The defendants Emergency Motion Under Circuit Rule 27-3 to Stay
Issuance of Mandate and to Remand to District Court to Develop the Record, filed
October 23, 2014, is DENIED.
The defendants alternative request to stay the mandate pending the filing of
a petition for a writ of certiorari in the Supreme Court, see Fed. R. App. P.

41(d)(2), is also DENIED. Judges OScannlain, Tallman and Watford dissent


from this portion of the courts order.
