DEFENDANT HAMPTONS MEMORANDUM IN RESPONSE TO PLAINTIFFS MOTION TO MODIFY STAY ORDER
Defendant Tonia Hampton, Register of Deeds for McDowell County, files this memorandum in response to the Plaintiffs Motion to Modify Stay Order (Document #93). At the time the Court originally stayed this action, the Court explained its determination to grant the stay, in part, as follows: The Court finds that it would be a waste of judicial resources, as well as the resources of the State and the Plaintiffs, to move forward in this case prior to a decision in Bostic. Put simply, the outcome in Bostic will in all likelihood shape the outcome of this litigation.
