Dear Sir or Madam:


Please be advised that a pre-hearing conference was held on Thursday, December 11, 2014 at which
you failed to appear to address the above incident and pending charge under 204 CMR 2.05 for no
manager of record working on the premises. Based upon your failure to answer the charge, the police
reports submitted regarding the above incident, and the Boards knowledge that the manager of
record, Eric Maldonado, is no longer working on premises (pursuant to testimony provided to the
commission by Mr. Maldonado on his application to be appointed manager of record at another
establishment) the Board found you in violation of Massachusetts General Laws and/or Regulations.
Additionally the board found that this matter constitutes an emergency as the Board has no
knowledge of the party currently operating the licensed establishment. The Board approved this
finding regarding the following:
1. Violation of 204 CMR 2.05 (2) Permitting an illegality on the licensed premises to wit: No
Manager of Record Currently Working on Premises. VIOLATION FOUND.
After making the above findings the Board voted to suspend your license effective December 12,
2014 until such time as an application for new manager of record can be heard and approved by the
Board. Accordingly your legal right to sell alcohol has been suspended and continuing to do so will
be in violation of Massachusetts Law. All alcohol should be removed from the premises and your
license should be surrendered to the License Commission Office Immediately. The Springfield
Police Department will be notified of the suspension in order to ensure compliance with state law.

You are advised that you have the right to appeal this Decision under Massachusetts General Laws,
chapter 138, section 67 to the Alcohol Beverages Control Commission, 239 Causeway Street, Suite
200, Boston, Massachusetts 02114, within five (5) days receipt of same.
