Dear Ms. Mertz:

Thank you for your response, but I think you have missed the point of our request.

The conduct of the investigations you refer to are highly irregular and troubling, and respectfully, since
you were directly involved in many of these decisions, you and top staff in the Attorney Generals Office
are not independent.

The following issues need to be addressed by an independent investigator:

1. Why it was that Mr. DeWine requested to meet with the investigator when it was a friend of his who
was the alleged harasser? This was a conflict of interest.

2. Why did Mr. DeWine ignore the professional EEO investigators opinion and demand the name of the
confidential informant?

3. What had the confidential informant said to the EEO investigator prior to the meeting with Mr.
DeWine?

4. What actions did Mr. DeWine take once he had the meeting with the informant?
