 18,000 square meters and has more than 10,000 ton capacity per annum. In November, AkzoNobel announced plans to invest more than 1million in the UK, to build a new Powder Coatings Pilot Plant at its Felling site in the UK. The function of this pilot line is to replicate the companys manufacturing system, enabling new powder coatings to be produced in a way that fully mimics full-scale production. Collection Anodic Range featuring matt and metallic powder coating finishes in popular anodizing shades. The collection offers a sustainable and aesthetic alternative to anodized aluminum, due to its environmental credentials and smooth metallic finish. The Anodic collection differs from traditional anodizing in its improved color consistency and versatility, according to the company. AkzoNobel also recently launched a new Interpon F 2014 trend range, designed for the furniture market, which offers protective, durable and design driven powder coatings. Created with the tough performance requirements and aesthetic qualities demanded specifically by the furniture industry, the Interpon F range offers a sustainable, quality coating alternative with increased scratch resistance and hardness as standard for the interior and exterior furniture markets. Lastly, AkzoNobel launched collection Futura 2014 - 2017, featuring 55 special effect coatings. According to the company, it is a durable range of powder coatings intended for use on architectural aluminum and galvanized steel. It delivers long-term performance, superior gloss retention, maximum film integrity and resistance to color change. The result is a long life high durability surface that retains its appearance and requires minimal maintenance for many years. AkzoNobel Powder Coatings has ambitious plans for the future. Further to offering productivity and efficiency increases through lower cure temperatures, we are constantly working on improving the eco-efficiency of our products to the benefit of our customers, said Wolff. Our products offer our customers sometimes the opportunity to replace precious materials in their buildings and applications, due to the sophisticated look our powder products create, thereby creating substantial cost savings and contributing further to the sustainability agenda of our customers. As part of AkzoNobels sustainability agenda, the company is working on a further reduction of cure temperatures for powder coatings. This will also have significant benefits for customers, as lower temperatures will ultimately result in lower energy usage and this higher and more cost efficient productivity. We will shortly be launching our new Interpon Align powder coatings system, Wolff said. Utilizing dry-on-dry coating technology, Interpon Align delivers superior edge coverage and corrosion performance, while eliminating one full cure cycle. The result is improved productivity, lower energy consumption, shortened coating cycle time, and reduced capital investment. Furthermore, we are constantly looking into new colors and effects for the furniture and architectural market. Additionally, powder coating performance remains a key target for AkzoNobel. We have launched a series of products under the Steelplex brand in Australia looking at a combination of corrosion resistance and UV resistance, Wolff said. We are working on products to improve corrosion resistance in the alloy wheel market while focusing on emerging markets we are looking at high performance products that can be applied over poorer surface treatments. he market for biocides continues to be driven by both new construction and the demand for higher quaility paint products. Overall global demand for biocides has remained stable, said David Tierney, head of global sales at Lonza. North America and Europe have reduced slightly, while modest growth has been seen in South America and Asia. Troy has seen an overall increase in global demand for biocides over the past year. However, there have been disparities in regional activity, said W. Brian Smith, vice president of Troy Corp. The Asia/Pacific region continues to grow, although not as aggressively as in years past. Growth is driven not only by new construction, but also by the increasing demand for higher quality paints and coatings with greater and more sophisticated wet-state and dry-film protection. Troy is in a strong position to supply these regional markets with the right technologies that offer high levels of performance, environmental responsibility, and cost-efficiencies, backed by regional distribution, regulatory assistance, and expert technical service and support, Smith added. Last year, Troy unveiled a state-of-the-art 1,500m2 logistics center in Thailand to service customers in Asia. Troy also doubled the size of its Thailand manufacturing site, significantly increasing the versatility and capacity of production. Troy recently opened its new Technical Service and R&D Center in Bangkok, Thailand. The new facility represents a major expansion of laboratory facilities for new product development, technical service, and field testing. Troy has been a dedicated supplier to the Asia-Pacific coatings industry since 1970, and has manufactured products in Asia since 1997. Biocide manufacturers report that it is not enough to simply offer a reliable product, customers expect a full range of valueadded services such as lab testing and technical support. Troy said that its customers are looking for class-leading protection

in the wet-state and on the film surface; green attributes, such as minimized environmental persistence, lowest toxicity, and safe handling attributes; and, of course, cost-efficiency. World-class regulatory support is a value-added service that Troy provides to its customers, Smith said. Different regions and countries around the world often have complex procedures and protocols that necessitate the assistance of suppliers like Troy who have experience in these areas. Troy has a long history of regional and local regulatory expertise, and has been serving customers in Europe, Asia, Latin America, and the Middle East/ Africa for several decades. There is an increased awareness regarding environmental impact of coatings and our customers are interested in longer term protection and lower leaching biocides for external applications, said Tierney. Additionally customers require efficacy against different target organisms as climate change affects the nature of surface spoilage. Paint and coatings manufacturers continue to address the challenges created by microbial contamination, which can cause gas production and bulging containers, phase separation, viscosity changes, poor stability, loss of film-forming properties and foul odors, said Beth Ann Browne, North American customer application specialist, Dow Microbial Control. Our customers continue to seek more sustainable product options, including low-VOC (volatile organic compound) formulations. Dow Microbial Control offers a wide range of solutions for in-can preservation and dry-film protection. Many climates around the world are subjected to algal growth. Because of this, biocide suppliers have been concentrating on the incorporation of anti-algal protection into dry-film preservatives. Lonza recently launched two new dry film preservative blends. Densil ZOD and Densil FAZ Antimicrobials are formulated to provide long term protection, especially in tropical environments. Lonza has also expanded pyrithione production at its two strategic manufacturing facilities in Rochester, New York and Suzhou, China. Dow Microbial Control has developed a number of highperforming and sustainable antibacterial, antifungal and antialgal products and solutions for coatings. We recently introduced MBIT (N-Methyl-1,2benzisothiazol-3(2H)-one), the only new active ingredient launched this century for in-can preservation. MBIT enables customers to maintain excellent in-can preservation in a sustainable and cost-effective manner, Browne said. BIOBAN 557 is an MBIT combination product scheduled for release in the U.S. in 2014. This next generation in-can preservative product for paint, colorants and latex emulsions is suitable for lowVOC water-based systems and is compatible with major coating ecolabeling schemes. It does not contain or release formaldehyde, and does not contain bronopol. It is a versatile combination product that closes performance gaps in other single-active isothiazolinone products and demonstrates long-term in-can preservation efficacy against bacteria and fungi, including resilient environmental isolates. Outside of the U.S., the MBIT-containing product BIOBAN 551S is already used to preserve paints and latex in regions including Southeast Asia and South America. CW

LEED v4 Launches at USGBCs Annual Greenbuild Conference

EED v4, the newest version of the LEED green building program, recently launched at the annual Greenbuild International Conference and Expo in Philadelphia. Developed by the U.S. Green Building Council (USGBC) LEED has revolutionized the marketplace since 1998 as the worlds premier benchmark for the design, construction and operation of high-performance green buildings. LEED v4 builds on the fundamentals of previous versions while offering a new system that prepares all LEED projects in a portfolio to perform at a higher level. Over the past 15 years, LEED has fundamentally revolutionized how we design, construct, operate and maintain our buildings and communities. he 31st Biennial Western Coatings Symposium was held October 21-23 at the Paris Hotel in Las Vegas, Nevada. Organized by the Western Coating Societies, the conference serves the people, companies, clients and customers of the coatings industry, addressing issues and concerns through oversight, advocacy, expertise and information sharing. This three-day event featured technical sessions, tabletop exhibits and a panel discussion. The Symposium was well attended with an attendance of 1,140 with a breakdown of 930 attendees, 130 exhibitors and 80 speakers. The general feedback we have received so far has been excellent with several emails to the WCS Board thanking us for putting on a great Symposium and Show, said Hal Harlan, member of the Western Coating Societies Board.

Technical Program
The technical program featured two keynote addresses. The first day featured a keynote address U.S. Economic Outlook by Dr. Robert Fry, a senior analyst at DuPont. Fry expressed cautious optimism for the future of the U.S. economy. U.S. recovery remains disappointing, Fry said. Employment has grown steadily, but too slowly. It will take us a while to get back to pre-recession levels. U.S. consumer confidence has come down due to the government shutdown, but I think that it will be temporary. The U.S. avoided a 2013 recession thanks to pent up demand for housing and automobiles. The economy has grown despite fiscal contraction. The second keynote address was given by Cyriac Alexander, vice president of technology and purchasing at Behr Process Corp.

In 1975 there were 100 coatings companies in the U.S., today there are only 31, said Alexander. Still the coatings industry has adapted and changed to meet the demands for high performance, cost effective coatings. This has helped the coatings industry achieve success despite the economic crisis. The industry continues to innovate. The technical program featured four sessions running concurrently. Presentations covered a broad range of topics and included both paint manufacturers and raw material suppliers. Presentations included Powder Coatings in the Defense Industry, by Beth Ann Pearson of Sherwin-Williams; Supersticky Waterborne Primer, by Peter Schmitt of Bayer MaterialScience and The Challenging Landscape of Alkyd Emulsions for Architectural Coatings in North America, by Neal Rogers of Arkema Coatings Resins. The WCS also featured a Leadership Panel: Lets Talk about Money, which was moderated by Patrick Kelly of Dowd and Guild and featured insights from a variety of experts in the coatings industry including Vince Anderson of the Horn Company, Eric Fernandez of EP Minerals, John Gilbert of Behr, Sheryl Southwell of Specialty Polymers and Wilhelm Wessels of BYK Chemie. The Panel offered insight on a variety of topics. Sheryl Southwell was asked what were the lessons learned from the economic downturn? When times are tough it is really important to focus on teamwork, never give up and communicate, she said. John Gilbert was asked Based on your experience where are the opportunities for growth? He said, Most of the opportunity is in creating new goods and services. When there is slow growth in an industry, you have to create value by developing new products. It is very important for companies to keep up with R&D. There certainly are opportunities in a slower economy, people have more time to undertake DIY projects. Another highlight of the event was the presentation of the Samson Adler Distinguished Service Award to two industry veterans. The WCS selected two recipients for this honor. The 2012 recipient is John Buckinger and the 2013 recipient is Jarry Moore. Buckinger has had a long and successful career in the coatings industry. Prior to retirement, he converted Miller Paint to

a wholly employee-owned company by establishing an ESOP (Employee StockOwnership Program). The 2013 Samson-Adler Distinguished Service Award recipient, Jarry Moore, had a career in the coatings industry that included 25 years at Ribelin. He was also one of the founder of the Arizona Society for Coating Technology.

Exhibits/Student Posters
In addition to the technical presentations there were 130 exhibitors, offering their latest products and services for the paint and coatings industry. During the exhibition there were also a Student Poster session where students from the California Polytechnic University displayed their research. Plans are already in place to expand and improve on the Symposium for 2015. We are always looking into new features and ways to improve the Symposium, said Harlan. One such new feature we had this year was having four of the college students that submitted posters for our poster session speak about their posters during an open forum. We plan on expanding on this by having a University Student Research Track at the next Symposium where students speak about the poster submission. We are looking for an all day track if enough students submit, but it probably more likely will be a morning or afternoon track. CW

BASF Strengthens Pigments Competitiveness in its Performance Products


BASF continues to implement a series of measures within its Performance Products segment to strengthen its competitiveness. As part of its long-term pigment strategy, BASF will enhance customer focus and continue to design differentiated products in high-value applications, and optimize the global production network. Approximately 650 positions globally will be reduced by 2017. At the same time, BASF will invest 250 million in the next four years in its production network as well as in research and development. The measures we are undertaking will make us more responsive to market and customer needs. We also continue to significantly invest in innovation as the leading pigment supplier, said Markus Kramer, president of the Dispersions and Pigments division. BASF will optimize its global production network for pigments. The major measures include the closure of the Paisley plant in Scotland and the restructuring of the Huningue plant in France. In addition, BASF is examining strategic options for the site in Maastricht, the Netherlands. The planned investments in the production network will further strengthen the production footprint in Asia Pacific, the fastest-growing market. This also includes the start-up and expansion of a plant for high-performance pigments at BASFs wholly-owned production site in Nanjing , China, and the expansion of the BASF pigments plant in Ulsan, Korea. The future global production network will enable us to reliably and efficiently supply our partners from a competitive base, added Kramer. Further measures to improve the competitiveness of the Performance Products segment continue to be analyzed. the marketing and technical support of Acryl-EZE, aqueous acrylic enteric system. Acryl-EZE fully formulated coating systems are produced by Colorcon and contain EUDRAGIT L 100-55, an Evonik product, as the key functional ingredient.

Innovative Process Allows Flexible Use of Renewable Feedstocks in the Integrated Production
BASF, working in cooperation with TV SD (a third-party certification body), has developed an innovative mass balance approach for the use of renewable feedstocks in the integrated production. The process is available immediately for many products and can be adapted to customers requirements. Based on this approach, biomass is used as a feedstock in the manufacturing of basic products in existing plants. This biomass share is then allocated to sales products according to their recipes using the new certified methodology. The quality of the products remains unchanged. The products mass balanced in this manner save fossil raw materi als and reduce greenhouse gas emissions, thereby contributing to sustainable development. Up to 100 percent of the fossil raw materials can be replaced in the end product, which can be marketed accordingly. Existing plants and technologies along the value chain can continue to be used, and the customers product formulations do not have to be adjusted. Prior to marketing the mass balance approach, experts at BASF and TV SD discussed the opportunities it offers in detail with customers, associations and other stakeholders. The new method enables us to respond rapidly and flexibly to customers wishes, said Lars Brger, New Business Development in the Performance Materials division. When selecting the biomass, BASF places great value on safeguarding sustainability aspects. Thus, bio-naphtha and biogas, for

example derived from organic waste, are used for the mass balance approach. As with their petrochemical analogs, they are fed into plants at the beginning of the production process: bio-naphtha into the steam cracker and biogas into the syngas plant. The Dispersions and Pigments division has supplied a large adhesives customer with initial amounts of mass balanced products, dispersions for construction adhesives. During the cooperation with TV SD as independent certifier, the mass balance approach and its underlying certification methodology were thoroughly checked. The experts conducted audits in selected BASF plants in Ludwigshafen and became acquainted with the existing product formulations and process steps. They have meanwhile issued certificates for 14 products. These include superabsorbents for diapers, performance polymers for electronic goods and further intermediates. TV SD Industrie Service GmbH has many years of experience in the field of energy certification and sustainability certification of bioenergy. Its international recognition and outstanding reputation secure high acceptance of the certificates. From the end of October, the mass balance approach will also be available for use by third parties.

PolyOne To Expand Operations in India

BASF and Yara are evaluating a possible joint investment into a world scale ammonia plant at the U.S. Gulf Coast. BASF, which has a strong presence in the U.S., is currently a major user of ammonia for its U.S. downstream manufacturing activities and intends to further strengthen its backward integration. Yara, with its global ammonia network and market expertise, seeks to strengthen its presence in the U.S. Additional details of the possible joint venture including the exact location for the plant as well as the capacity of the plant are currently being discussed by the parties.

BASF Successfully Expands Antioxidants Production in Singapore


BASF has successfully completed the expansion of its antioxidant capacity in Singapore. Irganox 1010 is now produced at BASFs site along with other antioxidants on Jurong Island as part of BASFs global production network. The facility enjoys a strategic central location with excellent infrastructure. With global plastics production projected to grow above GDP level in Asia and the Middle East, BASF will ensure continuous and reliable supply of antioxidants for its customers in the polymer industry. In doing so, BASF further optimizes its production footprint in Asia Pacific. According to its Asia Pacific strategy, BASF plans to invest 10 billion in the Asia Pacific region by 2020 in order to ensure that around 75 percent of its products sold in the region will be locally produced. BASF has a global network of regional antioxidants production sites including Shanghai (China), Jurong (Singapore), Kaisten (Switzerland), McIntosh, AL (U.S.), and Lampertheim (Germany). In line with this new investment, the current production of Irganox 1010 at the Isohara plant, Japan will be consolidated in Singapore. Irganox1010 produced in the Singapore plant meets BASFs published global product specifications. Meaning each product complies with the same classification and has the same product stewardship approvals. Increasing Demand for K-FLEX Non-phthalate Plasticizers and Coalescents Drives Latest Expansion
Emerald Kalama Chemical, a business group of Emerald Performance Materials, will re-start a second benzoic acid reactor train at its facility in Rotterdam, Netherlands, adding 75,000 metric tons of new capacity for benzoic acid. The added capacity will support sales of the companys Kalama and PUROX brand of benzoic acid and benzoate preservatives, as well as the expanding internal consumption needs for downstream products which have been driving growth. Benzoic acid is a key starting material for production of K-FLEX non-phthalate plasticizers and coalescents manufactured at the site. The project is slated for completion in the second quarter of 2014. Benzoic acid is the core product at the heart of our operations and essential to everything we do, said Ed Gotch, president of Emerald Kalama Chemical. Our wave of recent expansion activities which include expanded operations at our facilities in the United States and Netherlands will continue to increase our global footprint and allow us to

meet growing demand for our products in markets such as pharmaceuticals, food and beverage, personal care and industrial uses, including adhesives, sealants, caulk, paint, coatings, graphic arts and vinyl applications. Gotch added, We have experienced significant growth in recent years. Our K-FLEX line has filled a growing market need for more environmentallyfriendly alternatives to phthalates and high-VOC products that also deliver enhanced performance and value. Our technical team has done an excellent job developing an expanded range of products and working closely with customers to translate these benefits to their ultimate end-product. The expansion will also support our customers increasing needs world-wide for our Kalama and PUROX benzoic acid and benzoates, preferred brands known for their high purity, quality and consistency. The company has been producing benzoic acid at its Rotterdam and U.S. operations for more than 50 years. The last expansion that took place at Kalama Chemicals Rotterdam facility was completed in April and included a new flaker production unit for its PUROX B pure grade benzoic acid line. The company also commissioned a new K-FLEX plasticizer operation at the Rotterdam site in September 2012 and has commissioned several expansions at its Kalama, Wash. (USA) facility, effectively doubling K-FLEX capacity since 2011. The addition of the second benzoic acid reactor will continue to support the momentum of these growing product lines. Emerald Kalama Chemical reports that it is a leader in the benzoate business, focused on benzoic acid, benzaldehyde, benzyl alcohol and sodium benzoate manufactured at the facilities in Rotterdam and Kalama. Benzoic acid provides a range of functions in industrial applications and is a key intermediate for synthesis of a wide range of chemicals, as well as a chain terminator in the production of alkyd resins and an additive to synthetic polyester fibers, HDPE filaments and thermoplastic elastomers. The Rotterdam operation is also certified to a number of important quality standards, including ISO-9001, ISO-14001, HACCP and FamiQS.

Elevances Gresik Success Advances Natchez Biorenery


Elevance Renewable Sciences, Inc., a highgrowth specialty chemicals company, announced that it has authorized the next significant stage of its second world-scale biorefinery in Natchez, Mississippi, in order to expand production of its Inherent renewable building blocks in 2016. The decision is based on the successful startup and operation of Elevances first world-scale joint venture biorefinery in Asia, as well as robust customer activity and demand forecasts for the companys specialty and intermediate chemicals. Our current customer forecasts for Inherent renewable building blocks call for demand to exceed Gresiks capacity, said Elevance CEO KLynne Johnson. With commercial production underway at Gresik, customer activity continues to increase in each of our market platforms. By building biorefineries in multiple geographies, we are able to meet customer demand for better-performing, cost-competitive renewable alternatives to petrochemicals across multiple industries. We will also be providing our customers the added security of two world-scale commercial plants with diversified feedstock supply chains. Elevance is the only specialty chemicals company that will have two worldscale biorefineries in operation by 2016. The Natchez project will be the second biorefinery based on Elevances proprietary metathesis technology. Elevance announced commercial shipments from the companys first biorefinery, a 180,000 MT

joint venture with Wilmar International Limited located in Gresik, Indonesia, earlier this year. The Natchez biorefinery will initially operate using canola or soybean oil; the Gresik biorefinery is now operating on palm oil. Both plants are capable of running on multiple renewable oil feedstocks, including jatropha or algal oils when they become commercially available. We have been very pleased with the operation of the Gresik facility, said vice president of Manufacturing John Harvey. Production at Gresik has hit all targets, including the ability to operate at design rates, and demonstrating the ability to shut down and restart without issues while delivering excellent product quality. Our operations in Natchez will complement our joint venture with Wilmar International in Asia and expand our global capabilities. Harvey said, We have invested approximately $30 million in the Natchez site, and made several significant improvements that were required for todays announcement. The high-value performance specialty chemicals, olefins and oleochemicals produced at the companys biorefineries will be used in personal care products, detergents and cleaners, lubricants and additives, engineered polymers, and other specialty chemicals markets. The biorefineries produce Inherent renewable building blocks, including renewable C10+ olefins and high-value, di-functional specialty chemicals with superior functional attributes, that were previously unavailable commercially until now. These molecules combine the functional attributes of an olefin, typical of petrochemicals, and a monofunctional ester or acid, typical of bio-based oleochemicals, into a single molecule. Inherent specialty chemicals enable detergents to be more concentrated and clean better in cold water; improved solvency for better hard surface cleaners; lubricant base oils with improved stability and fuel economy; and unique monomers for bio-based polymers and engineered plastics, including long chain polyamides, polyurethanes and polyesters.

Clariant Opens New Innovation Center in Frankfurt


Clariant recently opened its new 100 million Clariant Innovation Center (CIC) in Frankfurt, Germany. The companys new global hub for Research and Development is based at the Industriepark Hchst. It will be the home of Clariants competence centers in chemical research and process technology as well as application laboratories for several Business Units and state-of-the art analytical laboratories . The CIC will also house the departments for Intellectual Property Management and New Business Development. As the corporations global hub, the CIC will ensure the coordination of Clariants world-wide R&D network, which includes centers across Europe, North America, Brazil, Japan, India and China. Located at Clariants largest manufacturing site, the CIC will benefit from the excellent infrastructure as well as industrial and academic links offered by the Rhein-Main region. The new facility covers a total surface area of 36,000 square meters and will house approximately 500 employees from R&D and supporting business and administrative functions. Momentive Collaborates with Kanoria to Construct Phenolic Specialty Resins Plant in India
Momentive Specialty Chemicals Inc. recently signed a non-binding Memorandum of Understanding (MOU) with Kanoria Chemicals and Industries Limited to form a joint venture that would construct a new phenolic specialty resins plant in India at Kanorias existing production facility at Visakhapatnam, Andhra Pradesh. In addition, under the agreement, for a cash consideration, Kanoria would transfer its currently existing manufacturing facility in Visakhapatnam to the proposed JV, while Momentive Specialty Chemicals would provide technology supporting its specialty phenolic resins, formaldehyde and hexamine businesses, as well as its current business in India, to the JV. It is envisioned that both parties would have equal ownership of the JV. Under the MOU, the companies will work to identify and evaluate additional growth opportunities for specialty chemicals in such vertical markets as automotive, industrial and construction. The non-binding MOU is just a first step in the process of setting up the contemplated JV, outlining the main principles around which the JV should be structured, although both parties are

Allnexs Polyester Resin Production Facilty in Malaysia Receives State Environmental Award
Allnexs production facility in Seremban, Malaysia, has been recognized for its environmental performance with the State Chief Minister Yearly Environmental Award 2012. The goal of the State Chief Minister Yearly Environmental Award is to create awareness for environmental stewardship and to call upon the public, manufacturers, business operators and local farming to the preservation and conservation of the environment in the State of Negeri Sembilan. It is awarded based on the level of compliance with environmental regulations pertaining to the management of industrial effluents, sewage, water and air emissions, and waste generation. A total of 57 companies in the state of Negeri Sembilan participated in the competition, and Allnex was nominated as Champion based on its environmental performance. Located in Seremban, the capital of Negeri Sembilan, and approximately 85 kilometers south of the Malaysian capital Kuala Lumpur, the Allnex facility manufactures polyester resins for the production of powder coatings that are used to protect and beautify metal products in both indoor and outdoor applications. These resins are supplied to powder coating producers in Southeast Asia, Australia, New Zealand, Taiwan, Japan, India and Pakistan, the Middle East and South Africa. The Allnex Seremban plant has several international quality, safety and environmental certifications (ISO9001:2000, ISO14001:1996, OHSAS 18001:1999) and has been recognized in the past with company awards for environmental and safety performance, as well as Malaysias premier environmental award the Prime Minister Hibiscus Award (Notable Achievement) in 2008/2009.

Teflon industrial coating 857G line is now an option for application to meet SP11C standards. DuPont SP11C specification is the corporate engineering standard for fluoropolymer-coated fasteners that require excellent corrosion resistance. DuPont SP11C is a specification for fasteners that are intended for use in severe atmospheric corrosive environments. It is not recommended for use in immersion service. The coating system is comprised of two coats: a sacrificial base coat of electroplated zinc or ceramic/metallic coating, and a fluoropolymer top coat applied by an applicator qualified by DuPont. Since fluoropolymer coatings have a low coefficient of friction, the make-up torque values for fasteners coated according to SP11C will be reduced. The DuPont Teflon industrial coating 857G product line is a new technology targeting applications requiring antigalling and dry lubrication. It is a water-based, low VOC, easy-to-use coating offering outstanding corrosion resistance that can be applied at .0005 to .0045 inches thick by conventional spray or dip spinning. The performance test ASTM B117 showed less than 10% rust on fasteners coated with 857G-018, the blue version of these coatings, after 3,000 salt spray hours. VOC emissions were less than 3.0 pounds per gallon. There are several coating color options. Getting the DuPont 857G coating line included on SP11C took years of development and testing. Recycled Glass Powder Plant Completed in Jackson, TN


Vitro Minerals has announced the completion and start-up of a 40 million pound per year recycled glass powder plant in Jackson, Tennessee. The glass powders are designed to provide a 100 percent recycled, crystalline silica free alternative to traditional mined mineral fillers and extenders such as calcium carbonate, clay, silica, and nepheline syenite. Glass has a fairly low recycling rate due to collection and processing difficulties. Vitro Minerals has developed a variety of post-consumer and post-industrial glass sources and unique processing schemes to make glass powders with excellent particle size control and brightness standards equal to traditional mineral fillers. The resultant glass powders act as cost effective functional fillers in coatings, plastics, adhesives, sealants and concrete. The powders are available in different glass chemistries in particle sizes from 0.5 microns to 500 microns. Glass powders, in addition to being free of crystalline silica, offer a lighter weight, corrosion/abrasion resistant filler for polymer systems that have the added advantage of being recycled content, said Joseph Keating, president of Vitro Minerals.

BP Reveals Three-step Process to Produce Acetic Acid for Paints


BP has developed two new technologies for the production of key petrochemical feedstocks. SaaBre is a new route for the production of acetic acid from syngas and Hummingbird directly converts ethanol to ethylene through dehydration. SaaBres breakthrough is a process for the conversion of synthesis gas (carbon monoxide and hydrogen derived from hydrocarbons such as natural gas) directly to acetic acid in a proprietary, integrated three-step process that avoids the need to purify carbon monoxide (CO) or purchase methanol, according to the company. SaaBre is expected to deliver a significant reduction in variable manufacturing costs, and lead to capital efficiencies, compared to the carbonylation of methanol route which has been the leading technology for several decades, according to the company. Acetic acid is a versatile intermediate chemical, used in a variety of products, such as paints, adhesives and solvents, as well as in the production of PTA, used extensively in polyester manufacture. Hummingbird is a newly developed proprietary process by which ethanol is dehydrated to produce ethylene, a fundamental building block for the plastics and other petrochemical industries. The new technology is lower cost and simpler compared to existing ethanol to ethylene technologies. SaaBre and Hummingbird were developed at BPs labs at the Hull Research and Technology Centre (HRTC), alongside its acetic acid manufacturing site, Europes largest, at Saltend, Hull in the UK. BP is actively exploring options for commercializing both technologies. SaaBre is planned for deployment in future acetic acid investments while Hummingbird is a licensing play for BP.

Ross SLIM Powder Injection Mixers with New Hopper Design


Ross has announced new developments to its line of High Shear Mixers with Solids/Liquid Injection Manifold (SLIM) Technology. Designed for high-speed and high-volume mixing requirements, the SLIM is a unique rotor/stator device capable of injecting powders directly into a fast-moving liquid stream without the need for an eductor or pump. One of the key innovations now being offered is a special hopper that promotes improved flow of various solids for more efficient induction to the mix chamber, according to the company. The hopper features multiple ports to accommodate air pulse devices that would prevent bridging of challenging powders. Another new option is the pneumatically-actuated ball valve for precise modulation of the powder injection rate. The 30HP SLIM Mixers are each equipped with a ported four-blade rotor designed to run up to 1,800 rpm and a stator head with large square holes for maximum pumping capacity. These inline mixers are lubricated by a double mechanical seal system which includes a pressure vessel with sight glass, internal cooling coil and piping. Tri-clamp connections on the liquid inlet, powder inlet and mixture outlet allow for easy disassembly and cleaning. Standard wetted parts are stainless steel 316; for special and heavy-duty applications, the rotor/stator can be boronized for improved wear performance. Installed on a portable cart, the inline SLIM Mixer can serve virtually any size vessel located anywhere in the plant. waterborne polyurethane (PU) coating systems. In polyurethane coatings, XPB 255 displays very high jetness and strong bluish undertones, which can be further maximized by using dispersion additives and optimizing the total quantity of XPB 255 in the mill base and final lacquer. In alkyd/melamine stoving enamels, high colorimetric values also can be achieved with dispersion additives. The special particle design of XPB 255, combined with good dispersion, results in the high jetness and deep blue undertone. An after-treatment on the carbon black pigment offers a functional surface, which imparts exceptional wetting and dispersing properties. The versatility of XPB 255 in waterand solventborne PU coating systems offers a major advantage to formulators, who can use the universal carbon black pigment in a broad range of coating systems, according to the company. For the development of high jet coatings with deep blue undertone, Orion recommends testing the experimental black XPB 255 along with the well-established Colour Black FW 171 and Colour Black FW 200.

Even though we had never built a telescoping head before, our engineering team welcomed the challenge. The SL-30 batch production Attritor will be used in an R&D application to grind materials in liquid nitrogen. As such, the mill includes a vented cover for cryogenic grinding with liquid nitrogen and a phase separator. A liquid nitrogen controller is used to maintain liquid nitrogen levels during the milling process. The product discharge is equipped with a cryogenic ball valve. The mill features a 304SS grinding tank that is jacketed for cooling. The agitator shaft is constructed of stainless steel. Specially configured arms are 440C stainless steel. Solvay Novecare has made three key appointments to its Asia Pacific Coatings Market Team. Leading the team is Asia Pacific regional market director Marc Teo, who is responsible for delivering financial targets and sustainably growing the business in line with growth objectives. Teo brings with him more than 20 years of experience in the chemical and process technologies industries. He has held various sales and marketing roles with Allied Colloids and Ciba Specialty Chemicals in Asia Pacific. Most recently, Teo was ASEAN general manager for GE Betz. Also joining the team is Asia Pacific Coatings business development manager Koh Hwee Koon, who is responsible for identifying and exploring new market opportunities, managing key accounts and marketing activities, driving product commercialization and supporting new project development for coatings in the Asia Pacific region. Koh brings with her more than 18 years of experience in technical and sales roles in the coatings industry and has worked in companies such as Rohm and Haas, Ciba Specialty Chemicals and most recently for BASF as industry manager for Coatings and Construction, ASEAN. Evy Krisnawaty has been named key account manager for Southeast Asia. PPG Industries has appointed Diane M. Kappas vice president, Americas, for the protective and marine coatings (PMC) business. The company also announced that Jane Valenta has been appointed to Kappas previous role of vice president, environment, health and Kappas safety (EHS). Kappas will assume full responsibility for PPGs PMC business in the U.S., Canada and Latin America, and she will report to Tim Knavish, global vice president, PMC. Valenta Kappas joined PPG in 1986 as an engineer trainee in the industrial coatings business, and she has advanced through positions in corporate diversity as well as facility, supply chain and product management. Reporting to executive vice president Michael H. McGarry, Valenta will assume responsibility for all EHS functions including environmental affairs, product stewardship, health, safety, compliance assurance and corporate medical, and she will contribute to PPGs corporate sustainability efforts. She is currently associate director of performance coatings for research and development, supporting the aerospace, architectural coatings, automotive refinish and PMC businesses. Valenta joined PPG in 1986 as a chemist trainee with the automotive OEM coatings business at the Allison Park, Pennsylvania Coatings Innovation Center, and she has held positions of increasing responsibility in product development. Valenta holds 10 patents.

Ford EcoTrek Vehicle Painted with Axalta Coating Systems Custom Waterborne Paint Wins at SEMA

Axalta Coating Systems custom waterborne, Beyond Bronze paint on a Ford F-350 truck that was customized with recycled and eco-sensitive materials by the EcoTrek Foundation received favorable attention. It caught the eyes of attendees and judges at the Specialty Equipment Market Association (SEMA) tradeshow in Las Vegas, NV. EcoTrek won Fords Outstanding Achievement in Design Award for its stylish customization and eco-friendliness. EcoTreks winning truck, known as an eco-expedition vehicle, is the brainchild of EcoTrek Foundation executive director, Tom Holm, and is a collaborative effort, with Ford sponsoring the vehicle, the U.S. Navy developing algae-based bio diesel fuel that powers the truck and Axalta donating the paint that was applied by students studying collision repair and vehicle refinishing at Los Angeles Trade-Technical College (LA Trade-Tech). Through Axalta, weve been able to take our vehicle to LA Trade-Tech for students to paint the truck with this amazing water-based color, utilizing Axaltas expertise. EcoTrek is a non-profit organization that conducts research and educational programs to advance the use of renewable fuels and materials. The SEMA tradeshow is the premier automotive specialty products trade event. It provides attendees with educational seminars, product demonstrations, special events and networking opportunities. CW
