Montgomery Brown PETITIONING THE COURT ‘The defendant has not complied with the following condition of Pretrial supervision: Violation Nature of Non-Compliance 1) New Drug Use a) On October 7, 2014, the defendant reported to the U.S, Probation Office and submitted a urinalysis. The test was presumptive positive for the presence of marijuana. The test was sent to Alere Laboratory for confirmation, b) On October 10, 2014, the results confirmed the defendants use of marijuana from the specimen collected on October 7, 2014. ©) On October 21, 2014, the defendant reported to the Probation Office and submitted a urinalysis, ‘The test was presumptive positive forthe presence of marijuana and was sent to Alere Laboratory for confirmation, Case 4:14-cr-00103-RP-CFB Document 24 Filed 11/12/14 Page 2 of 3 Page 2 4) On October 24, 2014, laboratory results ‘confirmed the presence of marijuana from the specimen collected on October 21, 2014. U.S. Probation Officer Action: ‘The Probation Office requests the defendant undergo a substance abuse evaluation and follow through with treatment, if recommended. Additionally, this officer will complete journaling with the defendant. Background Information: (On August 27, 2014, the defendant appeared in Court for his initial appearance before Chief United States Magistrate Judge Celeste Bremer. He was released on bond the same date with Pretrial Service supervision. The defendant has maintained full-time employment. The defendant has continued to deny any new use of marijuana. On October 27, 2014, this officer submitted a drug interpretation request to Alere Toxicology Services. On October 28, 2014, the ‘toxicologists opinion was thatthe defendant reused marijuana prior to the collections on October 7 and October 21. ‘This was based on the “lack of significant decrease in the normalized level of drug present” in the specimens collected on those days.
