secti on 13 of the Consti tuti on that an Act to whi ch that

ENACTED by the Parl i ament of Tri ni dad and Tobago as
fol l ows:

PRELI MI NARY
1. Thi s Act may be ci ted as The Occupati onal Safety
and Heal th Act, 2004.
2. Thi s Act shal l come i nto operati on on such date as
the Presi dent may appoi nt by Procl amati on.
3. Thi s Act shal l have effect even though i ncon-
si stent wi th secti ons 4 and 5 of the Consti tuti on.
4. (1) I n thi s Act, except where otherwi se expressl y

empl oyee means any person who has entered
i nto or wor ks under a contr act wi th an
empl oy er to do any sk i l l ed, unsk i l l ed,
manual , cl eri cal or other work for hi re or
reward, whether the contract i s expressed

repai ri ng, warehousi ng, ornament-
i n g, fu r n i s h i n g, di s tr i bu ti n g,
cl eani ng, washi ng, breaki ng up or
adapti ng for sal e, of any arti cl e or
pr odu ct, or th e fi l l i n g of
contai ners;
(b) th e s l au gh ter i n g of an i mal s or
poul try;
(c) the pr oducti on of ci nematogr aph

materi al ;
(d) the stori ng of gas;
(e) the tr ansfor mi ng or conver ti ng of

(g) the testi ng or anal ysi ng of any
substance,
and pr emi ses shal l not be excl uded fr om
thi s defi ni ti on by reason onl y that they are
open ai r premi ses;

the proper and safe use, storage, transport
and handl i ng of a danger ous substance
and i ncl udes i nfor mati on r el ati ng to the
toxi col ogi cal pr oper ti es of the substance
and i ts chemi cal structure and formul a;
I ndustri al Court means the court establ i shed
under the I ndustri al Rel ati ons Act;
i ndustr i al establ i shment means a factor y,
s h op, offi ce, pl ace of wor k or oth er
premi ses but does not i ncl ude
(a) pr emi ses occupi ed for r esi denti al
purposes onl y; or
(b) other categor i es of establ i shment
ex empted by th e Mi n i s ter i n
accordance wi th thi s Act;
i nspector means a person desi gnated as such
under secti on 71(1)(a);
machi nery means a part or an assembl age of
par ts, fi xed or movabl e, by whi ch moti on
or force i s transmi tted;
mai ntai ned means kept i n an effi ci ent state,
i n effi ci ent wor k i ng or der, and i n good
repai r;
medi cal i nspector means a person desi gnated
or appoi nted i n accor dance wi th secti on
71(1)(b);

medi cal pr acti ti on er mean s a per s on
regi stered under the Medi cal Board Act;
Mi n i s ter mean s th e Mi n i s ter to wh om
r esponsi bi l i ty for the admi ni str ati on of
occupati onal safety and heal th i s assi gned;
muni ci pal cor por ati on means a muni ci pal
cor por ati on con ti n u ed or es tabl i s h ed
under secti ons 3 and 4 of the Muni ci pal
Corporati ons Act, 1990;
occupati onal di sease means a di sease l i sted
i n Schedul e 1;
occu pi er mean s th e per s on wh o h as th e
ul ti mate contr ol over the affai r s of an
i ndustri al establ i shment;
owner means the per son for the ti me bei ng
recei vi ng the rack-rent of the premi ses i n
connecti on wi th whi ch the wor d i s used,
whether on hi s own account or as agent or
trustee for any other person, or who woul d
so r ecei ve the r ack-r ent i f the pr emi ses
were l et at a rack-rent;
parent i ncl udes a guardi an or person havi ng
the l egal custody of, or the control over, a
chi l d or young person;
per i od of empl oyment means the wor ki ng
hours of an empl oyee, i ncl usi ve of the ti me
al l owed for meal s and rest;
pl ant i ncl udes equi pment or appl i ance;
pr emi s es i n cl u des an y pl ace, an d, i n
parti cul ar
(a) an y v eh i cl e, v es s el , ai r cr aft or
hovercraft;
(b) any subter r anean i nstal l ati on or
i nstal l ati on on l and, i ncl udi ng the

and such other conveni ences necessary for
the personal hygi ene of an empl oyee;
sel f-empl oyed per son means an i ndi vi dual
who wor ks for gai n or r ewar d other wi se
than under a contr act of empl oyment,
whether or not he hi msel f empl oys others;
shi p i ncl udes any descri pti on of vessel used
i n aquati c navi gati on but not propel l ed by
oars;

shop means a bui l di ng, booth, stal l or pl ace
wher e goods ar e handl ed or exposed for
sal e, or where servi ces are offered for sal e,
and i ncl udes a hotel , restaurant, pub, and
recreati onal faci l i ty;
toxi c substance means any di si nfectant, and
an y oth er s u bs tan ce k n own to be
poi sonous, corrosi ve, i rri tati ng, sensi ti zi ng
or harmful to man or ani mal that i s used
i n agr i cu l tu r e, th e ar ts , commer ce or
i ndustr y, or for any domesti c or other
purpose but does not i ncl ude an anti septi c,
drug or preservati ve;
woman mean s a femal e per s on wh o h as
attai ned the age of ei ghteen years;
work of engi neeri ng constructi on means the
con s tr u cti on , s tr u ctu r al al ter ati on or
r epai r (i n cl u di n g r e-poi n ti n g an d r e-
pai nti ng) or the demol i ti on of any dock,
harbour, i nl and navi gati on, tunnel , bri dge,
vi aduct, water wor ks, r eser voi r, pi pe-l i ne,
aqu edu ct, s ewer , s ewer age wor k s ,
gashol der, oi l tank or r oad and i ncl udes
an y oth er wor k s pr es cr i bed by th e
Mi ni ster;
wor k r oom mean s a r oom i n wh i ch an
empl oyee i s requi red to work;
young person means a chi l d over the age of
fou r teen y ear s an d u n der th e age of
ei ghteen years.
(2) A r ai l way l i n e or s i di n g wh i ch i s u s ed i n
connecti on wi th and for the purpose of a factory shal l
be deemed to be part of the factory, but i f such l i ne or
si di ng i s used i n connecti on wi th more than one factory
bel ongi ng to di fferent occupi ers, the l i ne or si di ng shal l
be deemed to be a separate factory.

(3) A workpl ace i n whi ch, wi th the permi ssi on of
or under agreement wi th the owner or occupi er, two or
mor e per sons car r y on wor k, whi ch woul d consti tute
the workpl ace a factory, i f the persons worki ng therei n
were i n the empl oyment of the owner or occupi er, shal l
be deemed to be a factory for the purposes of thi s Act,
and the pr ovi si ons of thi s Act shal l appl y as i f the
owner or occupi er of the workpl ace were the occupi er of
the factor y and the per sons wor k i ng ther ei n wer e
persons empl oyed i n the factory.
(4) Pr emi s es s h al l n ot be ex cl u ded fr om th e
defi ni ti on of an i ndustri al establ i shment by reason onl y
that they are open-ai r premi ses.
(5) Wher e the Mi ni ster by Or der so di r ects, as
respects al l or any of the purposes of thi s Act, two or
more i ndustri al establ i shments shal l be deemed to be a
si ngl e i ndustri al establ i shment.
(6) Where the Mi ni ster on the advi ce of the Chi ef
I nspector on the basi s of prescri bed cri teri a so di rects,
as r espects al l or any of the pur poses of thi s Act,
di fferent branches or departments of work carri ed on i n
the same i ndustri al establ i shment shal l be deemed to
be separate i ndustri al establ i shments.
(7) Premi ses bel ongi ng to or i n the occupati on of
the State shal l not be excl uded from the defi ni ti on of an
i ndustri al establ i shment.
(8) For the pur poses of thi s Act, machi ner y or
pl ant shal l be deemed to have been constr ucted or
reconstructed before the commencement of thi s Act and
an i n du s tr i al es tabl i s h men t or bu i l di n g s h al l be
deemed to h av e been con s tr u cted, r econ s tr u cted,
extended, added to or converted for use as an i ndustri al
establ i shment, before the commencement of thi s Act or

the comi ng i nto oper ati on of any of the pr ovi si ons of
thi s Act, i f the constructi on, reconstructi on, extensi on,
addi ti on, or conversi on was begun before the passi ng of
thi s Act or the comi ng i nto oper ati on of any of the
provi si ons of thi s Act, as the case may be.
(9) A per s on wh o wor k s i n an i n du s tr i al
establ i shment, whether empl oyed by the occupi er or
not, ei ther i n a pr ocess or i n cl eani ng a par t of the
i ndustr i al establ i shment used for a pr ocess, or i n
cl eani ng or oi l i ng the machi ner y or pl ant, or i n any
oth er k i n d of wor k wh ats oev er i n ci den tal to or
connected wi th the pr ocess, or connected wi th the
ar ti cl e made or other wi se the subject of the pr ocess
ther ei n, shal l except as i s other wi se pr ovi ded by thi s
Act, be deemed to be empl oyed therei n for the purposes
of thi s Act.
(10) A young per son who wor ks i n an i ndustr i al
establ i shment, whether for r emuner ati on or not, i n
col l ecti n g, car r y i n g or del i v er i n g goods , car r y i n g
messages or r unni ng er r ands, shal l be deemed to be
empl oy ed i n th e i n du s tr i al es tabl i s h men t for th e
purposes of thi s Act.
(11) Except wher e other wi se expr essl y pr ovi ded,
the provi si ons of thi s Act shal l be i n addi ti on to and not
i n substi tuti on for or i n di mi nuti on of the provi si ons of
any other wri tten l aw.
5. (1) Ex cept as i n th i s Act oth er wi s e ex pr es s l y
pr ov i ded, th i s Act s h al l appl y on l y to i n du s tr i al
establ i shments.
(2) Thi s Act shal l appl y to i ndustr i al establ i sh-
ments bel ongi ng to or occupi ed by the State but i n case
of any publ i c emergency the Mi ni ster may, by Order, for
the dur ati on of the per i od speci fi ed i n the Or der,
exempt from thi s Act any i ndustri al establ i shment
(a) bel ongi ng to or occupi ed by the State;

behal f of the State; or
(c) whose acti vi ti es ar e vi tal to the nati onal
wel fare.
(3) Wh er e an y of th e r i gh ts of an empl oy ee

GENERAL DUTI ES
6. (1) I t s h al l be th e du ty of ev er y empl oy er to
ensure, so far as i s reasonabl y practi cabl e, the safety,
heal th and wel fare at work of al l hi s empl oyees.
(2) Wi th ou t pr ej u di ce to th e gen er al i ty of an
empl oyer s duty under subsecti on (1), the matter s to
whi ch that duty extends i ncl ude i n parti cul ar
(a) the provi si on and mai ntenance of pl ant and

(g) compl i ance wi th secti ons 7, 12, 37, 46, 75
and 76, Par ts I I I and I X and such other
du ti es as may be i mpos ed on h i m by
regul ati ons made under thi s Act.
(3) An empl oyer shal l
(a) en s u r e th at al l h azar dou s ch emi cal s
present i n the i ndustri al establ i shment are
l abel l ed i n a way easi l y understandabl e to
the empl oyees, or ar e i denti fi ed i n the
prescri bed manner;
(b) obtai n or prepare, as may be prescri bed, an
unexpi r ed chemi cal safety data sheet for
al l hazar dous chemi cal s pr esent i n the
workpl ace;

(c) ensur e that the i denti fi cati on r equi r ed by
par agr aph (a) and chemi cal safety data
s h eets r equ i r ed by par agr aph (b) ar e

(d) ensure that when hazardous chemi cal s are
tr an s fer r ed i n to oth er con tai n er s or
equi pment, the contents are i ndi cated i n a
man n er wh i ch wi l l mak e k n own to
empl oy ees , thei r i denti ty, any hazar ds
associ ated wi th thei r use, and any safety
precauti ons to be observed; and
(e) ensure that i nformati on i s provi ded on the
h an dl i n g an d di s pos al of h azar dou s
chemi cal s whi ch are no l onger requi red and
contai ner s whi ch have been empti ed but
whi ch may contai n r esi dues of hazar dous
chemi cal s, so that the r i sk to safety and
h eal th an d to th e en v i r on men t i s
el i mi nated or mi ni mi zed.
(4) An empl oyer shal l ensur e that a hazar dous
ch emi cal i s n ot u s ed, h an dl ed or s tor ed i n th e
i n du s tr i al es tabl i s h men t u n l es s th e pr es cr i bed
requi rements concerni ng i denti fi cati on, chemi cal safety
data sheets and wor ker i nstr ucti on and tr ai ni ng ar e
met.
(5) An empl oyer shal l advi se the Chi ef I nspector
i n wr i ti ng i f the empl oyer, after maki ng r easonabl e
effor ts, i s unabl e to obtai n a l abel or chemi cal safety
data sheet requi red by subsecti on (3).
(6) A copy of th e mos t r ecen t v er s i on of th e
i nventory and of every unexpi red chemi cal safety data
sheet r equi r ed by thi s Par t i n r espect of hazar dous
chemi cal s i n a workpl ace shal l be
(a) made avai l abl e by the empl oyer i n such a
manner as to al l ow exami nati on by the
empl oyees;

(b) fu r n i s h ed by th e empl oy er to a

commi ttee, i f an y, or to an empl oy ee

(7) An empl oyer of an i ndustri al establ i shment of
twenty-fi ve or more empl oyees, shal l prepare or revi se,

empl oyees, a wr i tten statement of hi s gener al pol i cy
wi th r es pect to th e s afety an d h eal th of per s on s
empl oyed i n the i ndustri al establ i shment, speci fyi ng the
or gani zati on and ar r angements for the ti me bei ng i n
force for carryi ng out that pol i cy and the requi rements
of subsecti ons (1) to (6A), and the empl oyer shal l submi t
the statement and any r evi si on ther eof to the Chi ef
I nspector and br i ng them to the noti ce of al l per sons
empl oyed i n the i ndustri al establ i shment.
(7A) The Chi ef I nspector may, havi ng regard to the
statement submi tted under subsecti on (7) di r ect the
empl oy er to appoi nt at hi s own ex pense, a safety
practi ti oner who shal l assi st i n ensuri ng that the pol i cy
and the provi si ons speci fi ed i n secti on 6 are compl i ed
wi th.
(8) The Chi ef I nspector may di rect an empl oyer of
fewer than twenty-fi ve per sons to effect under hi s
super vi si on, a pr epar ati on or r evi si on of the type
referred to i n subsecti on (7).

(9) An empl oyer shal l , after bei ng noti fi ed by a
femal e empl oy ee th at s h e i s pr egn an t an d u pon
producti on of a medi cal certi fi cate to that effect, adapt
the wor k i ng condi ti ons of the femal e empl oyee to
ensure that she i s not
(a) i n v ol v ed i n th e u s e of, or ex pos ed to,
ch emi cal s , s u bs tan ces or an y th i n g
dan ger ou s to th e h eal th of th e u n bor n
chi l d; or
(b) subjected to worki ng condi ti ons dangerous
to the heal th of the unborn chi l d,
and wher e appr opr i ate, the empl oy er may as s i gn
al ter nati ve wor k , wher e avai l abl e, to her wi thout
prejudi ce to her ri ght to return to her previ ous job.
(10) Where a femal e empl oyee who has noti fi ed her
empl oyer of her pr egnancy under secti on 6(6) i s no
l onger pregnant she shal l i mmedi atel y upon di scovery
of thi s fact noti fy her empl oyer and shal l pr oduce a
medi cal certi fi cate to that effect.
(11) No empl oy er s h al l r equ i r e or per mi t a
pregnant empl oyee or an empl oyee who i s nursi ng her
chi l d to perform work that i s hazardous to her heal th or
the heal th of the chi l d.
(12) Notwi thstandi ng any other l aw, dur i ng an
empl oyees pr egnancy, and for a per i od of si x months
after bi r th of her chi l d, her empl oyer shal l offer her
s u i tabl e, al ter n ati v e empl oy men t on ter ms an d
con di ti on s th at ar e n o l es s fav ou r abl e th an h er
or di nar y ter ms and condi ti ons of wor k , wher e the
empl oyee i s r equi r ed to per for m wor k that poses a
danger to her safety or heal th or that of her chi l d,
unl ess there i s no other avai l abl e sui tabl e al ternati ve
empl oyment or that i n doi ng so the empl oyer wi l l i ncur
costs greater than ordi nary admi ni strati ve costs.
(13) An empl oyee may chal l enge a deci si on of the
empl oyer i n accordance wi th secti on 83(A).

conduct hi s undertaki ng i n such a way as to ensure, so
far as i s reasonabl y practi cabl e, that persons not i n hi s
empl oyment, who may be affected ther eby ar e not
thereby exposed to ri sks to thei r safety or heal th.
(2) I t shal l be the duty of ever y sel f-empl oyed
person to conduct hi s undertaki ng i n such a way as to
ensure, so far as i s reasonabl y practi cabl e, that he and
other per sons, not bei ng hi s empl oyees, who may be
affected by hi s acti ons are not thereby exposed to ri sks
to thei r safety or heal th.
(3) I n such cases as may be prescri bed, i t shal l be
the duty of ever y empl oyer and ever y sel f-empl oyed
per son, i n the pr escr i bed ci r cumstances and i n the
pr escr i bed manner, to gi ve to per sons, not bei ng hi s
empl oyees, who may be affected by the way i n whi ch he
conducts hi s under taki ng, the pr escr i bed i nfor mati on
about such aspects of the way i n whi ch he conducts hi s
undertaki ng as mi ght affect thei r safety or heal th.
8. (1) Subj ect to Par t X and except as other wi se

(3) The Chi ef I nspector may, havi ng regard to the
statement or the emer gency pl an submi tted under
subsecti on (2), di rect the occupi er to appoi nt at hi s own
expense, a Safety Pr acti ti oner who shal l assi st i n
ensuri ng that the pol i cy and the provi si ons speci fi ed i n
subsecti on (1) or the r equi r ements of the emer gency
pl an, as the case may be, are compl i ed wi th.
(4) An occu pi er s h al l en s u r e, as far as i s
reasonabl y practi cabl e, that no unsafe structure exi sts
i n the i ndustri al establ i shment that i s l i kel y to expose
persons to ri sks to bodi l y i njury.

9. (1) The occupi er of every i ndustri al establ i shment
shal l
(a) be under a duty to take steps wi thi n the
s tan dar ds es tabl i s h ed by th e
Envi r onmental Management Author i ty, to
protect the safety and heal th of the publ i c
i n th e v i ci n i ty of h i s i n du s tr i al
establ i shment from dangers created by the
oper ati on or pr ocesses car r i ed on ther ei n;
and
(b) take speci al care to ensure that pl ant and
equ i pmen t u s ed th er ei n ar e of s u ch
i ntegr i ty and that such adequate safety
systems exi st as to prevent the occurrence
of fugi ti ve emi ssi ons not confor mi ng wi th
an approved standard.
(2) Where the Chi ef I nspector i s of the vi ew that
the steps taken under subsecti on (1) are i nadequate, he
may
(a) i ssue di r ecti ons i n wr i ti ng to the occupi er
speci fyi ng the measures to be taken i n an
i ndustr i al establ i shment or i n i ts vi ci ni ty
to pr event i nj ur y to the publ i c and the
peri od wi thi n whi ch those measures are to
be taken; and
(b) advi se the envi r onmental management
author i ty, i n wr i ti ng, of the i nstr ucti ons
referred to i n paragraph (a).
(3) Di recti ons under subsecti on (2) may i ncl ude a

at work
(a) to take reasonabl e care for the safety and
heal th of hi msel f and of other persons who
may be affected by hi s acts or omi ssi ons at
work;
(b) as r egar ds an y du ty or r equ i r emen t
i mposed on hi s empl oyer to co-operate wi th
hi m so far as necessary to ensure that that
du ty or r equ i r emen t i s per for med or
compl i ed wi th;
(c) to r epor t to h i s empl oy er , an y
con tr av en ti on u n der th i s Act or an y
regul ati ons made thereunder, the exi stence
of whi ch he knows; and
(d) to use cor r ectl y the per sonal pr otecti on
cl othi ng or devi ces provi ded for hi s use.
(1A) A per s on wh o r efu s es to compl y wi th
subsecti on (1) commi ts a safety and heal th offence and
i s subject to the juri sdi cti on of the I ndustri al Court.
(2) An empl oy ee wh o wi l fu l l y an d wi th ou t
r easonabl e cause does anythi ng whi ch r esul ts i n the
death or cr i ti cal i nj ur y to another per son at wor k ,
commi ts an offen ce an d i s l i abl e to a fi n e of ten
thousand dol l ars.
(3) An empl oyer may di sci pl i ne, i n the customary
manner, an empl oyee who breaks the safety provi si ons
of thi s Act.

11. (1) No per s on s h al l wi l fu l l y or r eck l es s l y

safety, heal th or wel fare i n pursuance of thi s Act.
(2) A per son who contr avenes subsecti on (1)
commi ts an offen ce an d i s l i abl e, on s u mmar y
convi cti on to a fi ne of one thousand dol l ar s and to
i mpri sonment for three months.
12. (1) No empl oyer shal l l evy or permi t to be l evi ed
on any empl oyee of hi s i n respect of anythi ng done or
pr ovi ded i n pur suance of any speci fi c r equi r ement of
thi s Act, except i n respect of
(a) foods tu ffs an d oth er i tems s er v ed i n a
canteen;
(b) thi ngs l ost or damaged wi l ful l y or through
the negl i gence of the empl oyee; and
(c) pr otecti ve cl othi ng and devi ces wher e the
empl oyee i s empl oyed for one month or l ess.
(2) Amount l evi ed under subsecti on (1)(c), shal l
not be i n excess of one-hal f of the val ue of the protecti ve
cl othi ng or devi ces.
13. (1) A person who desi gns, manufactures, i mports or
suppl i es any technol ogy, machi nery, pl ant, equi pment or
materi al for use i n any i ndustri al establ i shment shal l
(a) ensure, so far as i s reasonabl y practi cabl e,
th at th e tech n ol ogy, mach i n er y, pl an t,
equi pment or materi al i s safe and wi thout
ri sks to heal th when properl y used;
(b) take such steps as are necessary to ensure
that ther e wi l l be avai l abl e i n connecti on
wi th the use of technol ogy, machi ner y,
pl ant, equi pment or mater i al , adequate
i nformati on about the use for whi ch i t was
des i gn ed an d tes ted an d abou t an y
condi ti ons necessary to ensure that i t wi l l
be safe and wi thout ri sks to heal th or the
envi ronment when properl y used.

(3) I t shal l be the duty of any person who erects or
i nstal l s any machi nery, pl ant, equi pment or component
thereof, i n any premi ses when that arti cl e i s to be used
by per sons at wor k to ensur e, as far as i s r easonabl y
practi cabl e, that nothi ng about the way i n whi ch i t i s
erected or i nstal l ed makes i t unsafe or exposes persons
to ri sks to thei r safety or heal th when properl y used.
(4) Nothi ng i n the pr ecedi ng pr ovi si ons of thi s
secti on shal l be taken to requi re a person to repeat any
tes ti n g, ex ami n ati on or r es ear ch wh i ch h as been
carri ed out otherwi se than by hi m or at hi s i nstance, i n
so far as i t i s reasonabl e for hi m to rel y on the resul ts
thereof for the purpose of those provi si ons.
(5) Any duty i mposed on any person by any of the
precedi ng provi si ons of thi s secti on shal l extend onl y to
thi ngs done i n the course of a trade, busi ness or other
undertaki ngs carri ed out by hi m (whether for profi t or
not) and to matters wi thi n hi s control .
(6) Wh er e a per s on des i gn s , man u factu r es ,
i mpor ts or suppl i es any technol ogy, machi ner y, pl ant,
equi pment or mater i al for, fr om or to another on the
basi s of a wr i tten under taki ng by that other to take
s peci fi ed s teps s u ffi ci en t to en s u r e, s o far as i s
reasonabl y practi cabl e, that the arti cl e wi l l be safe and
wi th ou t r i s k s to h eal th wh en pr oper l y u s ed, th e
undertaki ng shal l have the effect of rel i evi ng the fi rst-
menti oned person from the duty i mposed by subsecti on
(1) to such extent as i s reasonabl e havi ng regard to the
terms of the undertaki ng.

(b) i n the course of that busi ness acqui red hi s
i nter est i n the machi ner y suppl i ed to the
cu s tomer as a mean s of fi n an ci n g i ts
acqui si ti on by the customer fr om a thi r d
person (the effecti ve suppl i er),
the effecti ve suppl i er and not the ostensi bl e suppl i er
shal l be tr eated for the pur pose of thi s secti on as
suppl yi ng the technol ogy, machi nery, pl ant, equi pment
or materi al to the customer, and any duty i mposed by
the pr ecedi ng pr ovi si ons of thi s secti on on suppl i er s
shal l accordi ngl y fal l on the effecti ve suppl i er and not
on the ostensi bl e suppl i er.
(8) For the pur pose of thi s secti on, technol ogy,
machi ner y, pl ant or mater i al i s not to be r egar ded as
pr oper l y used wher e i t i s used wi thout r egar d to any
rel evant i nformati on or advi ce rel ati ng to i ts use whi ch
has been made avai l abl e by a person by whom i t was
desi gned, manufactured, i mported or suppl i ed.
(9) A person who sel l s or l ets on hi re, or as agent
of the sel l er or hi rer causes or procures to be sol d or l et
or hi r e, for use i n an i ndustr i al establ i shment, any
technol ogy, machi nery, pl ant or materi al whi ch does not
compl y wi th the requi rements of thi s secti on, commi ts
an offence and i s l i abl e on summary convi cti on to a fi ne
of ten thousand dol l ars.

RI GHTS OF EMPLOYEES TO REFUSE WORK WHERE
SAFETY OR HEALTH I N DANGER
14. (1) Thi s Part does not appl y wi th respect to an
empl oyee descri bed i n subsecti on (2)
(a) wh en a ci r cu ms tan ce des cr i bed i n
secti on 15(a), (b), (c) or (d), i s i nherent i n
th e empl oy ees wor k or i s a n or mal
condi ti on of the worker s empl oyment; or
(b) when the empl oyees refusal to work woul d

of another person.

to secti on 10(1)(c), shal l forthwi th take steps to compl y
wi th secti on 6(1) and report to the Chi ef I nspector the
exi stence of the danger and any steps that he has taken
or i ntends to take to remove the danger.

i ndustri al establ i shment, al l practi cabl e measures shal l
be tak en by the occupi er to pr otect the empl oyees
agai n s t i n h al ati on of th e du s t or fu mes or oth er
i mpu r i ty an d to pr ev en t i ts accu mu l ati on i n an y
workroom, and where the nature of the process makes

(9) Th e occu pi er s h al l , wi th i n th e per i od

by the noti ce, and upon thei r bei ng car r i ed out, the

deter mi nati on of the compl ai nt, the Cour t may, on ex
parte appl i cati on by the occupi er, make such i nter i m
orders as i t thi nks fi t.
(13) An exami nati on by the fi re authori ty under
th i s s ecti on s h al l be car r i ed ou t on l y by offi cer s
author i zed i n wr i ti ng by that author i ty (her ei nafter
r efer r ed to as author i zed offi cer s) to car r y out that

(14) An authori zed offi cer may, i n the exerci se of
hi s power s under subsecti on (13), be accompani ed by
any person approved by the fi re authori ty.
(15) An authori zed offi cer may, for the purposes
of exerci si ng hi s powers under subsecti on (13), enter an

that he produces documentary evi dence of hi s authori ty

(3) Each fi rst-ai d box or cupboard shal l be under
the contr ol of r esponsi bl e per sons who ar e tr ai ned i n
fi rst-ai d treatment and retested every three years and
wh o s h al l al way s be r eadi l y av ai l abl e du r i n g th e
worki ng hours of the factory.
(4) I n ever y factor y or i ndustr i al estate wher e
more than two hundred and fi fty persons are empl oyed,
there shal l be provi ded and mai ntai ned an ambul ance
and a fi rst-ai d room of a prescri bed si ze, contai ni ng the
prescri bed equi pment and bei ng i n the charge of such
medi cal and nursi ng staff as may be prescri bed, unl ess
the Chi ef I nspector, upon appl i cati on, exempts an

subject to subsecti on (2) appl y to those premi ses.
(2) Wh er e i n a ch ar i tabl e, edu cati on al ,
r efor mator y or penal i nsti tuti on to whi ch thi s Act
appl i es, the persons havi ng the control of the i nsti tuti on
(herei nafter referred to as the managers) sati sfy the
Mi ni ster that the onl y per sons wor ki ng ther ei n ar e
per sons who ar e r esi dents of and suppor ted by the
i nsti tuti on, or persons engaged i n the supervi si on of the
work or the management of machi nery, and that such
work i s carri ed on i n good fai th for the purposes of the
support, educati on or trai ni ng of persons engaged i n i t,
and that any posti ng r equi r ed by secti on 61 i s not
necessary, the Mi ni ster may, by Order, di rect that such
provi si ons of Part XI as to the posti ng of abstracts and
noti ces as the Mi ni ster thi nks fi t shal l not appl y.

to a fi ne of fi ve hundred dol l ars.
62. The occupi er of every factory shal l , at i nterval s of
not l ess than one year, send to the Chi ef I nspector a
correct return speci fyi ng wi th respect to such peri od as the
Mi ni ster may di rect, the number of persons empl oyed i n
hi s factor y, and gi vi ng such par ti cul ar s as may be
pr escr i bed, as to the hour s of empl oyment of each
empl oyee, as to the age, sex and occupati on of al l persons
empl oyed, and as to such other matters, i f any, as the
Mi ni ster may di rect.

functi ons; and
(c) to en s u r e th at i ts acti v i ti es ar e i n
accor dance wi th pr oposal s appr oved by
the Mi ni ster.
67. (1) For th e pu r pos e of pr ov i di n g pr acti cal
gui dance wi th r espect to the r equi r ements of any
provi si on of thi s Act or Regul ati ons made under i t, the
Authori ty may, subject to subsecti on (2)
(a) approve and i ssue such codes of practi ce,
whether pr epar ed by i t or not as i n i ts
opi ni on are sui tabl e for that purpose; and
(b) appr ove such codes of pr acti ce i ssued or
pr oposed to be i ssued other wi se than by
th e Au th or i ty as i n i ts opi n i on ar e
sui tabl e for that purpose.
(2) The Author i ty shal l not appr ove a code of
practi ce under subsecti on (1) wi thout the consent of the
Mi n i s ter an d s h al l , befor e s eek i n g h i s con s en t,

(a) any government department or other body

Author i ty under subsecti on (1), the Author i ty shal l
cause a noti ce to be publ i shed i n the Gazette and i n a
dai l y newspaper ci rcul ati ng i n Tri ni dad and Tobago
(a) i den ti fy i n g th e code i n qu es ti on an d
stati ng the date on whi ch i ts approval by
the Authori ty i s to take effect; and
(b) speci fyi ng for whi ch of the pr ovi si ons of
thi s Act or Regul ati ons made under i t, the
code i s approved.
(4) The Authori ty may
(a) from ti me to ti me revi se the whol e or any
part of any code of practi ce prepared by i t
i n pursuance of thi s secti on;
(b) appr ove any r evi si on or any pr oposed
r evi si on of the whol e or any par t of any
code of pr acti ce for th e ti me bei n g
approved under thi s secti on,
and the provi si ons of subsecti ons (2) and (3) shal l , wi th
the necessar y modi fi cati ons, appl y i n r el ati on to the
approval of any revi si on under thi s subsecti on as they
appl y i n rel ati on to the approval of a code of practi ce
under subsecti on (1).
(5) The Author i ty may at any ti me wi th the
consent of the Mi ni ster wi thdraw i ts approval from any
code of practi ce approved under thi s secti on, but before
seeki ng hi s consent shal l consul t the same government
departments and other bodi es as i t woul d be requi red
to consul t under subsecti on (2) i f i t were proposi ng to
approve the code.

(6) Wher e under subsecti on (5), the Author i ty
wi th dr aws i ts appr ov al fr om a code of pr acti ce
approved under thi s secti on, the Authori ty shal l cause
a noti ce to be publ i shed i n the Gazette and i n a dai l y

i denti fyi ng the code i n questi on and stati ng the date on
whi ch i ts approval of i t i s to cease to have effect.
(7) Refer ences i n thi s secti on to an appr oved
code of pr acti ce ar e r efer ences to that code as i t has
effect for the ti me bei ng by vi rtue of any revi si on of the
whol e or any part of i t approved under thi s secti on.
(8) The power of the Authori ty under subsecti on
(1)(b) to approve a code of practi ce i ssued or proposed to
be i ssued otherwi se than by the Authori ty shal l i ncl ude
power to approve a part of such a code of practi ce; and
accor di ngl y i n thi s secti on code of pr acti ce may be
read as i ncl udi ng part of such a code of practi ce.
68. (1) A fai l ure on the part of any person to observe
any provi si on of an approved code of practi ce shal l not
of i tsel f r ender hi m l i abl e to any ci vi l or cr i mi nal
proceedi ngs; but where i n any cri mi nal proceedi ngs a
party i s al l eged to have commi tted an offence by reason
of a contr aventi on of any r equi r ement or pr ohi bi ti on
i mposed by or under any provi si on of thi s Act bei ng a
pr ovi si on for whi ch ther e was an appr oved code of
pr acti ce at the ti me of the al l eged contr aventi on,
subsecti on (2) shal l have effect wi th respect to that code
i n rel ati on to those proceedi ngs.
(2) Any pr ovi si on of the code of pr acti ce whi ch
appears to the Court to be rel evant to the requi rement
or prohi bi ti on al l eged to have been contravened shal l be
admi ssi bl e i n evi dence i n the proceedi ngs; and i f i t i s
proved that there was at any materi al ti me a fai l ure to
observe any provi si on of the code whi ch appears to the
court to be rel evant to any matter whi ch i t i s necessary
for the pr osecuti on to pr ove i n or der to establ i sh a
contraventi on of that requi rement or prohi bi ti on, that

ADMI NI STRATI ON
69. (1) There i s hereby establ i shed the Occupati onal
Safety and Heal th Agency (her ei nafter r efer r ed to as
the Agency).
(2) The Agency shal l consi st of the fol l owi ng
persons who shal l be appoi nted by the Authori ty:
(a) an Executi ve Di r ector who shal l be the
head of the Agency;
(b) a Deputy Di rector;
(c) a Secretary; and
(d) such per sons who i n the opi ni on of the
Author i ty, have the necessar y tr ai ni ng,
qual i fi cati ons and exper ti se to assi st i n
the effecti ve management and del i veri ng
of the servi ces of the Agency.
(3) Th e Ex ecu ti v e Di r ector s h al l be th e
Accounti ng Offi cer on the Exchequer Account for the
Authori ty and shal l
(a) carry out any di recti ons gi ven to hi m
by th e Au th or i ty i n pu r s u an ce of i ts
functi ons; and

accordance wi th secti on 141 of the Consti tuti on.
(5) The Agency shal l not l ater than three months
after th e commen cemen t of th i s Act, i n i ti ate
consul tati on wi th gover nmental enti ti es per for mi ng
var i ous i nspecti on functi ons, wi th the obj ecti ve of
for mul ati ng memor anda of under standi ng or other
ar r angements between the Agency and such other
gov er n men tal en ti ti es , wh i ch s h al l es tabl i s h th e
mechani sms for co-ordi nati on across juri sdi cti onal l i nes
and pr ovi de for the i mpl ementati on of i ntegr ated
occupati onal safety and heal th programmes.
(6) The Agency, on the advi ce of the Author i ty,
may
(a) create; and
(b) di rect operati ons of,
other bodi es to gi ve effect to the Act.
69A. (1) An offi cer i n the publ i c ser vi ce may, wi th
the appr oval of the appr opr i ate Ser vi ce Commi ssi ons
consent to be appoi nted on transfer to the servi ce of the
Au th or i ty or th e Agen cy u pon s u ch ter ms an d
condi ti ons as are acceptabl e to hi m or hi s trade uni on
and the Authori ty.
(2) The offi cer r efer r ed to i n subsecti on (1)
s h al l , u pon tr an s fer , h av e pr es er v ed h i s
super annuati on and pensi on r i ghts accr ui ng at the
ti me of transfer.
70. (1) Th e Au th or i ty may appoi n t a s u i tabl y
qual i fi ed person as Chi ef I nspector.

enforcement of thi s Act, have power to do al l or any of

(a) to enter, i nspect, take photographs of and
exami ne, at al l r easonabl e ti mes, ei ther
al one or together wi th such other person

i ndustri al establ i shments;
(i) i n th e cas e of a medi cal i n s pector , to
conduct such medi cal exami nati ons as may
be necessary for the purposes of thi s Act;
(j) to take photographs for the purpose of any
i nvesti gati on; and
(k) to exer ci se such other power s as may be
necessary for the purposes of thi s Act.
(2) Every i nspector, i n the di scharge of hi s duti es
under thi s Act, i s empowered to requi re of an occupi er
the means necessary for entry, i nspecti on, exami nati on,
i nqui ry and, subject to secti on 73, the taki ng of sampl es
i n respect of premi ses to whi ch thi s Act appl i es.
(3) Any person who
(a) wi l ful l y del ays an i nspector i n the exerci se
of any power under thi s secti on;
(b) fai l s to compl y wi th the r equi si ti on of an
i nspector i n pursuance of thi s secti on, or to
pr oduce a r egi ster, cer ti fi cate, noti ce or
document whi ch he i s r equi r ed by or i n
pursuance of thi s Act to produce;
(c) wi l ful l y wi thhol ds i nformati on as to who i s
the occupi er of an i ndustri al establ i shment;
or
(d) conceal s or prevents, or attempts to conceal
or prevent, a person from appeari ng before
or bei ng exami ned by an i nspector,
i s deemed to h av e obs tr u cted an i n s pector i n th e
executi on of hi s duti es under thi s Act.

(4) Any person who obstructs an i nspector i n the
ex ecu ti on of h i s power s or du ti es u n der th i s Act,
commi ts an offen ce an d i s l i abl e, on s u mmar y
convi cti on, to a fi ne of two thousand dol l ar s and to
i mpri sonment for si x months.
73. (1) Where an i nspector suspects that an occupi er
may be i n contr aventi on of a pr ovi si on of thi s Act
rel ati ng to the use of dangerous materi al s or rel ati ng to
ai r contami nants, whi ch materi al s or contami nants are
l i kel y to cause bodi l y i njury to persons empl oyed i n an
i ndustri al establ i shment, he may, after gi vi ng noti ce to
the occupi er, or i f the occupi er i s not readi l y avai l abl e,
to h i s agen t, tak e for an al y s i s s ampl es of an y
mater i al s or ai r con tami n an ts i n th e i n du s tr i al
establ i shments.
(2) The occupi er or hi s agent shal l be pr esent
wh en th e s ampl es ar e bei n g tak en , an d, wh er e
practi cabl e, the i nspector shal l di vi de each sampl e i nto
three parts, mark and seal or fasten each part i n such
manner as i ts nature permi ts, and
(a) del i v er on e par t to th e occu pi er or h i s
agent;
(b) retai n one part for future compari son; and
(c) submi t one part to the anal yst.
(3) Every anal ysi s made under thi s secti on shal l
be conducted by the Chi ef Chemi s t or s uch other
sui tabl y qual i fi ed anal yst as the Chi ef Chemi st may
authori ze i n wri ti ng.
(4) The Chi ef Chemi st or the qual i fi ed anal yst
shal l i n wr i ti ng, i nfor m the i nspector who submi tted
the sampl e for anal ysi s and the occupi er or hi s agent of
the resul ts of the anal ysi s.

(b) a p r oces s or wor k i s ca r r i ed on or
a n y th i n g i s or h a s been d on e i n a n

damage to the envi r onment;
(c) an i ndustr i al establ i shment i s i n such a

AUTHORI TY RULES
1. These Rul es may be ci ted as the Occupati onal Safety and
Heal th Authori ty Rul es.
2. The Mi ni stry shal l provi de the Authori ty wi th an offi ce and
other faci l i ti es, secretari al staff and other support servi ces as the
Authori ty requi res to effi ci entl y perform i ts functi ons.
3. The appoi ntment of a per son, other than the Executi ve
Di rector, as a member of the Authori ty shal l be for a term of three
years, but outgoi ng members are el i gi bl e for reappoi ntment.
4. (1) The Chai rman or Deputy Chai rman may resi gn at any
ti me by i nstrument i n wri ti ng addressed to the Mi ni ster.
(2) A member, other than the Chai rman, Deputy Chai rman
and the Executi ve Di rector, may resi gn at any ti me by i nstrument
i n wr i ti ng addr essed to the Chai r man, who shal l cause i t to be
forwarded to the Mi ni ster.
5. The Mi ni ster may at any ti me revoke the appoi ntment of a
per son, other than the Executi ve Di r ector , as Chai r man or as a
member of the Boar d and decl ar e hi s offi ce as a member to be
vacant i f sati sfi ed that the person
(a) has, wi thout r easonabl e excuse, fai l ed to attend the

(b) at an y oth er ti me as th e Ch ai r man may , i n h i s
di screti on, deem necessary for the performance of the
functi ons of the Authori ty.
8. (1) The Chai rman
(a) may at any ti me cal l a speci al meeti ng of the Authori ty;
(b) shal l cal l a speci al meeti ng wi thi n seven days of
recei vi ng a request, i n wri ti ng, to do so si gned by any
three members of the Authori ty;
(c) shal l cause noti ces to be i ssued to al l member s i n
respect of every speci al meeti ng.
(2) Ev er y r equ es t for a s peci al meeti n g s h al l i n cl u de
suffi ci ent i ndi cati on of the purpose of the requested meeti ng.
9. At any meeti ng of the Author i ty, seven member s of the
Authori ty shal l consti tute a quorum.
10. The Chai rman, or i n hi s absence, the Deputy Chai rman,
shal l pr esi de over al l meeti ngs, except that wher e both the
Chai r man and the Deputy Chai r man ar e absent, the Author i ty
may appoi nt one of the members present to presi de at the meeti ng.
11. (1) Mi nutes of each meeti ng i n proper form shal l be kept
under the di recti on of the Executi ve Di rector.
(2) Al l deci si ons, resol uti ons and standi ng orders made by
the Authori ty shal l be recorded i n the mi nutes.
(3) The mi nutes shal l be confi rmed at the next meeti ng of
the Authori ty and a copy of the mi nutes both when prepared and
confi rmed shal l be forwarded to the Mi ni ster.

12. The deci si ons of the Author i ty shal l be by a major i ty of

13. The Author i ty may co-opt any per son to attend any
parti cul ar meeti ng of the Authori ty for the purpose of assi sti ng or
advi si ng the Authori ty, but a co-opted person shal l not have any
ri ght to vote.
14. (1) The Authori ty may appoi nt a commi ttee
(a) to exami ne and report to i t on any matter whatsoever
ari si ng out of or connected wi th any of i ts duti es and
powers; or
(b) to assi st i t i n i ts busi ness and may, for that purpose,
del egate such duti es and power s as i t may consi der
necessary to that commi ttee.
(2) A commi ttee appoi nted under subrul e (1) shal l consi st
of at l east one member of the Authori ty.
(3) Wher e per sons not bei ng member s of the Author i ty
ar e member s of a commi ttee, the Author i ty may, wi th the pr i or
approval of the Mi ni ster, appoi nt them on such terms and at such
remunerati on as the Mi ni ster may approve.
(4) The Author i ty may r eject the r epor t of a commi ttee
appoi nted under subr ul e (1)(a) or adopt i t ei ther whol l y or wi th
such modi fi cati ons, addi ti ons or adapti on as the Author i ty may
thi nk fi t.
15. The member s of the Author i ty shal l be enti tl ed to such
remunerati on as the Presi dent may approve.
16. The Authori ty may make i ts own standi ng orders for the
regul ati on of i ts proceedi ngs.
