I conducted a case management conference (CMC) on August 14,2013.

By agreement of the parties a "phase one" bifurcated bench trial is set for Monday

20

February 3, 2014. This will resolve (i) the issues which in my last CMC order I described as the

21

'statute of limitations' issues, under which some parties contend I may not pass on the validity

22

of certain contracts or administrative decisions, as well as (ii) the 'I 090' issue, that is, whether

23
certain agreements are void or valid as a result of the alleged violation of Govt.C. 1090 by one

Stephen Collins.

The next CMC is set for October 10, 2013 at 9:00a.m. Among other things, the parties'

27

joint CMC statement should address the parties' views on the length of the hearing for phase I,

whether it will include presentation of live testimony, and proposed briefing schedules for the
hearing.
