Contractual wording notice

Employees refusing to work their notice period is a common issue for
employers. The wording below could be implemented into your contracts of
employment to deter employees from leaving without working their notice and
also help you minimise your losses where they do leave without giving proper
notice.
Deduction from wages notice periods
It is a condition of this employment that you give proper notice of
termination of this employment and attend work for the duration of that
period, except where expressly agreed otherwise by the company.
If you fail to attend work for all or part of your notice period then you agree
that:
1. You will not be paid for any day that you do not attend work; and
2. You agree that the company may deduct from any monies owing to
you (including wages, bonus payments, commission, expenses and
payment in lieu of accrued holiday pay) an amount equivalent to
your normal wages which you would have earned for the period of
notice during which you failed to attend work.

Reduction of outstanding holiday pay notice period


Where this employment is terminated for the reason of gross misconduct or
where you resign without giving or working your full notice period then you
shall only be entitled to payment of a sum of 5.00 in respect of any annual
leave entitlement which you had accrued but not taken up to the date this
employment terminates.
