Defendant has two Class C felony charges and two serious misdemeanor charges. The maximum
penalties for the class C felonies are up to 10 years in prison on each and fines of not less than
$1,000 nor greater than $10,000 plus 35% surcharge and costs on each. The serious misdemeanor
charges carry maximum penalties of up to one year in prison and fines of not less than $315 nor
greater than $1,875 plus 35% surcharge and court cost each. The preliminary hearing date will be
continued to July 14, 2014 if defendant is released on bond.

The Defendant herein appears before the undersigned Magistrate in and for Sac County, having
been charged with the crime(s) indicated above.

The Court advises the Defendant as follows:

1. That he/she has the right to remain silent. That any statement made by the Defendant can
and would be used against him/her in a Court of Law. That he/she has the right to have an attorney
present at all stages of the proceeding and , if the Defendant is unable to afford counsel, that, upon
proper application, one would be appointed for them.

2. That he/she is charged with a violation(s) as stated above and classified as:

5. (a) You will be released from custody prior to trial on your own promise to appear at all
further court proceedings. If you willfully fail to appear before any court as required, you shall be guilty
of a Class D felony/serous misdemeanor; or
(b) (If appropriate) Upon consideration of the factors in Section 811.2, the Court is not
reasonably assured that you will appear at all court proceedings in the future and therefore the Court
imposes the following conditions on your release:
You must post a cash or surety bond in the amount of $10,000. Defendant shall take all prescribed
medications. If he refuses then law enforcement has authority to transport for involuntary involuntary
administration of the medications.


6. Defendant is entitled to preliminary hearing unless waived, which hearing is held to determine
whether sufficient evidence exists to justify further prosecution of the Defendant as charged. Prior
to a preliminary hearing, the Defendant is informed that a Grand Jury may indict him/her, or a Trial
Information may be filed by the County Attorney of this county.

7. The Defendant is informed of his/her rights to a preliminary hearing and preliminary hearing

crime of WILLFUL INJURY RESULTING IN SERIOUS INJURY, a Class C Felony in violation of
Iowa Code Section 708.4(1) committed as follows: The said Defendant, Zachary Michael Rix, on
or about June 14, 2014 in the County of Sac and State of Iowa, did unlawfully and willfully
commit an act, which was not justified, against Craig Arends, with the intent to cause serious
injury and did cause serious injury to Craig Arends.

COMES NOW Benjamin John Smith, as Prosecuting Attorney of Sac County, Iowa, and in the
name and by the authority of the State of Iowa, accuses Defendant, Zachary Michael Rix of the
crime of TRESPASS, a Serious Misdemeanor in violation of Iowa Code Sections 716.7 and
716.8(2) committed as follows: The said Defendant, Zachary Michael Rix, on or about June 14,
2014 in the County of Sac and State of Iowa, did unlawfully and willfully commit criminal
trespass upon the property of Craig Arends, (thus injuring Craig Arends) (causing more than
$200 in damage) by entering upon or in property by one or more of the following means:
without the express permission of the owner, lessee, or person in lawful possession with the
intent to commit a public offense, to use, remove therefrom, alter, damage, harass or place

unlawfully and willfully intentionally damage, deface, alter or destroy tangible property, to-wit:
Tangible property belonging to Craig Arends; the cost of replacing, restoring and/or repairing of
which exceeds $200 but not $500.

crime of ATTEMPT TO COMMIT MURDER, a Class B Felony in violation of Iowa Code
Section 707.11(1) committed as follows: On or about June 14, 2014, in Sac County, Iowa, the
Defendant, with the intent to cause the death of Craig Arends, under circumstances which
would not justify Defendants actions, the Defendant did an act by which he expected to set in
motion a force of chain events which will cause or result in the death of the other Craig Arends.

COMES NOW Benjamin John Smith, as Prosecuting Attorney of Sac County Iowa and in the
name and by the authority of the State of Iowa, accuses Defendant, Zachary Michael Rix of the
crime of GOING ARMED WITH A CONCEALED WEAPON, an Aggravated Misdemeanor in
violation of Iowa Code section 724.4 committed as follows: On or about June 14, 2014, in Sac
County, Iowa, the Defendant went armed with a knife concealed about his person, and
Defendant used the knife in the commission of a crime and / or the knife had a blade exceeding
eight inches in length.
