CASES FOR PRESENTATION AND DEFENSE: LEGAL FORMS

INTRUCTIONS:
1. Choose your own group members -not more than 5
2. Prepare a case theory with TRIAL BRIEF (showing the positions, defense, evidence of the
contending parties)
3. Prepare the pertinent pleadings and motions from the inception/institution of the case up to
its termination.
4. Case Presentation- not exceeding 20 minutes
5. Submit your your pleadings and Motions in hard copy 2 days before the scheduled
defense
6. Failure to comply no. 6 within the required period shall constitute a waiver of your defense
and an end term grade of 65%
7. Schedule of presentation and defense will be on February 28, March 14 and March 28:
February 28 - CIVIL CASE
March 14 CRIMINAL CASE
March 28 SPECIAL PROOCEEDINGS
NOTE:
1. you can choose any case (of your own choice) falling within the jurisdiction of the MTCC/
MTC or RTC
2. groups must prepare pleadings and motions for both the plaintiff and the defendant (Civil
Case), complainant and the respondent/accused (Criminal Case) , Petitioner and
Respondent (Special Proceedings)
3. pleadings and motions MAY include the following:
CIVIL CASE:
- COMPLAINT, (MOTION FOR BILL OF PARTICULARS/DISMISS, PROVISIONAL
REMEDIES ETC.), ANSWER, REPLY, REJOINDER, PRE TRIAL BRIEF, JUDICIAL
AFFIDAVITS, FORMAL OFFER OF EXHIBITS, COMMENT/OPPOSITION MEMORANDUM)
CRIMINAL CASE
- COMPLAINT-AFFIDAVIT, COUNTER-AFFIDAVIT (WITH ATTACHMENTS/EVIDENCE),
RESOLUTION, INFORMATION, MOTION TO QUASH, PRE-TRIAL BRIEF, JUDICIAL
AFFIDAVITS, DEMURRER TO EVIDENCE, FORMAL OFFER OF EXHIBITS,
COMMENT/OPPOSITION, MEMORANDUM

SPECIAL PROCEEDINGS
PETITION (CONTAINING JURISDICTIONAL REQUIREMENTS), OPPOSITION,
INTERVENTION, PRE-TRIAL BRIEF (IF APPLICABLE), JUDICIAL AFFIDAVITS,
APPLICABLE MOTIONS, FORMAL OFFER OF EXHIBITS, COMMENT/OPPOSITION
