"PUNITIVE POPULISM"OF THE SERBIAN LAWMAKER: CRITICAL ANALISYS
OF THE SO-CALLED MARYS LAW
Summary: In this paperwork the author deals with a critical analysis of the socalled Mary's Law - the Law on Special Measures for the Prevention of Committing Criminal Acts of Sexual Abuse of Juveniles. Within this Law the author recognizes a series of
inadequate legal solutions that may endanger a number of well structured and proven criminal justice institutes. Thus solutions within the Law violates the purpose of punishment,
criminal sanctions, rehabilitation, criminal records and many other. The purpose of special
measures prescribed in this Law cannot be logical achieved and the legal nature of these
measures is questionable to the extent that the question whether they are even sanctions
may be raised. In authors opinion the cause of such solutions may be found in the inadequate standardization and unskilled legislative technique that violate logic and thorough coherence of the criminal justice system in the manner that even the fundamental distinction
between the general and incidental criminal legislation cannot be recognized. Serbian legislator seems to be succumbed by the psychology of punitive society or punitive public in the
worst possible way - punitive populism, the author concludes.
