An employee in ADAM CREATIONS Ltd in a particularly in a busy shift was trapped in the machine.

He tested positive for drug and was dismissed. He immediately filed a grievance, claiming that he had used drugs two days before. Regarding the outcome of drug and alchahol testing the company code of conduct saysEmployees found to be incapacitated shall be similarly dismissed. Question What strategy would you follow if you were preparing the employees grievance..? What points do you take up to the arbitrator for solving the issue?

The facts are 1. The employee was alchaholic two days earlier. 2. Employees fount to be incapacitated shall be dismissed While preparing the employees grievance, it can be stated that at the time of the happening of the accident, he was not under the influence of any drug and substantial evidence should be given to support his point of view. In order to solve the issue the attributer should further investigate into the matter by asking for some tests that can prove that the employee had taken the drugs two months prior to the accident .the company should reinstate the employee with adequate warning to be careful in the future
