INTER-COUNTRY ADOPTION LAW AND POLICY IN INDIA


International adoption is a type of adoption in which an individual or couple becomes the legal and permanent parents of a child who is a national of a different country. In general, prospective adoptive parents must meet the legal adoption requirements of their country of residence and those of the country whose nationality the child holds. The progress of inter-country adoption as a global phenomenon along with the international standards as they evolved in west through international instruments. The position of inter-country adoption in India is considered through the national statutes, case laws and the establishment of Central Adoption Resource Authority (CARA) after Indias rectification of 1993 Hague convention or inter country adoption. In India the guidelines were issued by the Government of India in 2006 within the framework of norms and principles laid by the Supreme Court in a series of cases.
