TO : PROVINCIAL GOVERNORS, CITY MAYORS, MUNICIPAL MAYORS, ARMM
REGIONAL GOVERNOR, AND DILG REGIONAL DIRECTORS
SUBJECT: STRICT ENFORCEMENT OF THE REQUIRED EASEMENT ON NATIONAL
ROADS AND PROTECTION OF THE ROAD RIGHT OF WAY FROM
INTRUSIONS AND ILLEGAL STRUCTURES
Last month, June, 2010, there were reports on a series of fatal vehicular
accidents in Cebu. It is claimed that some of the fatalities and injuries could have been
avoided if the road right of way were respected.
It is a common knowledge that road accidents inflict a tremendous continuing
burden on the disabled victims and their families, and push poor families deeper into
poverty by the loss of their breadwinners.
In view thereof, all Local Chief Executives are directed to strictly enforce the
easement standard of three (3) meters on both sides of a national road, and to protect
the road right of way from intrusions and illegal structures, e.g., waiting sheds,
makeshift stalls and makeshift eateries. Immediate removal of such illegal structures is

All DILG Regional Directors and the Regional Governor of the ARMM Regional
Government are likewise directed to:
1. Cause the dissemination of this Memorandum Circular to all local government
authorities within their regional jurisdictions;
2. Monitor local government compliance and call attention to inaction; and
3. Submit a Local Government Com, to reach the Office of the
Secretary before but not later
