Declaration for Title Deeds
Destroyed by Fire
I, ... residing at ... do solemnly and conscientiously state as follows
1. I am the owner of the immovable property at ... and which is more
particularly described in the Schedule hereunder written.
2. I have agreed to mortgage the said property to Mr. A in consideration
of the loan of Rs... agreed to be advanced by him to me.
3. The said intending mortgagee called upon me to produce the title
deeds for his inspection to investigate my title to the said property.
4. I am not able to produce the title deeds as they have been destroyed
by fire which broke in my house on the ... day of ... I could not salvage
any of the documents of title from the fire.
5. I say that I have not deposited the said title deeds with anybody as
equitable security or for any other purpose. The said title deeds were kept
in a wooden cupboard in my house when the fire broke out as aforesaid.
6. I declare that what is stated above is true to my knowledge and is
stated knowing full well that relying upon the said statement and rep-
resentations made by me the said mortgagee has agreed to advance the
said loan to me and to accept security of mortgage of my said property
described in the Schedule hereunder written.
