LICENSE AGREEMENT FOR DYNOJET RESEARCH Inc.

SOFTWARE - DYNOJET POWER COMMANDER 3 IMPORTANT-READ CAREFULLY: This License Agreement herein after referred to as ("L A") is a legal agreement between you (either an individual or a single entity) a nd Dynojet Research Inc. for the software product(s) identified as ("DYNOJET POW ER COMMANDER 3"). The DYNOJET POWER COMMANDER 3 includes computer software and any "online" or electronic documentation. This license does not entitle you to r eceive from Dynojet Research Inc. hard-copy documentation, technical support, te lephone assistance, or enhancements or updates to the Product. The controlling l anguage of this Agreement is English. If you have received a translation into a nother language, it has been provided for your convenience only. By copying, in stalling or otherwise using the DYNOJET POWER COMMANDER 3, you agree to be bound by the terms of this LA. If you do not agree to the terms of this LA, Dynojet Research Inc. is unwilling to license the DYNOJET POWER COMMANDER 3 to you. In such event, you may not use or copy the DYNOJET POWER COMMANDER 3, and you shoul d promptly destroy all copies. DYNOJET POWER COMMANDER 3 LICENSE The DYNOJET POWER COMMANDER 3 is licensed, not Transferred. Copyright laws and international copyright treaties, as well as other intellectual property laws a nd treaties protect the DYNOJET POWER COMMANDER 3 . 1. GRANT OF LICENSE. This LA grants you a non-exclusive, non-transferable, license to use the DYNOJET POWER COMMANDER 3 and related materials without charge provided that y ou adhere to all of the terms and conditions of this Agreement. 2. DESCRIPTION OF RIGHTS AND LIMITATIONS. Limitations on Reverse Engineering, Decompilation and Disassembly. You may not reverse engineer, decompile, or disassemble the DYNOJET POWER COMMANDER 3 , except and only to the extent that such activity is expressly permitted by a pplicable law notwithstanding this limitation. Rental. You may not rent or lease the DYNOJET POWER COMMANDER 3. Termination. Without prejudice to any other rights, Dynojet Research In c. may terminate this LA if you fail to comply with the terms and conditions of this LA. In such event, you must destroy all copies of the DYNOJET POWER COMMAN DER 3 and all of its component parts. You may freely copy and distribute copies of the self-extracting executa ble code version of the DYNOJET POWER COMMANDER 3, provided any copy must contai n all of the original proprietary notices. MISCELLANEOUS If you acquired this product in the United States, the laws of the State of Mont ana govern this LA. If you acquired this product in Canada, the laws of the Prov ince of Ontario, Canada, govern this LA. Each of the parties hereto irrevocably attorns to the jurisdiction of the courts of the Province of Ontario, Canada and further agrees to commence any litigation which may arise hereunder in the cour ts located in the Judicial District of York, Province of Ontario. If this product was acquired outside the United States, then local laws may appl y. NO WARRANTIES To the maximum extent permitted by the applicable law, Dynojet Research Inc. and its suppliers disclaims and makes no representations or warranties about the su itability of the DYNOJET POWER COMMANDER 3 , either expressed or implied, includ ing, but not limited to, implied warranties of merchantability and fitness for a particular purpose, with regard to the DYNOJET POWER COMMANDER 3. This limited warranty gives you no specific legal rights. You may have others, which vary fro m jurisdiction to jurisdiction.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES To the maximum extent permitted by the applicable law, in no event shall Dynojet Research Inc. or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the D YNOJET POWER COMMANDER 3 , even if Dynojet Research Inc. has been advised of the possibility of such damages. Because some states and jurisdiction do not allow the exclusion or limitation of liability for consequential or incidental damages , the above limitation may not apply to you.
