This bill proposes the Freedom of Marriage Act to legalize same-sex marriage throughout the United States. SECTION 1: All couples will be extended the right of a federal civil union (Referred to as marriage for the functions of this act) while residing in the United States of America. Marriage shall not be denied a couple based on gender, sexual orientation, religion, or any other defining factor used to categorize an individual.
SECTION 2: This law shall apply to all people who have been residing in the United States legally for at least three months, regardless of which state they reside in. Any illegal alien residing in this country is exempt from federal benefits and is therefore not compliment with this bill.
SECTION 3: Being that such marriages fall under terms already established as illegal and immoral in society of the majority of beliefs, religious or not, the freedom of marriage does not apply to Sub-SECTION A: Any polygamous marriage Sub-SECTION B: Any marriage binding a non-human individual Sub-SECTION C: Any marriage featuring a person restricted by Section 2 of this bill.
SECTION 4: Regarding the supremacy clause of the United States Constitution: any state law created that bans any form of marriage as listed in Section 1 of this bill is herewith disbanding and declared unconstitutional. Any of these laws is considered void after this bill is put into effect.
SECTION 5: This bill shall be enacted exactly 90 days after being signed, as standard with non-emergency legislature.
