Statement from San Jose City Councilmembers Madison Nguyen, Sam Liccardo
and Ash Kalra Regarding Video Release on Phuong Ho’s arrest

We are greatly disturbed by the video released by the San Jose Mercury News on the arrest of
Phuong Ho, a Vietnamese exchange student at San Jose State University. The video shows San
Jose Police officers repeatedly beating Ho with a baton and then a taser to subdue him. The behavior
of the San Jose Police officers at the scene needs to be investigated thoroughly to ensure
accountability for their actions.

We are calling on the San Jose Police Department to conduct a thorough investigation into this matter
as well as the Santa Clara County District Attorney’s Office to conduct a thorough and complete
investigation on this incident in a fair and objective manner. We also ask that if the District Attorney
chooses to conduct a grand jury proceeding, that it be open to the public.

Our priority is to ensure safety in the community and we are saddened the Vietnamese American
community has recently experienced two incidents with the San Jose Police Department regarding
possible use of excessive force.

We stand together with the Vietnamese American community as we seek to find answers and closure
to these incidents.
