The petitioners are accused in connection with Complaint Case


No. 579/2009 for the offence under Sections 323/ 341/ 379/ 420/ 120(B)/
417/ 406 of the Indian Penal Code in which, cognizance has been taken
under Sections 323/ 341/ 379/ 403/ 417/ 34 of the Indian Penal Code.
It reveals from the complaint that Hyva Tripper belonging to the
complainant was given to the petitioners at the instance of accused nos. 2
and 3 on hire but the accused persons have failed to make payment and
hence this case.
It is submitted that this case is an outcome of the business
transaction and even assuming that the petitioners have taken vehicle on
hire, the complainant can sue them for recovery of the amount.
Learned counsel for the State has opposed prayer for anticipatory
bail of the petitioners.
Considering the facts and circumstances of the case, the
petitioners abovenamed are directed to surrender before the Trial Court
within a period of three weeks from today and on such surrender, they are
directed to be released on bail on furnishing bail bonds of Rs.10,000/(Rupees Ten Thousand) each, with two sureties of the like amount each, to
the satisfaction of Judicial Magistrate, Dhanbad

in connection with

Complaint Case No. 579/2009, subject to the condition as laid down under
Section 438(2) of the Cr.P.C..
