EXTENSION OF JURISDICTION OF THE YUGOSLAV COURT IN CIVIL
CASES WITH A FOREIGN ELEMENT
Yugoslav court may extend jurisdicstion that it has over a party or a cause of
action in case there are multiple defendants or multiple causes of action, to parties
and causes of action for which it otherwise does not have jurisdiction, provided that
such power has been explicitly given to it by the Law on conflict of laws with laws
and regulations of other countries. The extension of jurisdiction is explicitly
provided in case of multiple defendants in a cause of action which is based on a
same legal ground and factual situation, provided that one of the co-defendants is
domiciled in Yugoslavia (Article 46 paragraph 4 of the said Law) and in case of
property disputes arising out of a matrimonial relationship, provided that the
predominant part of the property is situated in Yugoslavia (Article 49 paragraph 2
of the said Law). Another basis for extension of international jurisdiction of the
Yugoslav court is provided by analogous application of the norms of local
jurisdiction found in the Code of Civil Procedure and in other federal Laws,
pursuant to Article 27 of the Code of Civil Procedure.
